It is only Ghana that we government plead with people to obey our laws, even foreigners. We are not living in the jungle to just do things like animals who have no brains. Is the Government not tired of paying judgement debts? Is educating these folks involved not wiser option than yours? Is regulating both formal mining and galamsey not the a win-win situation for Ghana and the future? The war against galamsey (-including small scale mining) -can be won but very drastic laws and policies must be put in place. If properly managed small scale mining will bring in jobs and income to the government.
I recommend that a law should be passed which will tie the continuous appointment of any District Chief Executive to the issue of small scale mining in his area of operation. Should there be any illegal mining in his area he must be sacked and given a jail term with the cost of reclamation taken from his ex-gratia.
The same should be for the Police District commander of the area.
In addition any chief on whose land illegal mining is done must be prosecuted and given a jail term without an option of a fine.
In addition any company given a concession to do small scale mining should be made to satisfy these conditions:
1. The company must be made to put up a bond or pay money thrice the amount needed to reclaim the land after mining and if they fail to reclaim the land after mining that amount will be used by the state to reclaim the land. The remaining money shall be confiscated by the state because the company failed to do the reclamation on its own.
2. Anybody given a land for small scale mining must of necessity be made to sell his minerals to the State and any company which does not do so for at least six months and if it is proven that the company worked during those six months, the license must be revoked. The company must be made to reclaim the land though his license has been withdrawn.
3. Another requirement is that the company must be made to recruit a qualified Ghanaian mining Engineer and an Accountant, if he has at least 4 lots which is 100 acres.
With these measures in place I believe that the small scale mining can go on and Ghana will even gain from that operation.
