Kofi Ata, the 250 was not used by Addison to prove over voting. He showed over voting by adding the number of correct votes cast, 12, to the number of rejected votes, 1 to get 13. And 13 is more than the number of ballots issued out to voters at that polling station. The figure, 250 ,refers to the number of ballots issued by the EC to that particular polling station and this comes in bundles of 100, 50, and 25 according to Afari Gyan. ADDISSON was trying to suggest that it would have be sounder to for the ballot papers to come in bundles of 5, 10, 15, 20, etc to avoid over issuing ballots to various stations. when the judge rightly pointed out that it was 25 instead as he can see that the zero has been cancelled out, Addison explained that the ballots issued were still over 100 percent. The law requires it to be over bynot more than 10%.

Dr Afari Gyan sought to explain that they could still not vote twice and counsel proved that, since they might have voted by proxy, they could. This Dr Afari Gyan grudgingly accepted. Counsel also drew the inference that since a sample of 705 contained 7% double registration, it follows that the national register could contain double registration. Kofi, you should know that the Petitioners are also alleging a bloated register and the questions were towards that end.
With regards to the 25, which became 250, I thought Counsel redeemed himself. He did not start by pressing over-voting with that pink sheet. He gave it to Dr Afari Gyan following the question on whether the booklets could not have been in smaller packs. Thus he explained that what he intended to show was that there was no need to send 25 ballots to a station with only 12 voters (over 100%). He then proceeded to show the over-vote with 13 ballots being in the box, fitting Dr. Afari Gyan's 'classical' definition.
With regards to the issue on the discriminatory registration abroad, counsel wanted to draw attention to the unfairness that attended the election. Why limit overseas registration to largely government employees and students on government scholarships? Without any stretch of imagination, one can realise that these voters would be tilted to voting for the government of the day. If any orders that come out of this petition succeed in curtailing that in future, it would be improving fairness.

From the look of things it seems Ata has been keenly following events at the supreme court but some of his deductions and inferences are conspicuously poor. His failure to see that double registration found in the foreign register could have serious impact on the election results is one of the numerous instances where he was found wanton as far as far as judgmental issues of the Court proceedings are concerned. His stance on the constitutionally of the NVNV Is concern is also problematic since according to him the application of the NVNV was unconstitutional, forgetting that without the biometric verification people with multiple registration could nefariously cast more than one vote.

It is possible I might have got the figures with the 250 on the pink sheet wrong but I remember that the issue at stake was over-voting and I believe it was Justice Baffoe Bonney who corrected that the figure was 25 and not 250 as had been presented by counsel and admitted by the witness. I accept that I am unable to listen to all the day's proceedings and do not take notes. Therefore, writing from my memory, it is possible I will make some mistakes but this is a summary of my recollection of what happened.
Regarding the discrimination registration, Prof Stephen Kwaku Asare took the matter to the Supreme Court ( the prohibition of Ghanaians with dual citizenship from holding certain public office) but unfortunately the SC rejected that it was discriminatory. So Ghanaian law allows discrimination against those of us in the Diaspora. In fact, I heard the Presiding Justice make reference to it in court, when he mentioned Asare v the AG.

While I admit that Afari Gyan should exercise caution in responding straightforward to questions over whose definition and concept he is uncertain of, I think overall, he has done well in explaining issues well and must try and put his answers in a proper context of his earlier stated convictions so as not to fall into the trap of inconsistency. If you take his testimony up till date as a whole, you would find that even where there has been flaws, there is a retrospective correction effected by his earlier testimonies. He averred that his two definitions of over-voting relates to the classical which calls for the register and the other is with the assistant of technology i.e BVM.
His admission to another form of overvoting relating to ballot issued is WIERD and unsustainable. Before the start of voting, how do you issue and record 66 ballot papers to a polling station of 71 registered voters when you have no idea of the number of people likely to show up to vote on that day? If you have a register of 71 voters then you should be at least anticipating 71 people by close of day hence the need to issue and record 71 ballot papers as such if such recording is required before start of voting. But recording ballot issued before the start of voting doesn't even make sense. Ballot ISSUED connotes a PAST ACTION and can only be arrived at and recorded after close of polls. If sorting could't identify any alien ballot paper and counting went on to produce 67 clean ballot papers then a mistake should be traced to a wrong recording of the ballot issued by the presiding officer. So using pink sheet record of ballot issue as a base to to define overvoting is unsustainable and doesn't count.

And even that,they were curable and reexamination will take care of that.Lynes Quashie Idun had been a bit shoddy though in his preparation.Some questions which were already answered were recycled and Idun should have objected to protect his client.

As usual your analysis has been objective but I have some further comments to add to it.
On the definition of over-voting, I also found it strange that Afai-Gyan started his answer with that opening confused and unexpected statement. In fact his analysis afterwards did not prove his opening statement. He rather ended supporting the "classical" and condemining the "Keynesian". It was thus suprising he started in that manner.
I seem to agree with him that the so-called second definition might be equally correct but then given the electoral set-up in Ghana with BMV and other features, it is possible to analyse the pink sheet or check the BMV print-out or check the serial numbering of the ballots cast or check the back-side of the ballots to find out the wrong ballot paper or correct the error on the pinksheet.
In that sense, it could be said that the second definition could always be sorted out at the polling station if it is brought up as an issue by a polling agent.
But at the end of the day, why should we cancel 200 or more votes just because there are one or two seeming over votes, particularly when it could have been checked and corrected at the polling station before the results are sent to the collation centre or even at the collation centre
Secondly, I agree with you that the EC and their Lawyers might have done a poor job in countering the evidence of the Petitioners. But I do not blame them so much because they had a much shorter time to do so. Particularly, 5 days to present sworn affidavit statements was rather two short a time. It appears we may be sacrificing justice for speedy trial.

Over Voting: When, Afari Gyan says "I am not clear in my mind what over voting is", he is not saying he does not know what 'over-voting' is, he is only saying he does not have his own definition or there is no static definition of over voting. He then proceeded to define the 'classical' definition. The term 'classical' only refers ‘the established definition’ of over voting in Ghana since the 4th Republican Constitution. It is not strictly in academic sense in regards to ‘Classical economics’ or Keynes’. Again, he never dismiss the definition espoused by the petitioners he only pointed out the weakness of that definition in comparison to the established one and subsequently said he preferred the classical one because of the identified weakness.
2. Worried and Confused: From my observation, this resulted because of the line of questioning of the petitioners’ counsel hence; I would not like to blame A. Gyan entirely. I personally do not know what he (the counsel) aims to achieve. Why was he asking technical questions relating to law, IT and even the detail of the registration itself. Afari Gyan is not a registration officer. I was expecting him to stick to the substantive issues they raised in their pleadings.
It’s true that Afari Gyan is the Chairman of the Electoral Commission but he does not constitute the Commission. As result, our assumption of expecting him as a Chief Executive to be familiar with all detail aspect of everything in that regards is unrealistic. The court case might compel him to refresh his mind on all aspect but we must bear in mind that his age (68) not allow him to recall as sharp and accurate as expected. The superficial confusion has resulted because Afari Gyan unlike Asiedu Nketia do not want to be seen rude till the time he could not take anymore when he burst out to say “ I am not a registration officer”. Remember sometimes he uses expressions like ‘if you say so’ meaning he has no business in knowing those detail. He did not want to engage the counsel or being evasive like Bawumia and Asiedu Nketia.
3. The Tendering of BM Print Out: Contrary to your view, I think not accepting that vital document in evidence in the name of speedy expedition of the case is a miscarriage of justice. Why? It’s court case, it does not matter even if it will take a thousand years to get the truth. The fact that the EC made a gross error for not adding it to their affidavit does not mean justice, should be denied Remember, the case is still on-going. There are even instances where cases are closed but with a new evidence, they are re-opened. Remember, during the Bawumia’s cross examination, The EC had wanted to tender, a particular document, it was asked to do it through its witness, so why the denial. Is it because the petitioners are special than the respondents

It is true the EC could be more efficient--but which Ghanaian institution is that efficient anyway. Try getting a simple driver's ID--and the system is so corrupt.
Rawlings tried to "clean" the system of corruption and he failed woefully. Kuffour came and made it worse. Mills did nothing.
So why would anyone expect a Ghanaian institution to function that efficiently? IT will not happen.
The petitioners have not proved anything--except irregularities and mistakes.
Afari Gyan has done his best--let the old guy retire in peace.
