Nurse appeals against ruling

Accra (Greater Accra), 15 July, Mrs. Theresa Amponsah Aidoo, an Agona Swedru nurse has appealed against the judgement of a Swedru High Court in a land case between her and Mr. Matwatt Kori of Japan Motors in Accra which she lost. One of Mrs. Aidoo's grounds of appeal is that the presiding judge erred in law and caused a miscariage of justice by admitting exhibits Mr. Kort, the plaintiff, had failed or refused to produce for inspection when requested to do so. According to her, the presiding judge erred in law and wrongfully exercised his discretion to admit the exhibits when Mr. Kort had failed to give reasonable explanation for his failure to produce the document for inspection. She called on the Court of Appeal to quash the High Court ruling of June one, 1998, reject the exhibits and expunge evidence relating to the indentures submitted by Mr. Kort from the record of proceedings. Mr. Kort, among others things, was claiming damages against Mrs. Aidoo for trespassing and harassment over a piece of land near the Swedru Market. Mrs. Aidoo, on the other had insists that the property belongs to her by inheritance from Mr. John Laud Amponsah, her father who leased it to Mr. Nutus Lort, father of defendant.
