The guy is out out mischievous and congenital crook lawyer. And thank God for saving our country from the late starter Sam George. That boy is a thief in waiting. His motivation has always been to get into government and milk the system. There is no doubt in my mind John Mahama, beholden to mediocrity would have given him some ministerial appointment and presto, Sam George would have joined the likes of Fiifi Kwertey, Ablakwa, Kwakye Ofosu etc. God saved our country.
How else anybody can come and say that an individual can issue 44 cheques to ostensibly clear his goods and tell the government, not some tomatoes or kokonte seller, don't take my cheque to the bank until I tell you so. 44 cheques? Do we all get the same privilege? Damn fools. The guy is a crook and they should take his properties to defray the amount owed.
Amaliba and Sam George know the truth and the right thing to do, but for reasons of political expediency, would always sidestep the truth, and spin outlandish excuses and nonsense.
Is issuing not one, but 44 dud or bounced cheques, a business arrangement? What kind of business arrangement is that? Let us not forget, this same Ibrahim Mahama withheld monies he owed the Merchant Bank until the bank collapsed and somehow some faceless individuals with links to the NDC, perhaps including himself, constituted themselves into Fortiz Group and bought the bank at fire sale price even as some South African company, I think First Rand or Stanbic, as well as UT Bank etc. had offered higher bid prices. In the case of First Rand, they offered $92 million US dollars whereas the NDC cronies called Fortiz Group were sold the Merchant Bank for GHS 91 Million frigging cedis by the NDC government headed by John Mahama, the brother of Ibrahim Mahama. The winning bid price as compared to First Rand's offer was not even close as the exchange rate of the cedi to the dollar was 3:1. So Ibrahim Mahama sat on the money he owed Merchant Bank, forcing the bank into liquidity problems and turned around to buy the same bank a là the Fortiz Group for cheap. In real cedis terms, the NDC rejected a bid price of GHS 273 million cedis and rather took in GHS 91 million cedis. If this is not daylight robbery nothing else would qualify as such. Kofi Adams, deputy general secretary of the NDC was all over the place defending the sale to the shadowy Fortiz Group.
It is very clear Ibrahim Mahama did what he did, knowing very well nobody would touch him because of who his brother was. All the custom officers and GRA people dared not touch him for fear of losing their daily bread, and they took their cues and hints from President John Mahama's own vehement defence of his brother.
Big mouth Sam George and Amaliba know all that, but just like the custom officers and GRA people, they lack the spine to speak truth to power for fear of causing the displeasure of their masters in the NDC, more so when Ibrahim Mahama has oiled their political campaigns including him Sam George. The annoying thing about him is, he always wants to have the last word on every issue, as well badger and interrupt his colleague panelists. Shut up and listen Sam George, just maybe you would learn some sense and wisdom. Kronfuo!

This so called lawyer, Amaliba, has demonstrated he is full crap. he wouldve have been better off not sounding this excuse that IRS was asked to wait for orders to clear the checks. It is fraud to write a check let alone checks that bounces! Punishment for that is time in penitentiary.
An option outside this is, which is legal, is agree to the audit findings and agree to terms on how to pay the arrears. This arrangement will accure interest all the way till the entire amount is paid. The bottom line here is, the IRS dictates the rules and not the party in arrears.
The other issue is, how the hell did "screamer"; he is always screaming, even on TV talk shows, Kennedy Ajaypong, know about Ibrahims personal dealings with the banks. Is he on the board of IRS and even if he is, what gives that he has to make it public?
Bearing otherwise, Mahama can make it a legal case against "screamer". Adjapong will loss as long as the institutions are put to work fairly.
The country is surely non functional and in going down a bottomless pit and one of the major contributors is jealousy. No on wants the other to progress or have more than them. It is like the two friends who where very poor except one had a goat that provided his family milk everyday and the other didn't. One day, an Angel appeared before the one without a goat and told him it was God's orders to provide him whatever he wanted. His request to the angel was to kill the friends goat.

You are right. Amaliba is spewing garbage. Any person who has a modicum of the knowledge of law, should be excused for doubting the legal credentials of this Amaliba character. A person issues 44 post-dated cheques from 2015, and then we have some quack lawyer arguing that the person did nothing wrong, because he advised the holder of the post-dated cheques, not to deposit the cheques on due dates, until he could deposit funds he was expecting from someone, into the relevant account/s! One cheque may be excusable, but 44 cheques from 2015? If Amaliba's argument were to be accepted, it would mean that a debtor could avoid paying his debts, by issuing post-dated cheques to a creditor and advising him continuously, not to deposit the cheques on due dates, until he is able to deposit money into the relevant account/s. Such an arrangement could continue in perpetuity, because the debtor could make sure that any money he would be expecting would not be paid into the account/s upon which the post-dated cheques were drawn, but into a different account, in order to avoid paying the holder of the post-dated cheques. It's highly probable that this was the intention of Mahama. Amaliba's argument is untenable and indefensible.

The GRA needs to be taken to task for accepting post dated cheques from Ibrahim Mahama.Would they accord the same privileges to any Tom,Dick and Harry in Ghana?
Whoever sanctioned the receipt of the post dated cheques ought to be prosecuted for dereliction of duties.

Amaliba should know, if he does not know, and I hope he knows but trying to pretend, that personal checks are not accepted at the ports. No one is allowed to clear any good from the port via that person's personal check. They only accept bank checks or bank drafts. So for Ibarahim to have issued personal check to clear his goods from the port, is in the first place, is illegal. The fact that they allowed him even to issue those checks, let alone bouncing later shows that he Ibrahim was given the preferential treatment because he is the brother of the former President. No one is given that privilege. If someone who has struggled overseas to buy his personal car and ship to Ghana is not able to clear it from the port just because the person was not able to come up with the duties on it via bank draft is seized and sold for peanuts, I do not see why Ibrahim should have been treated differently. Supposed the NDC was still in government, Amaliba, do you think this issue would have come up? No matter what Ibrahim does, he will pay up and if he does not will see his goods being sold and NDC cannot do "foko". We line in a country of laws and the laws should be preserved irrespective of the personality involved.

What doesn't go down well at all is the fact that there are thousands of contractors waiting for their money from government. Are they also able to ask the government to wait for their taxes or you can only do that if your brother is the president.

If that kind of arrangement were possible, or the customs would allow payment by installments, hardly anyone's imported item could be seized for non-payment and auctioned off.
Even if the check was drawn upon by the GRA and bounced, why didn't Ibrahim make payment shortly later?

And instead of NDC telling them point blank they are thieves just as Ghanaians told them at the polls in December, they are pampering and defending the thieves of Ghana.
The thief cannot warn any state agency not to withdraw cheques due the state for transactions entered into with the state.
Indeed, by writing those cheques it is deemed to honour his obligation to the state in the said transaction with the promise of funds being available to satisfy the transaction so entered into. Writing those cheques knowing there were no funds to satisfy and honor the transaction entered into with the other parry in this case GRA, constitutes a crime. Return of the cheque by the bank for the unavailability of funds incurs charge and interest,and upon further refusal or inability to honor that obligation, it becomes subject to criminal prosecution for defrauding and engaging in criminal conduct. This does not waive the obligation due the other party in this case GRA. The obligation in this case the import duty accrues interest to the State as well as charges that the bank may impose on the thief.
So let not idiot Amaliba talk about the thief warning anybody about not cashing the cheques. Such stupidity is totally unwarranted. It should have no place in this matter. Warning, nonsense. Who are you warning???

But when a chk is drawn for immediate encashment you cannot ask for reference. To clear goods at the port is by immediate payment. These people are trying high and low to defend the indefensible. A crime has already been committed and these guys should prepare proper defense and not what they are saying so far. This guy was of the view that he was above the law and there did not think that he should pay import duty. The issuance of the dud Checks was a camouflage. He should be dealt with according to law.

You cannot clear goods with did cheques and after the expiry date tell the bank not to pay or the creditor not to withdraw. The GRA must be sanctioned for keeping the cheques until they became stale. Whether Ibrahim pays or not, he must be penalised in accordance with the law. Nobody should talk about witch hunting.

Ibrahim Mahama issued post-dated cheques to GRA intending clearance upon receipt of monies owed him by gov't. He apparently advised GRA not to cash the cheques immediately.
It is really heavy-handed for this case to end up with EOCO. gRA should simply have arranged with Ibrahim Mahama to honour the cheques he had issued. This is normal business practice.
