The Special Prosecutor Martin Amidu today Monday June, 17, 2019 in court floored the Member of Parliament (MP) for Bawku Central constituency Mahama Ayariga following his application filed at an Accra High Court challenging the age of the former.
The financial court division of the Accra High Court presided over by Justice Efia Serwa Botwe dismissed Mr Ayariga’s application in which he challenged the capacity of Mr Amidu to prosecute him on tax evasion charges.
She ruled that any pronouncement on his qualification to hold office as Special Prosecutor would amount to injuncting a public officer and that he is the de facto Special Prosecutor.
According to the judge, since there is a matter already in the Supreme Court, she will decline the invitation, and hence he is competent to sign the charge sheet.
Mr Amidu wrote a letter to Parliament to release Mr Amidu to the court after he charged him for evading taxes and trading in foreign currency without a valid license.
But Mr Ayariga argued that the Special Prosecutor does not have the capacity to prosecute on the charges levelled against him hence filed the application.
He said Mr Amidu cannot prosecute him because he is above statutory retirement age of 60.
