" Ghanaians gear-up for Constitution week celebration "


Activities earmarked for the eight annual Constitution Week celebrations on the theme; "The sovereign will of the people and Election 2008," was on Thursday outdoor in Accra by Mr Laary Bimi, Chairman of the National Commission for Civic Education (NCCE). The activities include; a press briefing, finals of the National Constitution Game competition involving second cycle schools, public forum on tolerance for peaceful elections, radio talk shows, and forum with the security services. The one-week celebration (April 28th to May 4th) is a period when the entire Ghanaian community is to participate in discussions, debates, theatre performances and other activities on the Constitution to ensure that it becomes a living document embodied on the mind and heart for the attainment of democracy and good governance in Ghana. The week was borne out of an urgent demand for knowledge and information by Ghanaians to accelerate the growth and sustenance of democracy and constitutionalism in the country Briefing members of the National Organising Committee, Mr Bimi said as the nation prepares for this year's general elections "we deem it proper for this ritual to imbue the sovereign will of Ghanaians with the faith, tenets, traits and culture of constitutionalism for the deepening of democracy".

Mr Bimi reiterated the aim of the National Constitutional Week as the creation of an increased and sustained interest and participation of all Ghanaians in the new democratic dispensation for the achievement of good governance, social and political stability for national unity and development. April 28 has been adopted as the commencement date for the activities in commemoration of the national referendum for the endorsement of the 1992 Constitution fashioned by the Consultative Assembly.

If it does not fit, why waste your time with it?

Where are the much needed amendments in the constitution?

And who puts the "check and balances" to monitor the legislature, and the executive?

Is there a place for an elected senate or an Upper House in the 1992 constitution to perform these mentioned duties?

Where is the "Separation of Powers" in the 1992 constitution, in other words the independence of the Judiciary, the media,etc.

Why do the constitution allows the government to still have direct controls over the media through the ministry of information, and continue to have state owned media corporations like the Ghana televison ( GTV ), the daily Graphic, Times, etc?

Is the "Co-operation of Powers" the best choice of solution for Ghana in democracy, and what are meanings to these hidden agenda?

You mean the "unitary nature" of the constitution and it`s imposition of DCE`s, regional Ministers and appointment of members of Council of State on Ghanaians by the President, the clear absence of "Checks and balances", indemnity clauses to protect high profile State criminals, the serve yourself culture of a rubber Stamp Parliament, the central system of government etc. ?

Or to form IPAC to steal from public funds to finance their various political parties without the consent of the public who are the sole owners of the money?

“betterment and compensation,” which is long dead in Britain, still affects the
contemporary interpretation of Ghanaian compensation law.

The 1992 constitution still reflects the colonial Town Planning Ordinance and had failed to establish the right to
compensation.

Ghana is no more under British colonialism. It has independence and a "written down constitution" unlike its so-called colonial master. However, it still practices the British type of expropriations with the law.

In written down constitution, Ghanaians would have expect the drafters of the constitution to specifically put it in relevant parts as follows:

Any person whose property is injuriously affected by [a] scheme
[other] than the expropriation thereof may, within three months
from the date at which the scheme comes into force by notice in
writing served at the office of the Local Commission, claim
compensation in respect of such injury . . .

Obviously there is nothing of that effect in the constitution, and the government continues to bully its own citizens by taking the properties by force in the modern era.

Constitutional provisions in most countries require the payment of compensation to the owner. The English practice in the early 17th century was for Parliament to authorize the taking of property and either to prescribe the amount to be paid or to provide a judicial proceeding to determine it. The proceeding was held without the presence of the owner.

However, the American colonies developed judicial procedures enabling the owner to be heard on the question of compensation.

There have been few legislative attempts in some countries to control or define what is just compensation.

In general, the judicial definition is that just compensation is the fair market value at the time of the taking, the market value including not only the existing use value but also the best use to which the property may be put.

Many countries and or the democratic governments have “quick-taking” statutes providing that, upon the deposit of adequate security, the government may take title and possession before the price is judicially decided.

Nearly all other countries have constitutional or statutory provisions requiring that compensation be paid for property taken so why not in Ghana?

When are the political parties in Ghana going to pay back their proposed Campaigned financing funds "with the 1992 constitution, and who will monitor for its full payment back into the coffers of the people?




The French and German systems, unlike Anglo-American law, require that it be paid in advance of the taking by the government.

In the countries influenced by French and German law, the question of the public purpose to be served by the taking is an administrative one and is not determined in the regular courts.

Also, there are fewer general statutes providing for blanket authorization of condemnation for particular purposes (such as highways) than there are in the United States, and more often there is a requirement that expropriation of each particular parcel be authorized by the Parliament.

For instance ,in a landmark ruling in 2005, the U.S. Supreme Court adopted an expansive interpretation of the power of democracy as defined in the “takings” clause of the Fifth Amendment to the Constitution (“private property [shall not] be taken for public use without just compensation”).

Holding that the term “public use” should be understood to mean “public purpose,” the Court affirmed that government may take private property not only for use by the public but also for private use that results in a public benefit, in particular economic development.


Sorry, the rawlings supervised 1992 Constitution is just a mere cosmetic one to deceive the people for democracy, therefore ,there is an urgent need for serious amendments ,or a complete change, since its supervisor has himself admitted to the fact that ;

"he knows no law nor economics , but he knows it when his stomach is empty".

So why should a lame man like jerry john rawlings be allowed to draw a constitution for a whole nation and be accepted without a change?

It would be seen as a complete negligence for any sane person to allow himself to be driven in a car by a blind man without first considering the accidental possibilities.

And who puts the "check and balances" to monitor the legislature, and the executive?

Is there a place for an elected senate or an Upper House in the 1992 constitution to perform these mentioned duties?

Where is the "Separation of Powers" in the 1992 constitution, in other words the independence of the Judiciary, the media,etc.

Why do the constitution allows the government to still have direct controls over the media through the ministry of information, and continue to have state owned media corporations like the Ghana televison ( GTV ), the daily Graphic, Times, etc?

Is the "Co-operation of Powers" the best choice of solution for Ghana in democracy, and what are meanings to these hidden agenda?

Or to form IPAC to steal from public funds to finance their various political parties without the consent of the public who are the sole owners of the money?

The 1992 constitution still reflects the colonial Town Planning Ordinance and had failed to establish the right to
compensation.

Ghana is no more under British colonialism. It has independence and a "written down constitution" unlike its so-called colonial master. However, it still practices the British type of expropriations with the law.

In written down constitution, Ghanaians would have expect the drafters of the constitution to specifically put it in relevant parts as follows:

Any person whose property is injuriously affected by [a] scheme
[other] than the expropriation thereof may, within three months
from the date at which the scheme comes into force by notice in
writing served at the office of the Local Commission, claim
compensation in respect of such injury . . .

Obviously there is nothing of that effect in the constitution, and the government continues to bully its own citizens by taking the properties by force in the modern era.

However, the American colonies developed judicial procedures enabling the owner to be heard on the question of compensation.

There have been few legislative attempts in some countries to control or define what is just compensation.

In general, the judicial definition is that just compensation is the fair market value at the time of the taking, the market value including not only the existing use value but also the best use to which the property may be put.

Many countries and or the democratic governments have “quick-taking” statutes providing that, upon the deposit of adequate security, the government may take title and possession before the price is judicially decided.

Nearly all other countries have constitutional or statutory provisions requiring that compensation be paid for property taken so why not in Ghana?

The French and German systems, unlike Anglo-American law, require that it be paid in advance of the taking by the government.

In the countries influenced by French and German law, the question of the public purpose to be served by the taking is an administrative one and is not determined in the regular courts.

Also, there are fewer general statutes providing for blanket authorization of condemnation for particular purposes (such as highways) than there are in the United States, and more often there is a requirement that expropriation of each particular parcel be authorized by the Parliament.

For instance ,in a landmark ruling in 2005, the U.S. Supreme Court adopted an expansive interpretation of the power of democracy as defined in the “takings” clause of the Fifth Amendment to the Constitution (“private property [shall not] be taken for public use without just compensation”).

Holding that the term “public use” should be understood to mean “public purpose,” the Court affirmed that government may take private property not only for use by the public but also for private use that results in a public benefit, in particular economic development.


Sorry, the rawlings supervised 1992 Constitution is just a mere cosmetic one to deceive the people for democracy, therefore ,there is an urgent need for serious amendments ,or a complete change, since its supervisor has himself admitted to the fact that ;

"he knows no law nor economics , but he knows it when his stomach is empty".

So why should a lame man like jerry john rawlings be allowed to draw a constitution for a whole nation and be accepted without a change?

Now the question how much does he make a year to raise these kids/adults?

He is definitely going to send the kids outside for college/University just like all the other big shots in ghanaian politics.

How is he going to sponsor 9+ kids education in europe or North America whereby an international students spend at least 24000 us dollars for fees and living?

Madam Lordina is one of the friendliest and nicest people I have ever met.I visited their home in Madina sometime in 1995,with a friend, during the time John Mahama was still at Plan International.She'd never met me before and

Ghana Must look Within For Growth




Five presidential aspirants for the 2008 elections and 10 industrial associations have underscored the need for Ghana to look within to tap the natural and human resource potential for the sustainable growth of the country.

They argued that for the country to engender accelerated growth, it was important for the private sector to be assisted significantly to become globally competitive to offer employment and the needed resources for the development of the country.

The five presidential aspirants — Dr Paa Kwesi Nduom of the Convention People's Party (CPP), Dr Edward Mahama of the People's National Convention (PNC), Mr Emmanuel Ansah-Antwi of the Democratic Freedom Party (DFP), Mr Kwesi Amoafo-Yeboah, an independent candidate, and Nana Addo Dankwa Akufo-Addo of the New Patriotic Party (NPP), who was represented by Mr Jake Obetsebi-Lamptey — and the industrial players made the call at a meeting in Accra .

Organised by the Private Enterprises Foundation (PEF) and dubbed, "Meeting with Presidential Candidates of Political Parties", the meeting provided a platform for captains of industry to share their challenges with the aspirants and also get their responses on how they hoped to make local industries the backbone for the development of the country.

The associations were the Ghana Chamber of Mines, the Federation of Exporters, the Ghana National Chamber of Commerce and Industries, the Ghana Association of Women Entrepreneurs, the Ghana Union of Traders Association (GUTA), the Consumers Association of Ghana, the Ghana-German Economic Association, the Ghana Institute of Surveyors and the Ghana Institute of Architects.

Dr Nduom, who was the first to speak, said the problems of the private sector were not new because they had been documented years ago, adding that what was required were efforts to assist the private sector to come out of such problems.

That, he said, should take the form of tax incentives, technical support and ready markets that were geared towards providing Ghanaian industries added advantage over their counterparts who would import goods and services to Ghana.

He said the state must play an active role by especially supporting the Ghanaian private sector to lead the way in accelerated development, put money in people’s pockets and generate employment.

The DFP candidate said his administration would check over-liberalisation of trade in the country by reducing taxes on petroleum products, locally produced textiles, rice and poultry in order to revamp and increase the capacity of producers to produce more at cheaper prices, while making profit, so that they could offer revenue to government and employment to millions of the people .

“We will also take a second look at the Economic Partnership Agreement (EPA) between the European Union and Africa, including Ghana, in the interest of helping to protect our local industries,” he said.


Dr Mahama, who said he knew the problems of the private sector because he was in it, said his administration would create systems and institutions that would specifically work towards creating the needed conditions for the private sector to do better.

He said to reduce corruption that increased the cost of doing business and hindered the smooth running of trade , his administration would cut down the number of ministers to 40 and pass the Freedom of Information Bill as early as possible.

For his part, the independent candidate said his administration would always engage the private sector before arriving at any decision and solutions to the problems facing the nation and also offer the private sector the right assistance to give it a better edge over its counterparts elsewhere because “we cannot succeed as a nation unless the private sector succeeds”.

Mr Amoafo-Yeboah pledged his support to a planned phasing out of the National Youth Employment Programme and after that task industries to step up employment for the youth, saying that would yield over GH¢100 million, part of which would be channelled to support the private sector.

Speaking on behalf of the NPP candidate, Mr Obetsebi-Lamptey said as set out in the candidate’s four thematic areas for his government, the next NPP administration would transform the economy by pursuing a policy of Ghanaian economic empowerment that would encourage the accumulation and investment of Ghanaian capital, both locally and from the Diaspora.

He said the administration would also assist the private sector to focus on the production of value-added goods and services rather than primary products and make the formal sector more attractive to the majority of local economic operators, as well as invest a significant percentage of the nation’s gross domestic product in research and development.
