Ghanaians remember the regime which stripped people of their properties, destroyed families and killed in the name of corruption eradication. Today, they have been found out by EOCO and the Sole Commissioner to have deliberately connived to steal millions from the State. The Supreme Court has confirmed the stealing, labelling it as an alliance to create, loot and share.
Rather than deal decisively with such gargantuan and mind boggling impunity and corruption, the President chooses to join his communication foot-soldier chorus.

They should manage their power because we are all "small" in one way or the other, so we should not try to show people where power lies. The Saddam's and Gaddafi's should be our guide.

Yes, we all wish to see the end of this case but you would agree with me that it is not the justices of the SC who are delaying things. Indeed all parties to the case continue to play their part in dragging the case on, and (truth be told) we should be critical of both respondents (NDC) and the petitioners (NPP) in the slow progress made so far.
Evidence has to be presented, analysed and scrutinised and this takes time. Surely we don't want a 'Kenyan style' adjudication do we? You cannot say that was a satisfactory process or can you?

"Kenyan Style?" I thought that was the best but I might wrong. I thought this case was stupid and the judges should not have wasted our time on this. When the respondents started asking the validity of the pink sheets, I proposed earlier that, let them count all the pink sheets and ascertain the real number. Then let them tally the over-voting and see if that will affect the results of the results... because I believe that it would be sheer stupidity to think it just only simple "errors" when the number is over 200,000. It we could that "errors" it does not become errors anymore, then something should be done about it. However, if those "mistakes" or "errors" can't threaten the results of the election, we end that case.
But what do we see now-- my phase is now being done or adopted and yet it has taken us months to do that while it should have taken less than 2 wks to finalize my proposal. At the end of the day, Atuguba is going to them to tally the "mistakes" When that happens, please do come back and ask me to prophesy on you for a beautiful lady to marry.
And then again, Ghana will not burn,m in spite of stupidity emanating from our politicians.

I know technicality when I see one. So far, I am yet to hear or see one from the respondents or petitioners. At the end of the day, I have been proven right by the SC ordering the counting of those pink sheets, which the respondents spent almost a month on them just trying to find whether the number submitted were right or wrong. Only NDC and their apparatchiks believe they needed a month to bring Bawumia's credibility into question in this petition. Backward people!
And for heaven's sake, we have supreme court justices who are supposed to use their brains to think thoughtfully on issues. And here we are saying that because there are people insulting them, they could not come out to make appropriate and sound judgement. What kind of stupidity is this?
If they think they can't reason things thoughtfully and soundly or certain things might affect their work, they should give up or recuse themselves. After all, that is what happens to every worker everywhere. Is this hard you guys to understand?
And btw, how do we even know things are not affecting them privately? How do you go about that? When probably, his mistress is denying him sex, or his wife is having an affair? Don't you think it is even difficult in those instances than to hear an insult from a moron on a radio. Are you guys for real?
And your argument about the Kenyans, is not logically sound either. The petition is about the "leadership" of the country. Here it means there is controversy about that leadership. In your mind, you should let this drag on forever? Don't you know that is the reason it creates a sense of uneasiness for the President and his people?

My word of caution to you Arthur Kennedy is that you need to be very careful in these matters. We all need to recgonise the important and difficult task the supreme court is dealing with, and appreciate their decision to stamp out the level of misuse of "freedom of speech / expression" with specific regard to this case.
I seem to recall that some people (including you Arthur Kennedy)were of the impression that the supreme court was not being tough enough or that they "had lost control" of the situation. Why is it such a problem when they (after many warnings, and having allowed BOTH sides to "get away" with things) have decided to stamp their authority? Is it merely because the first to receive the crack of the whip happens to be a member of your party? Why can you not be fair, balanced, objective and consistent?? I rather worry that Arthur K, your inconsistency is part of your own undoing!!! This is what in my opinion is making some Ghanaians who would otherwise support you as a politician worry.
At the end of the day it is all about TRUST not partisanship. I am afraid you betray the latter however carefully disguised. That my friend, does you no favours, and frankly is counter-productive as far as your own political fortunes go.

Each and everyone of them is in the court house listening to the case proceedings and at the end of the day, deliberate and come up with a decision through voting. Some of them will vote for as others will vote against. Judge Atuguba's role is just to announce the decision the panel comes to to the public. He is not there as an authoritarian. Therefore don't be naive thinking that he will give the verdict to JDM 'at all cost' to quote the NPP.

It therefore came as a surprise when you decided to make an example of Sammy Awuku, a lay-person for his comments describing the court as “selective and hypocritical” on Peace fm.
Where does the element of surprise come in when the 'budding' lawyer(now in training) appeared before the SC willingly and pleaded mea culpa? And was the "final touchline warning" to all and sundry, not handed down by the court only a day before Awuku`s 'foolish' display of bravado? Let`s not kid ourselves into thinking that that those who have decided to bring this country to its knees, simply because their preferred candidate did not win the 2012 presidential elections, are engaging in this 'nonsense' out of sheer ignorance! Oh no; they are following a 'prepared script' with a cast spread across the globe. Is Awuku not part of the organizers that created that ludicurous alphabet organization called the Let My Vote Count Alliance(LMVCA) And what are their main backers, the Petitioners, in the on-going election debable, asking the SC to do?
You, Kennedy, have come in for your fair share of tongue-lashing for telling fellow party folks the truth about not only this election, but the preceeding one in which you played a pivotal role. And did you not become a target of viscious attacks from organized wings of your own party for urging tolerance and moderation in hanling the pending dispute with your colleague, Wereko Brobbey?
Aside from the hearings, has the time not come for somebody to assert and defend the authority of the State?
I thought you stand for the rule of law; and sincerely believes that can only come about when we have law and order1 So what are you dilly dallying about? Please leave the panel to handle the situation the way it deems fit! You aso have a very pleasant week.

This is precisely Arthur Kennedy's problem!! He seems to think that somehow he has to 'please' a certain constituency at all costs. I simply cannot understand that someone I once regarded as an astute politician can be so taken in, and some of his interpretation of things of the law are so naive as to be disturbing. He will do well to seek legal technical interpretation of some of these issues before he comes out with some of his opinions.
By the way, for those so called legal 'luminaries' like "Prof Asare" who have argued about "due process" and the "over-extension of the the powers of the supreme court" to summons without going through proper procedures and "without proper legal representation", I thought the first basis of forming a legal opinion was 'common sense'.
It is on record that the supreme court had issued several warnings and indicated that they would sanction or call people to book if they "crossed the line". Awuku chose to do so, and was rightly in my opinion invited to court to answer for his misdemeanours. Should it matter whether that summons was WRITTEN or VERBAL? Surely like Kuranchie, he could have chosen to ask for a WRITTEN invite (and sure enough he would have received one).
None of these 'pundits' and arm chair critics have even examined the case as to what made Awuku to rush to the supreme court when his name was announced, but I even suspect that the lead counsel Addison for the petitioners (or one of their legal team) may have called and encouraged him to come at once!!.
Now, when one is served a summons of court (whether verbal or written), you have a choice. You either ask for more time, and decide to appear in court at an appointed time with your lawyer (s) or you do whatever you deem fit in your case. That Awuku appeared in court on his own is not because he was not allowed to hire counsel, but he did so in his own right and knew exactly what he was doing. He wanted to show a contrite spirit and to seek a pardon and a quick resolution of the matter.
In my view that was the wisest choice he took. He should be applauded for that rather than "do-gooders" and arm-chair judges seeking to milk the situation under the guise of their knowledge of the law regarding "freedoms". One thing we must all be careful of is, knowledge of the law is one thing but knowingly or selectively interpreting it to win an argument may be "lawful" but not necessarily expedient.

However where I disagree is that rights to freedom of speech and expression are not absolute. In fact they are qualified. To allow intemperate languages which seem to undermine and incite in case the petition did not go some one's way, will be irresponsible of the judges if they allow it.
Part of their duty is to ensure the rule of law. That mean respect for the institutions of state. To keep mute when the court is undermined will be the height of dereliction of duty.Lets allow the judges to do their job without political interference.

Prof. Dudley and Mr Arthur have expressed their views clearly, defending the freedom of expression that is enshrined in our Constitution.
But they forgot one thing. That the parties have not finished presenting their cases and the judges have not expressed their views as to which party is right. They have not passed any judgement yet.
But these wayward party supporters who think they alone should govern the country are thinking for the court, directing where the judgement should go and even threatening an unconstitutional action if they do not have their way.
I expected your piece to include, at least, an advice to those who do not know or pretend not to know the role of the Judiciary in our constitution. And that when a case is pending before the court you do not go around speaking like children at playground.
I think such expressions would if not checked go to influence and undermine the sound judgement expected from the court. Please remember where Ghana is coming from: innocent judges were murdered by the previous PNDC/NDC President FOR NO REASON other than the fact that they were judges. Some of these speeches have similar undertones. I stand to be corrected if I am wrong.
