Ghana and the Awards of Contracts – Is the matter of Sole-Source Procurement properly applied to the discussion?

One of the best practices for Ghana to ensure excellent public financial management is a well-appraised public procurement, especially for contracts awarded without competitive tendering. I share some views on the discourse to support the body of knowledge.

In recent discussions of government procurement methods, the term sole-source has been used. Ghana’s procurement regime is guided by ACT 663 and its subsequent amendment (ACT 914). There is no such term, sole-source, stated clearly in these ACTs. The procurement methods under the ACT are the Competitive method (National and International Competitive Tendering), Restrictive Tendering, Single-Source Procurement, and Request for Quotation (RFQ). The terms Sole-Source and Single-Source procurement are often used interchangeably. These “synonyms” technically do not mean the same thing in the procurement business. It is paramount to understand the distinction because the approval requirements, legal justification, and eventual audit consequences may differ depending on the instances under which a contract is awarded.

Recently I hired some Ghanaians nationals to build a house for me in Cote d'Ivoire. They sold all my items and run away. What really hurt me is Akwesi Frimpong who is from the Cape Coast area. we formed such a bond that I was promised him to bring his son to the United States to study since I am myself an University professor in the States. About 75 millions CFA worth of materials since I was building a six units apartments complex. His son is an university student in Ghana. Anybody knows Akwessi should contact me. I have contacted the Ghana embassy in Cote d'Ivoire, Interpol is doing its part. Thank you.

Abstract

On 28 February 2026, the United States and Israel launched coordinated military strikes against Iran codenamed "Operation Roaring Lion" (Israel) and "Operation Epic Fury" (United States) targeting military and governmental infrastructure across the country and resulting in significant civilian casualties. This article critically examines these developments through the lens of international human rights law and the laws of armed conflict, evaluating the legality of the use of force under the United Nations Charter, obligations arising under international humanitarian law (IHL), and the profound consequences for civilian populations. The strikes occurred against a backdrop of Iran's violent suppression of mass domestic protests, which itself raised grave human rights concerns. This article argues that a durable and just regional order cannot be built on military force alone, but requires adherence to legal norms, independent accountability mechanisms, and robust diplomatic engagement.
