Your type is the kind that enables autocratic rule. At the heart of it, all that Prof Asare, aka Azar, said is the Supreme Court judges cannot be the prosecutors and judges in their own case. They cannot be adjudicators in a case that they are part of. That is called due process. Secondly, if they are going to punish those who criticize them, they might as well punish those who praise them. What makes criticism in and of itself more contemptuous than praise? Do they just want to hear only those words pleasant to their ears?
The fact that they are Supreme Court judges does not mean the legal process has to be set aside and allow them to run riot all over the place even to the extent of insulting and demeaning the people who they haul before them.
If the two of you cannot understand this simple logic then you are the nuts here, especially you Moyo. I have read a number of your postings and you come across as a nitwit. And to you Maxwell Nimo, what about this over flogging of the word "straw lawyer" you ascribe to Professor Asare? Look, your envy and jealousy stinks to the high heavens. Who is holding your scrambled brains in chains? Go get some if you can. For a so-called “straw lawyer” he has proven beyond doubt that he has his digits on the things he is talking about, check out at Ghana Law School, KNUST and Legon. He has become a household name and they are devouring his write-ups.
Prof. Asare has a proven academic record; he has demonstrated that we are captains of our own destinies. What about yourself? I doubt anybody will take your tosh seriously. Muff there!! Don't be an ass.
What at all do you yourself know about law? How do the examples you cited fall into the narrow definition of Contempt of Court? Zilch! Zero! In the USA where gun shootings and killings have become rampant, of course the authorities have to investigate any threats to public safety. Nobody is arguing for unfettered free speech here. I bet you if anybody will be hauled before any court in the USA for saying a certain judge is “selective, prejudicial and discriminatory”. Following your scrambled thought line, people should even be hauled before court for invoking Antoa Nyama in curses. But have you seen any of those sorts. The worst that can happen will be to send you to the chief’s palace to reverse your curse. Ghana’s Supreme Court judges must not behave like traditional chiefs, especially when they are an unelected hack. They must follow due process.

It is about time these judges stop wearing horse-hairs and Dracula robes; that would enable fresh air go through their natural hair. This overly deferential words like "My Lord, Your Lordship, and Your Worship" etc somehow have gone to inflate their super egos. They have to be reminded that they are not angels. They are fallible and we the people who pay their salaries have every right to criticize them. If they want to become "Thought Police" then they have got to build bigger prisons to hold us all. Thought lies in public opinion and they can't even attempt to control it. They would make an ass of themselves if they try.
The same goes for the president, the excessive accolades - "His Excellency the President" - that his bootlickers abuse our ears with are overused and over the top. If only he was doing something extraordinary and excellent, but you and I know what we are being served is mediocrity and not excellence.

The examples he cited are not free speech but probably more to do with threats leading to massacre and the law enforcements authorities were looking more at preemption of genocide.
I am surprised that the due process was the least of Mr Nimo's concern. He ought to understand that it could usher in "judicial dictatorship".
Is he using the definition of contempt alone to justify the SC's hurried actions? Once we accept there is contemp what process do we go through to avoid dispensation of raw and instant justice?

1. Prof Asare's issue is about the application of "the due process of the law", is it right for the SC judges to sanction only those who criticise them? What about those praise them?
2. The cases you cited in the US arrests were seriously out of context. Were these teenagers arrested under the orders of a dictatorial SC judges? Emphatic no. In the advanced societies there are control systems in place toe addresse these types of social deviants who overstep the freedom of speech mark into a different realm like the teenagers cases. Do we have the similar systems in place in Ghana prior to this SC judges sanctions?
3. My issue with the SC judges orders and freedom of speech in Ghana is, what happens to freedom of speech after the SC judges finish this case? Are we going to implement control systems to monitor those who overstep the freedom of speech mark or things will be as usual. How is Ghana going to deal with "President" Mahaha's tribal cam comment that "I am one of yours", Akuffo-Addo's "All die be die" rhetoric, Ken Adgapong's "Kill Ewes and Gas", etc?
4. The Supreme Court judges should have been proactive to avoid these confusion by way of making the public aware of the principle of contempt of court through publishing a code of conduct rather than ASSUMING that everyone present should know its powers and contempt of court.
There are too many administrative lapses around this case especially regarding the handling, counting, etc., of the so-called "Pink Sheets", the issues relating to the contempt of court, and so on.

Nimo, your article is very unfair to Prof Stephen Kwaku Asare for a number of reasons.
You have every right to disagree with the views of Prof Asare on the subject of contempt of court and its interpretation and application by Ghana's Supreme Court as some of us also do. However, to denigrate him is very unfair. Have you heard him refer to himself as Constitutional Expert and or Law Professor? Is it not the Ghanaian media who have made such assumptions and awarded him those titles?
For those of you who do not Prof Asare, he is a very humble person but also very principled. Throughout our secondary school days at Augustine's and St Peter's, he will often take the minority view on a matter and argue his case forcefully. He is not boastful and has never claimed to be all knowing or better than the nine Justices but that is the nature of law. There are always differences of opinion on one subject and I even believe some Justices on the Supreme Court may disagree with their colleagues hearing the petition.
I re-established contact with Prof Asare in 2002 after a very long break and we now keep in regular contact with each other through e-mails and telephone. He never mentioned to me that he was JD and member of the Florida Bar. He never mentioned that he lectures Law, even when we discussed legal and constitutional matters in Ghana. In fact, the last time we spoke just before he went to Ghana, he had discussed the petition hearing with a friend who was an Attorney and he told me the Attorney was surprised on how matters of evidence, case management, disclosure, etc were being handled. I only got to know that he was JD from the web. The first time I became aware that he referred to himself as was in one of his articles on this matter.
Let us be candid in our criticisms of others if we disagreed with them but not to portray them as boastful, all knowing, better than all, etc.
The examples you gave are what is known in legal matters as time and place or space. Because gun crime and massacres of school children are common in the US, any such threat is taken seriously whilst probably, it may not be taken as serious in Ghana. I did state this in one of my articles in response to Prof Asare's.
Nimo, let's have differences of opinion and be accommodating to what we disagreed with without necessarily turning the gun on ourselves just because we disagree. Can't we disagree to agree?

I hope the Prof would not be deterred by such unsavory attacks. Nimo's article started by stating his respect for Dr Asare with regards to the latter's stance on free speech,yet he(Nimo)launches personal insults on the poor prof,.What a contradiction!
Maxwell,on the other hand,contributed intelligently by reminding readers that Dr Asare never claimed to be a constitutional scholar.It was the media that tagged the label on him.And I personally feel regretful for harping on that in my commentary in the ongoing discourse.
Unfortunately,our media turn to be reckless in some cases in their reportage.And since,there are no consequences for their unprofessional narratives,decent fellow Ghanaians' reputations are smeared unnecessarily.
But that shouldn't hinder us from what we all feel is our small contribution in shaping our nascent democracy.
I believe the punishment meted out to the editor was hash but who says life is fair,huh?As long as one believes in what one says,a ten days jail sentence is a small price to pay.Oh.its easy for me to say,huh?
Anyway,when all is said and done, we'll have to learn to agree to disagree,as Maxwell questioned.

Nimo is quite right in pointing out the erroneous info being put out that he is a law Professor instead of an Accounting Professor. But that's not sufficient to argue that his arguments are not valid. Even an informed lay person can point out some errors in legal positions.
I don't know Azar personally even though he was a yr or 2 behind me in Legon. But, we got to "know" each other quite well on Okyeame, the premier cyberforum for Ghanaians. I therefore became aware of the time when he first got hold of Ghana's Constitution, and gradually drifted into taking a law degree.
Yes, he is a level-headed but a dyed-in-the-wool NPP supporter; no doubt about that. He has therefore been vigorous and sometimes disingenious in prosecuting the NPP agenda, while developing a principled stance of his own, even at odds with his NPP gurus and colleagues. I think he might be among the first NPP supporters on Okyeame I managed to convince that tribalism is not the catch-all phrase of politics in Ghana but just a ruse and a diversion from the realpolitikk.
Politics trumps law; at least in the long run. And what is law in one country is not in another, so Azar's position is idealistic, which we must strive toward. But now, can we also not agree that in an African environment in which election disputes often lead to civil conflicts, with thousands killed or maimed and properties destroyed, it is equally important for our judges to jail quickly those whose utterances can be a harbinger of such a conflict, just as the flippant cyber threats of those teens in the US can also send a wrong signal to those who are prone to shooting up innocent Americans?
Yes, when the animals were gradually taking over the ongoing circus in the SC, it is imperative that the Circus Masters crack the whip! And gosh! They did, thereby restoring some level of respect in the eyes of some of us who were not amused by the antics of the developing people of Ghana and their judicial system!

Of late, he has even stopped calling himself "Prof" in his articles. It is commentators who address him as such but it appears he may not want to be addressed as such on ghanaweb which is not an academic forum.
I have never seen him call himself a Professor of Law. So why all these attacks on his credentials? If he is a professor of accounting and not of law, and so what? Even people like Kofi Ata and Andy CY, who never read law make legal comments on the issues at stake. And Asare read law, even if just for interest, so he may know a thing or two about the law. Even so, these are just his opinions. Even if he were a Prof of Law, whatever his comments are here would just be his opinions which can be challenged by others - lawyers and non-lawyers alike.
If this writer sees any legal loopholes in Asare's arguments, he should point these out and show us where he (Asare) is wrong. This has nothing to do with Asare's academic or legal credentials. Cut that crap out. And if the man doesn't refer to himself as a Prof, stop calling him one!!!

Lastly, if you once styled yourself a Professor, or teacher or Guy Warren, or Koo Hia or was jailed as a thief, even once, and people know you by your earlier name or title or deed, then it is immaterial whether you've temporarily stopped using the title or name or stopped doing your past act. Any one may still call you by your name or title or refer to your past misdemeanour. Even when you swear an affidavit and change your name or title, your former names and deeds remain valid. School mates and colleagues still call each other by names and titles which are not known to others. They commit no offence in doing so. If Sani had not written, I would never have known that the man used to style himself as Prof. It is not for Maxwell Nimo to second guess that the fellow has stopped styling himself (temporarily or permanently) as Prof. Where is the evidence? And is Maxwell supposed to forget that the man used to call himself a Prof or was once arrogating to himself such titles? That is not the job of Maxwell Nimo. Well, a JD stands for "juris doctor"...depending on where the JD is obtained, the individual may or may not be a licensed attorney/lawyer. Anyway, he may not be a law prof, but it it is safe to say that he must know a thing or two about the law and is therefore entitled to a specialized opinion in the subject. So...he really should be entitled to expressing his opinions. Just because there are NDC or NPP lawyers of repute as well as experienced Supreme Court Judges does not mean that a legal specialist cannot express his opinion?
So I disagree with Maxwell Nimo when he writes this:
