Office of the President

The Republic of Ghana

Accra

30th April, 2012

Dear Sir,

*ATTENTION TO SOME CONSTITUTIONAL BREACH IN THE COMPOSITION OF THE BOARD OF DIRECTORS OF GHANA COMMERCIAL BANK. *

I write to bring the attention of His Excellency, President John Evans Atta Mills to the conflicting of interest and a serious constitutional breach that exist with the heads of the National Commission for Civic Education, NCCE and the Commission on Human Rights and Administrative Justice, CHRAJ serving on the Board of Directors, BoD of the Ghana Commercial Bank.

Mr. President, in the wake of the very recent debacle between the Management/BoD one side and the Employees of the Ghana Commercial Bank on the other hand which could end up at CHRAJ some of doubted if there could be a just and fair hearing considering the fact that the CHRAJ commissioner was also an interested party in the conflict and was expected to determine the case.

Further to this, Mr. President, Article 222 of the Constitutions expressly states: “The Commissioner and Deputy Commissioner *shall not hold any other public office*.” (Emphasis mine)

Mr. President accepted international standards and best practices prohibits such instances where fully occupied Public Officials like the NCCE and CHRAJ bosses would have additional loads which makes them either ineffective or bias or both. Whichever case, as a country I strongly believe we should be above that.

I hope His Excellency would take immediate steps with the sense of urgency our common hero and Founder of Ghana, Osagyefo Dr Kwame Nkrumah operated with to correct this anomaly and smoothen the path to a prosperous future Ghana our fatherland.

Sincerely yours
