Even if “unnatural canal knowledge is a criminal offence" the gay like any other criminal still has rights. Do we say because a person is a homosexual, he should not be employed in any capacity? Because a person is a homo they be killed because they do not have the rights to life or to live? Martha must come again. She needs to review her understanding of the law and not to play to popular nonsense. I think she made a fault start and we shall watch critically how she bails herself out of this. People should not use their religious background or their own perceptions to determine what is right, The law is there and the law gives the rights to every human being. Marietta, your reasons for not supporting the death penalty is flawed.People steal and are jailed buT stealing still goes on.Does that mean that thieves should not be jailed.SO MANY MURDERRES HAVE BEEN JAILED ,RELEASED AND COMMITTED MURDERS AGAIN[SERIAL KILLERS]They could not have committed more murders if the death penalty had been imposed on them.Also there are so many families and friends of murdered people who have expressed satisfaction with death penalties.The death penaly is also an effective deterrent to potential murderers.In societies without the death penalty precious lives are being taken for frivolous reasons.Iam a strong supporter of the death penalty when guilt beyond doubt is established before a competently established court of law.Life imprisonment without parole to me means a sheer waste of state resources.

I think the honourable Minister-designate missed the point. There's a difference between Human Rights and criminal law. Human rights are not conferred on anyone, they are bonafide rights every human being automatically acquires at birth. The criminal law code frowns on the act of unnatural carnal knowledge but not the inaliable fundamental human rights of every individual. Please lets learn to differentiate between the rights and laws. Even convicted criminals have rights.

A lot of the arguments are based on the impact of the death sentence as a deterrent but has anyone bothered to examine the impact of removal of the death sentence in countries e.g. UK and the murder rates?

Yes, it is true that the healing process from families' point of view is more complex and will not result from executing the perpetrator of murder. Of course not, because that still does not bring back their loved one. However if we rely mostly on research from the US, that can be very misleading. Examine research from elsewhere in Europe, China, Singapore, other parts of Asia and the Arab Gulf for example if you are talking about deterrents.

Unless you do proper research examining all the issues and taking into account culture, access to weapons etc. you cannot draw such a simplistic conclusion. Whereas 'murder weapons' are easily obtainable in the United States (their constitution allows them e.g. to bear arms), in which case, even with a death sentence you still have high rates of such crimes, by virtue of the sheer number of people with access to such weapons alone; in other societies (including Ghana's) the law prohibits e.g. the bearing of arms. Therefore you will find that the type of weapon(s) used to commit murder in Ghana are not the same as those commonly used in the US. That in itself is a major deterrent although not full proof.

Surely if one person, by virtue of their advantage e.g. of carrying illegal arms, has another at their mercy and tortures or kills them because they are simply powerless to defend themselves, then surely, there must be the option for the state to give the ultimate punishment as part (not of retribution Madame Minister, but) of justice. I disagree with the minister-designate's characterisation of the state's act as "murder by the State". And yes, this will be a deterrent in my view. Otherwise wicked, lawless and murderous people will walk with impunity in the knowledge that whatever they do to others, the worst will be to be in prison where they are guaranteed free food, housing etc (however appalling the conditions there).

They also have the impudents to argue for yes, their "human rights". These are the bread and butter issues we should be discussing more of as a nation. These are my personal opinions on the matter.

I am disappointingly surprised. Why should this women be quoting the criminal law while she should be quoting the 1992 Constitution of Ghana, which guarantees the fundamental human rights to Ghanaian? Does the minister-designate also know that the 1992 Constitution is the supreme law of the land and for that matter, trumps any statutory law?
2. And what does she mean by this: "the practice of death sentence, ... has no use in Ghana’s statute books." Does she mean that the law exists in Ghana but it is no longer relevant? She needs to be clearer in her argument.

It is very clear that when we talking about homosexuality, we are all not on the same frequency. I don't think any Ghanaian will say that someone has the right to practice gay. Human rights does not mean the right to do anything. Nobody has the right to do evil or sin. Gayism is clearly a sinful act which cannot be tolerated by our law. The bible abhors all sins including homosexuality.
But what human rights activists are advocating is that those who unfortunately find themselves as gays should not be beaten, harassed, stigmatized, discriminated against or killed unlawfully.All human beings have human rights which can be taken away only by a court of competent jurisdiction.
According dignity to all persons without discrimination is what human rights is about.

We in Europe are watching how horribly uneducated and blockheaded African people are according to the fact that 10 % of the population worldwide would prefer a mate of the same sex. It is of course only up to themselves. Others have nothing to fear or worry. But socoieties on the whole are developping very well if people are given the right to marry and live with a person they themselves prefer. It is a horrible reading that people in paParlamentary status are not educated enough in these matters. It is for us Europeans like turning the time back 50 - 100 years to ages of uneducation and superstition. Have a look how developped countries like France and England are dealing with this matter allowing couples of same sex to marry. We wish that Africans wanting the same love life will get their human rights as soon as possible. Good Luck to for all African Gay workers in their fights and struggles. Don´t give up because you will win against uneducation and blockheaded fanatism at the end. We in Europe did. We are very happy for it. We wish you all Africans the same. Good Luck!

To those who are unaware Europe and America have become graveyards, corrupt, immoral without any future because men are sleeping with men and women are sleeping with women.
