And when it comes to arrest, its not only the arrest of mayors who need court orders, but it applies to all citizens.

You are absolutely wrong, the policeman and his boss the Divisional Commander although do not report directly to the MCE they are under him and Mr Bonsu is the Chief Executive of Kumasi and the chairman of security council of that district in which these police officers are members and have no right whatsoever to invite him to that place in the first place when the assembly took a decision to pull down unauthorized structure in the city.
What is the crime of Mr Bonsu for the police to invite him, is it not the responsibility of the city to take those decisions, are they asking the assembly to get a permit from them before pulling down those structures, was Mr Bonsu involved in a fight with that man for the police to invite him?
If you do not know, if somebody reports you to the police in Ghana and you are invited by the police it is considered most of the time as arrest.
What is the police investigating, investigating if the man has the right to build on a land reserved for a road?
Some of these policemen are turning Ghana to a lawless country where anybody can do whatever he or she can so long as that individual has money or power and some of them too are taking the law into their own hands because they are policemen.
Yesterday it was another hopeless one who reportedly slapped Vicky Hammah because she did not pull over when she was asked to do so and went as far as standing in front of her car to prevent her from moving, how dumb can that police man be to do something stupid like that.
How on earth in this civilized world a policeman will slap somebody more especially a female even if she was in a fight with him, how can we have such idiots as peace officers?

I am an ex DSP of the Ghana Police Service. I do not identify with this District Police Commander over his frustrations. I think his frustrations are self-inflicted. Under the laws of Ghana, there is equality before the law and the law is clear that for the purpose of conducting their investigations, the police can arrest anyone on reasonable suspicion of having committed a crime or on reasonable suspicion of being complicit in the commission of a crime. The police were simply being courteous when they invited the KMA boss for investigations but since he wants to ride roughshod over the police, they should arrest him for the purpose of their investigations. Once he is under arrest, they can then keep him from being one minute to 48 hours for the purposes of their investigations and he cannot walk out on the police whilst under arrest with the flimsy excuse that he is busy.
The District Commander has all the power under the law to arrest this bloke to let him co-operate with his office for the purposes of this investigation. I think an arrest of this bloke will teach him and other people of his ilk that the law is no respector of persons even if they are exalted in political offices.

Mr Ex. DSP, I agree with you in respect to the powers of arrest of the police. However, I would have to disagree with the police invitation to the Mayor. This is because the Mayor is the head of the local government under which the police answers.
Secondly, the action of demolition was undertaken by the KMA (the local government), and not the MAyor.
Thirdly, the action was undertaken by a combination or police/military team under instructions from the KMA.
Thus, the police have no locus to invite the person of Kojo Bonsu in his personal capacity. But rather they can go to the KMA offices and request all legal documents and information pertaining to the said demolition. Or better still they can report any un-coorperative attitude to the Minister of Local Government, under which all local governments serve, including the KMA.
If the Police is so peeved, I would ask him then to go and arrest all the soldiers/police who carried out the actual demolition.
Our police should know the law and how to go about official business. The Mayor does not have to answer to them for ANY official actions undertaken by the local government authority(in this case KMA).

The above statement betrays your crass ignorance of the place of the police in our current constitutional democracy. Under our constitution, the police are never under any local government authority. They co-operate with every local government authority for the purpose of enforcing the law but they do not work under any such authority. It is such warped reasoning that made this bloke to walk out on the police.
Secondly, you do not know the full details of the complaint made by Mr. Odike to the police. Therefore, it is improper to conclude that the case is civil or that it concerned the official functions of the suspect concerned and hence there is no need for him to co-operate with the police. No matter how bogus you think a complaint against you is, you will be foolish to ignore an invitation to go and answer to the police. For all you know, what you guess to be the basis of the complaint may be altogether wrong and you may actually have a criminal case to answer to. From the complaint received, as long as the police have a reason to suspect that you have involved yourself in some form of criminality, the police can always move into a higher gear to arrest if you ignore their courteous invitation to you to come and answer to the complaint. When the interrogation after your arrest reveals that you were wrongly suspected, then sorry for you for the arrest but you can do nothing about the arrest. The arrest remains lawful as long as there was reasonable suspicion of your criminal involvement as the basis for that arrest.

And just to educate you, the police at the District level is under the District Security Council (Disec), and the District Police is under the DISEC. Or and guess who the head of the DISEC is...the District Chief Executive (The MAYOR).
This also runs same for the Regions. Each region has the Regional Security Council (REGSEC), of which the Regional Police commander is a member. The HEAD of the REGSEC is the Regional Minister. Since you want me to educate you, under our constitution, the political Heads of government take precedence over the Security heads. Because the political heads, all the Ministers, District Chief Executives and Municipal Chief Executives are all representatives of the President and serve at his pleasure. That is what Ghanaians signed up for in democracy and that is what they are getting.
However, comming back to this issue, if the case is about the demolition, why did the police not

Please cool your hot head. I know a lot of people do not like Kojo Bonsu, and personally I don't care for him because I do not think he is qualified. But the matter of the case is that the demolition was ordered by KMA, not the Mayor. However since you are so passionate about the Mayor being arrested, I suggest you petition the police to arrest all the KMA officers and the police/military team that undertook the demolition (if they can)!

So you see, when it comes to both the law and policing, I am streets ahead of you in doing a well-informed analysis.
Why do you continue to expose your crass ignorance to the public? I can assure you that the Local Government Act, 1993 (Act 462) does not contain any provision relating to the District Security Council (DISEC)or the Regional Security Council (REGSEC). These councils are extentions of the National Security Council and the establishment and functions of all these security councils are provided for by the Security and Intelligence Agencies Act, 1996 (Act 526). Go and read Act 526 for yourself!!!
Suffice it to say that both REGSEC and DISEC exist to perform only advisory functions to the National Security Council under Act 526 as regards the identification of security threats to the relevant District, Region or to the country or Government and the making of recommendations to the National Security Council for proactive steps to be taken to make all of us safe from such threats.
So you see, the fact that a District Chief Executive is the chairman of DISEC does not make him the head of the police in the district. He has his mandate and the police also do have theirs. In a true democracy as we are trying to build in Ghana, everyone must respect the law no matter who you are or what position you have been appointed to else the police always have the power to pick you up to face the music if you break the law and there are criminal implications in such breaches of the law. Please read before you expose yourself next time, boy!!!

I can see through his complex: being a metropolitan chief executive, he believes he should report to the regional police commander or at least the divisional commander but not a common district commander and hence he snubbed the district commander, but the district commander can send his men after him to bring him in for investigations and even if he has a meeting with the President of the Republic, the President must either wait till after the interrogation or reschedule the meeting. It is high time the police took their rightful position in our constitutional democracy!!!

And by the way, it was a city action, why call the Mayor personally to the police station? An official written notice should have been sent to the city office and city lawyers would have responded; not the mayor directly.
