Sammy Gyamfi files motion to set aside Afenyo-Markin's 'incurably defective and incompetent' suit
The Chief Executive Officer of the Ghana Gold Board (GoldBod), Sammy Gyamfi, has reportedly challenged the defamation suit filed against him by the Minority Leader and Member of Parliament for Effutu, Alexander Kwamena Afenyo-Markin.
According to a report by Accra-based TV3, Sammy Gyamfi, through his lawyers, has filed a motion for the court to set aside the Minority Leader’s defamation suit.
The report indicated that the GoldBod CEO, who doubles as the National Communications Officer of the ruling National Democratic Congress (NDC), stated in his motion that the court should strike out the suit because it is “incurably defective and incompetent”.
“Lawyers for GoldBod CEO Sammy Gyamfi have filed a motion to set aside the defamation suit filed by Minority Leader Alexander Afenyo-Markin, describing the writ as ‘incurably defective and incompetent’,” TV3 wrote in a Facebook post shared on September 3, 2026.
This report comes after Sammy Gyamfi formally authorised his lawyers to accept service of a writ filed against him by the Minority Leader over alleged defamatory statements.
According to a notice filed with the High Court, Gyamfi, through his solicitors, Ayine & Partners, has written to the Registrar of the High Court, General Division, Accra, authorising the law firm to receive the writ of summons and all accompanying court processes on his behalf.
The notice, dated August 26, 2026, is titled "Notice to Accept Service of Writ on Behalf of the 1st Defendant in Osahen Alexander Afenyo-Markin v. Samuel Adu Gyamfi and Anor."
It was signed by Seth Nyaaba, Solicitor for the first defendant, on behalf of Ayine & Partners.
The lawyers said they had received express instructions and authority from Gyamfi to accept service of the writ and other originating processes connected to the case.
Afenyo-Markin announced during parliamentary proceedings on August 24, 2026, that he had sued the Chief Executive Officer of GoldBod and three others, including the Chief Executive Officer of the National Entrepreneurship and Innovation Programme (NEIP), Eric Adjei.

The Minority Leader disclosed that he had filed two separate suits against the two men, whom he accused of making defamatory comments against him over allegations that he was an "extortionist."
"I have accordingly caused writs to be filed in Suit Number GT/1029/2026, titled Osahen Alexander Afenyo-Markin versus Samuel Adu Gyamfi and Multimedia Group Limited at the Accra High Court, and Suit Number GR/ACH/CC/C5/02/2026, titled Osahen Alexander Afenyo-Markin versus Eric Adjei and Peace FM at the Achimota Circuit Court," he announced.
