Court adjourns Bernard Mornah’s case against EC

An Accra High Court has adjourned a case filed by Bernard Mornah, the Flagbearer of the People’s National Convention, challenging his disqualification from the 2024 presidential election by the Electoral Commission.

During a court appearance on Monday, October 7, 2024, the case was adjourned to October 16, 2024.

Led by a high delegation of party executives, Bernard Mornah addressed the media after the proceedings, accusing the Jean Mensa-led Electoral Commission of miscarrying justice against the PNC.

“One thing is certain; the EC is running away because they know that they did injustice to us, otherwise why would the EC that has to conduct elections on December 7, they know that they have processes to embark upon and that part of our affidavits indicate that they should not proceed with any other processes including printing of ballot until I am included as a presidential candidate so, if the EC is delaying, they are trying to de-organise our elections,” he said.

According to him, the electoral body is attempting to disrupt the elections by deliberately delaying the electoral processes through the courts and strategically laying the blame on the PNC.

“What the EC is doing carefully through the court is that they will not print the ballot, they will not do anything and come and blame me that it is because of our court processes they were not allowed to do so, therefore, the December 7 elections may be in limbo. As it stands now, the court has agreed and I was excited listening to the judge.

“He says that upon the filing of the statement of case by the EC, he can easily just go through and make a judgment without necessarily having to listen to both councils and so I am more than convinced that on the 16th of October, instead of coming here for the hearing, we may come to a judge conclusion that the EC should include us on the ballot and we are good to go for elections 2024,” he added.

Bernard Mornah is seeking to demand an order of mandamus compelling the 2nd respondent [EC] to declare the 1st applicant as duly nominated to contest the 2024 public presidential elections.

He is equally seeking an order restraining the 1st and 2nd respondents from printing the presidential ballot papers or carrying on with the December 7, 2024 Public Presidential Elections until 1st Applicant is declared duly nominated candidate of the 2nd applicant and allowed to contest the said elections.
