"particularly because of new and material facts that have come to the knowledge of the petitioners after filing of the petition on December 28, 2012 which will have a significant effect on the results as declared by the second respondent".

What Akuffo Addo and Co are disingenuously attempting to do is to submit a new petition under the cloak of correcting typographical errors. The election was held on 7th December 2012. The material facts were available in the 21 days that they were permitted to petition the Supreme Court. Since their submission no activity has been organized by the Electoral Commissioner by way of an election to create new material facts.

They are passing of their lack of diligence, shortsightedness and oversight as new material facts. In essence they are submitting a new petition which is now asking for the disenfranchisement of 4 million votes not the 1.3 million originally stated. They now propose to call 45 witnesses and not the 15 originally stated. They haven't as yet stated how the annulled votes would still show Akuffo Addo as winner with 51% of the votes. And nowhere in their petition did they state that their audit wasn't complete and that they would be submitting supplementary evidence. They still shy away from substantiating their declaration made before the EC declaration.

They were busy organizing press conferences and did not realize that the petition had typographical errors. That is the level of competence that they want the nation's affairs to be entrusted with.

It is gone from being the historical court case in the land to being the most farcical.

By the time the NPP finalises the scrutiny of the votes cast in all the polling stations of the country, the ONLY VALID VOTES to be declared in Ghana will be votes received by NPP parliamentary candidates and the Presidential candidate (Nana Addo Dankwa Akufo Addo).

We will give them (the petitioners) another month to make the final amendment to their petition (with the remaining 10% polling stations to be examined) and then we will know that they will pray the SC to strike out all votes except those cast in their favour.

If this story is to be believed, the petitioners are asking for nearly 46 per cent of the total votes cast to be annulled. Surely if this were to be accepted, then a complete re-run of the elections will be required. Are we seriously saying that over 4.6 million REGISTERED VOTERS whose names were on the electoral list voted incorrectly? May be it is time for the real "LET MY VOTE COUNT COALITION" to emerge.

If there were 'irregularities associated with 5% of the votes, I would accept that it is bad enough but nearly 50% means either the EC is completely incompetent or there has been a massive fraud beyond all proportions. Is it the latter that the petitioners are claimin in Ghana? Then our democracy is in real trouble! Think seriously again.

THAT THE OUTCOME WAS THAT NANA AKUFO ADDO INSULTED US THE (VOLTA REGION PEOPLE WHEN HE SAID "SHAME, SHAME UNTO VOLTA REGION PEOPLE". THAT I MYSELF BECAME UNDER ATTACK IN RICHMOND, VIRGINIA WHEN H.E.DR.MR.PRESIDENT BARACK OBAMA DULY ASKED ME TO UNDERTAKE A RESEARCH WORK ON THE HEALTH CARE REFORM BILL" AND I WENT TO BARNES & NOBLE BOOKSTORE AT VIRGINIA COMMONWEALTH UNIVERSITY (VCU) CAMPUS WHERE PUBLIC COMPUTERS WERE INSTALLED FOR PUBLIC USE ON JUNE 2, 2009 THAT A PURPORTED VCU POLICE OFFICER WITH THE NAME FISH FALSELY ARRESTED ME THAT I TRESPASSED TO THE BOOKSTORE AND INTIMATED THAT SOMEONE CALLED PAGE INTIMATED HE BANNED FROM THE UNIVERSITY CAMPUS IN 2007 AND I CAME THERE ON JUNE 2, 2009 THEREFORE I TRESPASSED TO THE BOOKSTORE.
THAT AT THE TIME THE UNIVERSITY EVALUATED ALL MY GHANAIAN EDUCATIONAL/PROFESSIONAL TRANSCRIPTS WITH MY THESIS AND ADVISED THAT "! AM A COMMUNITY BUILDER AND TO JOIN THE ICMA"/ HOWEVER, THEY INTIMATED THAT SOMEONE INSTRUCTED THAT THEY SHOULD PUT MY AMERICAN EQUIVALENT ON HOLD" AND UPTIL NOW THE AMERICAN EQUIVALENT HAS NOT BEEN GIVEN TO ME.

THEREFORE IN ACCORDANCE WITH C.I 74 AND PART V- OF THE SUPREME COURT RULES THAT THAT DEAL WITH FURTHER AND BETTER PARTICULARS AND REVIEW RESPECTIVELY THAT THE PETITIONERS CHALLENGING THE PRESIDENTIAL RESULTS PRELIMINARY ACTION HAS NO LEGAL BASIS AND TO BE DISMISSED.
THAT ALSO UNDER CHAPTER 8 ARTICLE 57 SECTIONS 4,5,6 THAT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE HE IS NOT AMENDABLE TO THE COURTS OF GHANA AND THEREFORE THE COURT TO CONSIDER TO INVOKE ITS OWN ACTION "SUO MOTTO" TO STRIKE OUT OR DISMISS THE CASE AGAINST THE PRESIDENT.

The Chairman for the Electoral Commission, Dr kwadwo Afari Gyan has declared Ghana’s incumbent president John Dramani Mahama, the winner of the 2012 presidential elections.
President Mahama who ran on the ticket of the governing National Democratic Congress (NDC), polled 5,574,761 representing 50.70% to win the polls held on Friday and Saturday.
The presidential candidate of the New Patriotic Party (NPP), Akufo-Addo had 5,248,898 of the valid votes cast, representing 47.74%.
Out of a total of 14,158,890 registered voters, 11,246,982 voters exercised their franchise. 10,995,262 of this number were deemed valid. The total rejected votes stood at 251,720. The turnout in the 275 constituencies is 79.43%

The President
(1) There shall be a President of the Republic of Ghana who shall be the Head of State and Head of Government and Commander-in Chief of the Armed Forces of Ghana.
Electoral Commission
(2) The President shall take precedence over all other persons in Ghana; and in descending order, the Vice-President, the Speaker of Parliament and the Chief Justice, shall take precedence over all other persons in Ghana.
(3) Before assuming office the President shall take and subscribe before Parliament the oath of allegiance and the presidential oath set out in the Second Schedule to this Constitution.
(4) Without prejudice to the provisions of article 2 of this Constitution, and subject to the operation of the prerogative writs, the President shall not, while in office, be liable to proceedings in any court for the performance of his functions, or for any act done or omitted to be done, or purported to be done, or purported to have been done or purporting to be done in the performance of his functions, under this Constitution or any other law.
(5) The President shall not, while in office as President, be personally liable to any civil or criminal proceedings in court.
(6) Civil or criminal proceedings may be instituted against a person within three years after his ceasing to be President, in respect of anything done or omitted to be done by him in his personal capacity before or during his term of office notwithstanding any period of limitation except where the proceedings had been legally barred before he assumed the office of President.

(1) A person shall not be a candidate in a presidential election unless he is nominated for election as President by a document which -
(a) is signed by him; and
(b) is signed by not less than two persons who are registered voters resident in the area of authority of each district assembly;
(c) is delivered to the Electoral Commission on or before the day appointed as nomination day in relation to the election;
(d) designates a person to serve as Vice-President.
(2) The election of the President shall be on the terms of universal adult suffrage and shall, subject to the provisions of this Constitution, be conducted in accordance with such regulations as may be presecribed by constitutional instrument by the Electoral Commission and shall be held so as to begin -
(a) where a President is in office, not earlier than four months nor later than one month before his term of office expires; and
(b) in any other case, within three months after the office of President becomes vacant; and shall be held at such place and shall begin on such date as the Electoral Commission shall, by constitutional instrument, specify.
(3) A person shall not be elected as President of Ghana unless at the presidential election the number of votes cast in his favour is more than fifty per cent of the total number of valid votes cast at the election.
(3) Where at the close of nominations under clause (2) of this article only one candidate stands nominated, there shall be no election and that candidate shall be declared elected.
(4) Where at a presidential election there are more than two candidates and no candidate obtains the number or percentage of votes specified in clause (3) of this article a second election shall be held within twenty-one days after the previous election.
(5) The candidates for a presidential election held under clause (4) of this article shall be the two candidates who obtained the two highest numbers of votes at the previous election.
(6) Where at a presidential election three or more candidates obtain the two highest numbers of votes referred to in clause (5) of this article, then unless there

CHAPTER 007

THE CONSTITUTION OF THE REBUPLIC OF GHANA 1992

Right to Vote
Every citizen of Ghana of eighteen years of age or above and of sound mind has the right to vote and is entitled to be registered as a voter for the purposes of public elections and referenda.
Electoral Commission
43
(1) There shall be an Electoral Commission which shall consist of -
(a) a Chairman;
(b) two Deputy Chairmen; and
(c) four other members.
(2) The members of the Commission shall be appointed by the President under article 70 of this Constitution.

(1) A person is not qualified to be appointed a member of the Electoral Commission unless he is qualified to be elected as a member of Parliament.
(2) The Chairman of the Electoral Commission shall have the same terms and conditions of service as a Justice of the Court of Appeal.
(3) The two Deputy Chairman of the Commission shall have the same terms and conditions of service as are applicable to a Justice of the High Court.
(4) The Chairman and the two Deputy Chairmen of the commission shall not, while they hold office on the Commission, hold any other public office.
(5) The other four members of the Commission shall be paid such allowances as Parliament may determine.
(6) If a member is absent or dies, the Commission shall continue its work until the President, acting on the advice of the Council of State, appoints a qualified person to fill the vacancy.

The Electoral Commission shall have the following functions -
(a) to compile the register of voters and revise it at such periods as may be determined by law;
(b) to demarcate the electoral boundaries for both national and local government elections;
(c) to conduct and supervise all public elections and referenda;
(a) the guarantee of a fair and realistic remuneration for production and productivity in order to encourage continued production and higher productivity;
(d) to educate the people on the electoral process and its purpose;
(e) to undertake programmes for the expansion of the registration of voters; and
(f) to perform such other functions as may be prescribed by law.

Except as provided in this Constitution or in any other law not inconsistent with this Constitution, in the performance of its functions, the Electoral Commission, shall not be subject to the direction or control of any person or authority.
47(1) Ghana shall be divided into as many constituencies for the purpose of election of members of parliament as the Electoral Commission may prescribe, and each constituency shall be represented by one member of Parliament.
(2) No constituency shall fall within more than one region.
(3) The boundaries of each constituency shall be such that the number of inhabitants in the constituency is, as nearly as possible, equal to the population quota.
(4) For the purposes of clause (3) of this article, the number of inhabitants of a constituency may be greater or less than the population quota in order to take account of means of communication, geographical features, density of population and area and boundaries of the regions and other administrative or traditional areas.
(5) The Electoral Commission shall review the division of Ghana into constituencies at intervals of not less than seven years, or within twelve months after the publication of the enumeration figures after the holding of a census of the population of Ghana, whichever is earlier, and may, as a result, alter the constituencies.
(6) Where the boundaries of a constituency established under this article are altered as a result of a review, the alteration shall come into effect upon the next dissolution of Parliament.
(7) For the purposes of this article, "population quota" means the number obtained by dividing the number of inhabitants of Ghana by the number of constituencies into which Ghana is divided under this article.

(1) A person aggrieved by a decision of the Electoral Commission in respect of a demarcation of a boundary, may appeal to a tribunal consisting of three persons appointed by the Chief Justice and the Electoral Commission shall give effect to the decision of the tribunal.

(1) At any public election or referendum, voting shall be by secret ballot.
(2) Immediately after the close of the poll, the presiding officer shall, in the presence of such of the candidates or their representatives and their polling agents as are present, proceed to count, at that polling station, the ballot papers of that station and record the votes cast in favour of each candidate or question.
((3) The presiding officer, the candidates or their representatives and, in the case of a referendum, the parties contesting or their agents and the polling agents if any, shall then sign a declaration stating -
(a) the polling station; and
((b) the number of votes cast in favour of each candidate or question: and the presiding officer shall, there and then, announce the result of the voting at the polling station before communicating them to the returning officer.
(4) Subject to the provisions of this Constitution, an issue for determination by referendum shall not be taken to be determined unless at least thirty-five percent of the persons entitled to vote at the referendum voted and, of the votes cast, at least seventy percent voted in favour of the issue.

(1) Subject to the provisions of this Constitution, where at the close of nominations and on the day before a public election -
(a) two or more candidates have been nominated, the election shall be held and the candidate who receives the largest number of votes cast shall be declared elected; or
(b) only one candidate is nominated, there shall be no election and that candidate shall be declared elected.
(2) Where for the purposes of a public election two or more candidates are nominated but at the close of the nominations and on the day before the election, only one candidate stands nominated, a further period of ten days shall be allowed for nomination of other candidates, and it shall not be lawful for any person nominated within that period of ten days to withdraw his nomination.
(3) Where at the close of nominations under clause (2) of this article only one candidate stands nominated, there shall be no election and that candidate shall be declared elected.
(4) Where at the close of nominations, but before the election, one of the candidates dies, a further period of ten days shall be allowed for nominations; and where the death occurs at any time within twenty-five days before the election, the election in that constituency or unit shall be postponed for twenty one days.
51The Electoral Commission shall, by constitutional instrument, make regulations for the effective performance of its functions under this Constitution or any other law, and in particular, for the registration of voters, the conduct of public elections and referenda, including provision for voting by proxy.52
There shall be in every region and district a representative of the Electoral Commission who shall perform such functions as shall be assigned to him by the Commission.

The appointment of officers and other employees of the Electoral Commission shall be made by the Commission acting in consultation with the Public Services Commission.

The administrative expenses of the Electoral Commission including salaries, allowances and pensions payable to, or in respect of persons serving with the Commission, shall be charged on the Consolidated Fund.

Political Parties
(1) The right to form political parties is hereby guaranteed.
(2) Every citizen of Ghana of voting age has the right to join a political party.
(3) Subject to the provisions of this article, a political party is free to participate in shaping the political will of the people, to disseminate information on political ideas, social and economic programmes of a national character, and sponsor candidates for election to any public office either than to district assemblies or lower local government unit.
(4) Every political party shall have a national character, and membership shall not be based on ethnic, religious, regional or other sectional divisions.
(5) The internal organisation of a political party shall conform to democratic principles and its actions and purposes shall not contravene or be inconsistent with this constitution or any other law.
(6) An organisation shall not operate as a political party unless it is registered as such under the law for the time being in force for the purpose.
(7) For purposes of registration, a prospective political party shall furnish the electoral commission with a copy of its constitution and the names and addresses of its national officers: and shall satisfy the commission that -
(a) there is ordinarily residence, or registered as a voter in each district of Ghana, at least one founding member of the party:
(b) the party has branches in all the regions of Ghana and is, in addition, organised in not less than two thirds of the districts of each region; and
(c) the parties name, emblem, colour, motto or any other symbol has no ethnic, regional, religious or other sectional connotations or gives the appearance that it activities are confined only to a part of Ghana.
(8) A political party shall not have as a founding member, a leader or a member of its executives, a person who is not qualified to be elected as a Member of Parliament or to hold any other public office.
(9) The members of the national executive committee of a political party shall not be chosen from all the regions of Ghana.
(10) Subject to the provisions of this constitution, every citizen of voting age has the right to participate in political activity intended to influence the composition and policies of the Government.
(11) The state shall provide fair opportunity to all political parties to present their programmes to the public by ensuring equal access to the state-owned media.
(12) All presidential candidates shall be given the same amount of time and space on the state-owned media to present their programmes to the people.
(13) Every candidate for election to Parliament has the right to conduct his campaign freely and in accordance with law.
(14) Political parties shall be required by law-
(a) to declare to the public their revenues and assets and the sources of those revenues and assets; and
(b) to publish to the public annually their audited accounts.
(15) Only a citizen of Ghana may make a contribution or donation to a political party registered in Ghana.
(16) A member of an organisation or interest group shall not be required to join a particular political party by virtue of his membership of the organisation or group.
(17) Subject to the provisions of this Chapter, Parliament shall by law regulate the establishment and functioning of political parties.

Parliament shall have no power to enact a law to establish or authorise the establishment of a body or movement with the right or power to impose on the people of Ghana a common programme or a set of objectives of a religious or political.

Former President Olusegun Obasanjo of Nigeria on Sunday described Ghana’s general election as peaceful, transparent, free and fair, and should, therefore, be emulated by other African countries.

He said, “By this successful and peaceful election, Ghana has again added another beautiful block to the already political edifice it has built over the years.”

The former President, who led an African Union and Economic Community for West African States delegation to observe the polls, called on President John Dramani Mahama at his official residence in Accra.

He commended both the party in government and the opposition parties for their peaceful and successful participation in the election.

Also at the meeting was Vice President Paa Kwesi Amissah-Arthur, Alhaji Baba Kamara, Ghana’s High commissioner to Nigeria among others.

General Obasanjo said Ghana’s democracy had reached a level where there would not be any need to resort to any court cases regarding this year’s election.

He gave the assurance that the final results of the polls that would be presented by the Electoral Commission would be credible and acceptable to all in the contest.

President Mahama commended the Observer teams for participating in Ghana’s election as that would go a long way to give the exercise high level of credibility.

He said his government would continue to be law abiding as they await the declaration of the final results in the next few hours or days by the Electoral Commission.

Commonwealth Observer Group at Ghana elections Interim Statement

The Commonwealth Observer Group has been present in Ghana since 30 November 2012. During this period we have met with the Electoral Commission (EC), representatives of political parties, civil society, media, Commonwealth High Commissions as well as other international and national observers. Commonwealth teams were based in seven of the ten Regions. Our teams observed the voting, counting and results aggregation and also met with electoral officials, observers and other stakeholders at the Constituency level to build up a larger picture on the conduct of the process.
Key Findings

• This is the interim statement of the Commonwealth Observer Group, and it is issued with the process yet to be completed. The critical results process is on-going and we continue to follow this. We will issue a Final Report at a later stage, containing our final conclusions on the entire process.

• The 7 December 2012 elections were Ghana’s 6th elections since the restoration of democracy in 1992. The elections were contested by eight presidential candidates from seven political parties and over 1,300 parliamentary candidates, illustrating that freedom of association is provided for, and that the elections were competitive. The campaign was highly active and generally peaceful, though characterized by a vigorous competition between the two leading parties. The various calls for peace, including the Kumasi Declaration involving all Presidential candidates, were helpful and are to be commended. However, some incidents and localized tensions involving party supporters were reported.

• While it is true that freedom of association and participation are fully provided for in Ghana, the level of women’s participation as candidates, and thus as representatives, remains very low. None of the Presidential aspirants was female and just 10% of the parliamentary candidates were women. For a country with an increasingly strong democratic reputation this remains a concern.

• Stakeholders expressed their confidence in the role and capacity of the EC and generally it managed the process well. The undertaking of a constituency demarcation review and a biometric voter registration, both in an electoral year, was a major undertaking on behalf of the EC and represented a major effort. While there was some uncertainty and dispute regarding the creation of the new constituencies, this was ultimately upheld by the Supreme Court. The EC was put in a difficult position due to the late publication of the census data and the late creation of new Districts. The timing of the revision was far from ideal, which needs to be kept in mind for future elections.

• The voter register was criticized in 2008, including by the Commonwealth, and it is important to highlight that the new biometric voter register represents a significant improvement; providing for increased participation levels as well as increased safeguards for the integrity of the process. The main concern raised was in regard to reports of underage voters on the list in some areas. This is something to be addressed in the future and political parties and community leaders must help the EC in this regard.

• On the day of the elections our teams reported from seven of the ten Regions of Ghana. The process proceeded as planned in most areas and the election day was largely peaceful. There was a large turnout of voters, the process was transparent and the secrecy of the vote generally provided for. Problems were noted with the late delivery of materials in some areas and problems with the voter verification machines in some places, resulting in delays and uncertainty and frustration for affected voters. As a consequence the voting in some 431 affected polling places was extended to 8 December.

• Our teams followed the count at polling stations and the tabulation at the Constituency level. Transparency was maintained, with local observers and party agents present and agents able to get a copy of the result for later verification by the parties. The final results processes are on-going and we will reflect more on these in our Final Report, but we note the comprehensive coverage offered by TV, radio and online keeping people updated on the results as they are announced.

• We urge all parties and their supporters to remain constructively engaged, await the outcome and use official channels in case of any complain

Mahama Ayariga won the elections!!!

The rate at which NPP is seeking cancellation of some of the votes and the increasingly huge numbers they want cancelled will if granted only make Mahama Ayariga the winner of the elections! Haba!

Just a few days ago, they were praying the court to annul ca 1.4 million votes of John Mahama. Today, barely, a few weeks on, not only have they raised the number of votes to be cancelled to 4 million, they have even added that even some of their own votes must be annulled!!! If all these votes for John Mahama and NPP's Akufo Addo are all cancelled, who wins the elections then -- Mahama Ayariga or Dan Lartey's son? Haba!

Whither NPP? Is this the end of the road or the beginning of hell? What next turn of wonder and breathtaking do the NPP folks have in store for us? Will they be escalating the number of votes they want annulled to, say, 10 million? Chei, Chineke God, borrow me 5 naira, NPP naa waa!
