State Prosecutors shielded evidence against Delta Force members - Amaliba

A private legal practitioner and member of the legal team of the National Democratic Congress (NDC), Abraham Amaliba has accused state prosecutors of shielding evidence that could lead to successful prosecution of Delta Force members.

“What has happened is a tacit admission that the presidency, New Patriotic Party (NPP) together with the Attorney General support Delta Force supports their criminal activities”

The State has dropped charges against the eight members of NPP’s vigilante group; Delta Force who were standing trial for their alleged role to aide thirteen of their members from prisons custody.

The case was called for hearing but police persecutor on Wednesday told the court upon advice from the Attorney General, the state prefers dropping the charges citing lack of evidence to continue to prosecution.

“The Attorney General should have contacted the judge attacked on their first appearance in court. They can talk to the court’s clerk, those who were in the court room to witness proceedings and the journalists around at the time for some evidence if they claim they don’t exist” Lawyer Amaliba suggested.

While acknowledging that the Attorney General can discontinue the case by filling Nolle Prosequi, he claims the Attorney General did a poor job to gather enough evidence.

He stated the decision taken by the Attorney General is a bad precedent which can entice other NPP members in near future to engage in criminality demanding that all 8 be re-arrested and arraigned before the court to face the full rigors of their action to serve as a deterrent to others.

Meanwhile, Governance expert, Prof. Emmanuel Asiamah has slammed government for discountinuing the trial.
