If he has any legal advice to KT Hammond, why won't he meet Tsikata at the court rather displaying his knowledge on legal matters in the public gallery. Tsatsu has given KT Hammond the opportunity to have his day at court the professor has the chance to represent the respondent.

How would we ordinary citizens be able to establish the truth about the gratuity. These days, it appears there is a certain pernicious influence pervading the society whereby people would readily defend others at the expense of the nation. The GNPC monies belong to every citizen and is it not disturbing that just four people who claim to be serving the nation would be given close to 3m ghana cedis, an amount that can take about 500 people out of stark poverty. The unorthodox means of trying to stifle public criticism in the name of legal suit ought to be condemned. GOD help Ghana!

Azar, whilst you make some valid argument on some issues, I am afraid your suggestion of expanding the frontiers of parliamentary privilege beyond Parliament is neither here nor there. The fact is that it is only a privilege which is used by members on rare occasions and not the norm. Indeed, even within parliament the misuse of this privilege could result in sanctions against offending members of the house, such as withdrawal of what was said and an apology. Here in the UK MPs and the Lords will dare not repeat a defamatory statement made in the houses using this privilege outside the Houses of Parliament. For example, just before the May 2015 General Election, the then Labour Leader, Ed Miliband used the word "doggy" to describe a Conservative Peer in the Lords and accused him of tax avoidance. The Lord or Peer challenged him to repeat the word doggy outside parliament and if he did so, would be sued for defamation. Ed Miliband repeated the tax avoidance allegation against the Peer outside parliament but refused to use the word doggy. This was because he was aware that his parliamentary privilege did not extend beyond parliament.
If your argument of the privilege assisting an MP to carry out parliament duties be extended outside parliament holds water, why would the leader of Her Majesty's opposition be sacred of repeating the word doggy outside parliament when he was performing his duties as leader of the opposition outside parliament?
Azar, this frontier extension if allowed will lead to abuse of the parliamentary privilege, particularly in an indisciplined society such as Ghana. It is dangerous to make such legal argument that would not be made in even the developed democracies such as the US and the UK because of the risk of abuse. We should not give MPs a licence to abuse others whenever they feel so or may disagree with others. Such open ended parliamentary privilege will no longer be a privilege but a weapon of parliamentary anarchy.

Parliamentary privilege gives people speaking in Parliament legal immunity against being sued for libel however statement made outside parliament is not privileged or even qualified privilege and you stand to answer for any indiscretion or careless statement made in breach of the law.
MPs like the rest of the public are not exempt from the law since it is a long established principle that no one is above the law – including MPs and that Parliamentary privilege was never intended to help politicians escape the law. The line and the scope is clear.
There are many shades of defamation not least malicious falsehood which is much more likely to succeed in this case. In this instance, the only thing to prove is that the statement in question is not true.Tsikata has not received any money as alleged by Hammond
Secondly The element of malice is an important one here, as evidenced in the name of the offence. Malice has been defined as a statement made by a person who knows it to be false or who is reckless as to its truth.
Additionally it could be a false statement made by a person who is moved to this action by some improper motive.
It seems to me that Asare is playing politics at the expense of his reputation with these infantile arguments.

As you've pointed out, in the UK, Parliamentary Privilege provides legal immunity for MPs, peers and select committees against being sued for libel, contempt and other offences. This enhances their ability to speak freely in parliament.
Mr K.T. Hammond made statements that were wholly not true. This brings Mr Tsatsu Tsikata's personal integrity, dignity and reputation into disrepute, and expose him(Tsatsu) to accusations of dishonesty. Clearly, Mr Hammond knows his statements have generated a storm of publicity and if he was not acting out of malice, when it now clear he made wrongful accusations, he wouldn't continue to taunt Mr Tsikata in the media and stand by his statements in his public utterances. "Actual Malice" could be established in this defamation claim. Therefore, Mr Tsatsu Tsikata has reasonable grounds to sue for defamation against Mr K.T.Hammond.
