I wrote a rejoinder to challenge his arguments and conclusions (see "Re: SC Verdict Exposed Exposed Polarised Bench", Ghanaweb September 15, 2013). Why has it been recycled?

Prof, I have no further comment to make but kindly go and read my rejoinder and the comments from readers. Please accept my apology for the harsh language but your baseless and partisan arguments had to be challenged. How come they did not pursue their original claim of electoral fraud involving the stealing of Akuffo Addo's vote and the padding of Mahama's vote?

And even worse, they displayed grotesque bad faith and dishonourable character in hiding 2,002 other pink sheets. When they win elections then the EC Chairman is good and the elections fair. When they lose then the verdict has been stolen. They are such an obnoxious lot and this loud mouth of a professor who has promised much and delivered little thinks this subject has mileage. Can you point to a single person the EC exercised this prerogative in ghana and any political party disputed against that prerogative before the count of the vote? you either trust the EC's independence or you don't in that case your so called reforms should have been done by Kufour or Mills. but neither presidents found it troubling and at best ghana' EC was among the best in Africa.

I am afraid the write up is factually inadequate and skewed to score political points rather than an informed analysis of the electoral process and what happened in the elections.The writer thought the judges missed a golden opportunity to address all his fancies.Forgetting that these judges sat throughout the proceedings and had first hand knowledge of the details of the petition and the contesting claims to form an informed opinion and to help with their judgement.

I don't see on what basis the writer thinks he is more knowledgeable than the judges on the facts and that his prescription is therefore better than the judges and therefore the effrontery to make some political rather than legal conclusions.One wonders what basis this man thinks rerunning of the whole elections will be a better option than the judge's decision.And his prescription for electoral reforms make no sense as well.

Electoral reforms imply a complete change and not improvement of the electoral process.For example proportional representation as an electoral reform will imply For example, under a PR voting system, if 30% of voters support a particular party then roughly 30% of seats will be won by that party.This must take a change of the constitution to make it possible.When we talk of electoral reforms this is what is meant and it will need a complete revamp of the electoral system to achieve it.

The history of elections in Ghana and more so one skewed for political expedience is unhelpful.Dr Ayitey your contribution to the debate is not balance ,it is not objective and has been in totality unhelpful to the present discourse and climate.

The damage some of the judges have done to Ghana's democracy is to endorse illegality, in effect the law is blind when it comes to elections and there are no laws governing elections in Ghana. Its a winner takes all situation. If a political party bribes EC officials, they can subvert the fundamental right of one man one vote, by filling imaginary figures to favour one party. Election results cannot be audited in Ghana.Lawless country.

Dear Prof Ayittey,
Your article catalogues most of the 'whys' and 'hows' of what brought us to where we are today---both before and after the election and more importantly after the Supreme Court verdict. As you rightly said, the debate will rage on, and rage on it must, not because of any attempt to get the SC verdict re-examined and possibly reversed, but because we could use all the "lessons learned" from the last election to clean up our act to make the next one and all the elections thereafter better. In this regard and in my humble opinion, you stretched it a little bit when you said in paragraph 4: "I would have preferred, not a re-run but a re-vote of both the presidential and parliamentary elections in a year's time". That will take time and money, money that we don't have much of at this time.

To that end let me say this: to believers in the democratic principles, there was not a heck lot that needed to be said after you wrote in your very first paragraph: "In a 5-4 ruling...the SUPREME COURT on Aug 29 dismissed the petition filed by the NPP, challenging the validity of the Dec 7., 2012 election..." When the SUPREME COURT rules, that is the end of the road for both sides of a litigation, PERIOD.

I guess slowly but surely, we are all learning the hard way that travelling along the road of Democracy is bumpy and not a very easy one. But we have made reasonably impressive headway so far and we should keep that momentum. And moving forward, we cannot make any progress unless we move beyond the SC verdict. Nobody wants to see the affairs of the country put on hold for yet another few more months. Therefore, all this deafening supersonic decibels about forming a second layer of the Supreme Court and the-ever-looming probable call for a revisit to the SC verdict wouldn't do anyone any good. Let's revamp the Supreme Court if we have to (not a 2-tier one for sure) but for now, we have an economy that needs attention. PLEASE, LET'S MOVE ON and as we move on, we could use some of the rather constructive points you raised in your article to fine-tune our legal and parliamentary systems, keeping in mind what to me is the finest line in your whole article: "The national interest is supreme and should trump partisan interests".

What was in court for the judges to decide was the validity of Mahama's presidency and not the efficiency of the EC.
Did the irregularities alluded to affect only one contender in the election.
Where is the evidence that Mahama influenced the EC?
Is it only when NPP loses an election that electoral reforms become necessary?
Kindly note that the EC boss that is being vilified was invited to conduct elections in other countries. No project is recognised in his own town. If NPP wins there is no fraud, but if it loses then there is a fraud. This writer claims to know better what is in the supreme interest of this nation than the 9 SC judges who deliberated on this issue for 8 solid months. To us the lay men the admission by Bawumia to the whole wide world that there was no wrong doing in the election by JM settles everything. It is only when we as a nation learn to accept the truth and defend it that this country's interest will be better served.

ATUGUBA’S BEHAVIOR AND ATITUDE HAS BROUGHT ONE OF THE REPUTABLE AND HIGHLY RESPECTED COURT IN THE WORLD, GHANA SUPREME COURT INTO THE MUD. IT WILL TAKE YEARS FOR THE COURT TO REDEEM ITS IMAGE.
