Dr. Arthur Kennedy should realise that the adverse findings against Nana Akufo Addo has legal consequences. If Nana Addo does not appeal to overturn the judgement, he is estopped from filing nominations papers to contest the presidential election in 2016. Read Art, 62 and 94 of the 18992 Constitution carefully. The maxim in law: AUDI ALTERAM PARTEM (LITERALLY MEANING HEAR FROM THE OTHER SIDE FIRST) has exceptions to the general rule. The trial judge and in this case the Sole Commissioner had to decide whether or not to invite Nana Akufo Addo to appear personally to to give evidence or had sufficient information on record which did not warrant his invitation.
Also remember that people who appear before a Commission of Inquiry are witnesses of the Commission and have prosecuting immunity.
That is why the former Chief of Staff in Kufour's regime, Mr. Kwadwo Mpiani and Dr. Wereko Brobbey could not be prosecuted after appearing before the Commission of Inquiry in connection with the Ghana @ 50 Inquiry. Justice Marfu Sau who headed the Inquiry has taught us a lesson!
I therefore advise Nana Akufo Addo to appeal against the findings if he feels the Justice Apau findings were wrong in law. If he appeals up to the Supreme Court and loses then that's it. If he does not appeal Ghanaians will go to court to stop him from filing nomination papers in 2016; A catch 22 situation! We await the official release of the Report and it's accompanying White Paper.

Your analysis leads to absurd consequences:
To you, a person that appears before a commission has immunity from prosecution because he/she becomes a witness of the commission; but a person that is not invited has no immunity and can be prosecuted or have a judgment standing against him/her?
The essence of the Wereko Brobbey/Mpiani ruling is that a commission of inquiry's findings cannot be used to prosecute anybody in a court of law. It has nothing to do with any immunity afforded anybody that appears before a commission.
Now, if a person cannot be prosecuted on the basis of a commission’s adverse findings, then it also implies in law that a person cannot be deemed to have a judgment against him or her on the basis of a commission’s adverse findings. And if a commission’s “indictment” does not automatically lead to a prosecution or a trial, then it logically follows that whatever the commission calls an “adverse finding” cannot be weighed in the same category as a legal judgment. This is because a body of facts that is not fit for evidence cannot be fit for a judgment.
But I do agree with Dr. Kennedy's view that Nana should explain himself in the public domain. It is insufficient to say, "I was not called to explain myself". There is every opportunity for him to explain himself now.

I don't know the law but I don't think anybody will want to prevent Akufo-Addo from standing. I doubt if any court will grant that request. The EC cannot disqualify him on this ground and if he wasn't disqualifed in two previous attempts to become president, nothing can disqualify him.
Only the people of Ghana, voting in free and fair elections, can prevent him from becoming President. The sole Commissioner's ruling can influence the way a few Ghanaians cast their vote but I don't think it will be decisive even in a close vote. It seems many Ghanaians already have their fixed ideas of Akufo-Addo and they are not going to change that in a hurry - whether he explains himself now or not.

The cloud will continue to hang over Akufo-Addo even if he comes out to debunk the report and explain his part in the deal. He will find it difficult to convince those who already do not like him. Only his die-hard supporters will believe him. And they don't need any convincing.
Nothing he does on this issue will change his fortunes come next year. The man is not just the kind of person who can sway undecided voters - the group of Ghanaians he needs to convince most.
If he doesn't say anything, the cloud will hang over him. If he tries to defend himself, his opponents won't believe him cos they know Ghanaian politicians are all liars.
He is caught between the devil and the deep blue sea... But he can still win next year by a tiny margin.

You're right, Boy Kofi, that NDC as a party cannot disqualify Nana but an NDC lawyer can try to do so as an individual (like Kpegah tried and like a PP member initiated action in court to prevent Gbedemah from his seat in the 2nd Republic Parliament). If he is a strong party member, the party should prevent him from doing so.
NPP has lost focus, yes, but there is still a lot of time for them to turn things around before the elections. The only problem I see for them succeeding in doing so is Akufo-Addo himself. I don't think he is the right man to unite the party towards victory because he is one of the root causes of the disunity within the party. He did a great dis-service to the party by not allowing a fresh voice/face take over the candidature.
