Elche chiefs try to mitigate Mubarak Wakaso's court case by paying €300,000

Former bosses of Elche José Sepulcre and Juan Carlos Ramírez have reached an out-of-court agreement with JP Sports manager to renounce their civil and criminal actions over unpaid fees following the transfer of Mubarak Wakaso.

JP Sports, the company which holds the economic right of Deportivo Alaves' Mubarak Wakaso, drove Elche and Villarreal to court over the player's sale.

JP Sports petitioned the court to let the clubs repay them an amount of €680,000 and additional €240,000 over his transfer from Ghana’s Ashantigold to Spain in 2011.

The agency said besides demanding that fee for a breach of contract, the heads of the clubs should face criminal charges.

JP Sport Manager Deportivo SL denounced at the time that the departure operation of Wakaso from Elche to Villarreal was not a breach of contract and explained it in this way: "We are facing a simulation of contracts with a clear objective illicit, since said contract was not an isolated act, but part of a collective action of the investigated, which have sought to obtain a profit at the expense of causing serious economic damage to this part."

He understood that Villarreal CF and the company Desgrachouski Sport SL made a fictitious contract whose sole purpose was to pay for the covert purchase of the federative rights that Elche CF possessed over Wakaso, to which must be added the simulation of dismissal by the Elche club thus preventing JP Sport Manager Deportivo SL from charging for the rights they had over the Ghanaian player, creating a direct economic loss of 680,000 euros.

Judge María Eugenia Gozalbo Serer considered in her car that the events that revolved around the departure of Wakaso Mubarak from the club of Martínez Valero in January 2011, under a disciplinary dismissal later signing a contract with Villarreal CF, could be constitutive of a crime punishable by deprivation of liberty.

However, the Office of the Prosecutor continues to maintain its accusation against some of those involved, so that convictions are not ruled out and the judicial process continues to progress.

JP Sports owns 42.5 percent of the rights of Wakaso who now plays for Deportivo Alaves.

He spent three years with Elche before joining Villarreal in 2011.
