Hanan Abdul-Wahab's Buffer Stock case faces dismissal motion led by Godfred Dame

Former Attorney-General Godfred Yeboah Dame has asked the court to strike out the charge sheet against former National Food Buffer Stock Company (NAFCO) Chief Executive Officer, Hanan Abdul-Wahab, arguing that it is legally defective and fails to meet the requirements of Ghana's criminal procedure laws.

Appearing for Abdul-Wahab before the Specialised Court One, Dame contended that the charge sheet does not provide sufficient particulars to enable his client to clearly understand the allegations against him or adequately prepare his defence.

According to reports by adomonline.com, he further argued that the prosecution had improperly combined several transactions spanning different years into single charges, contrary to established legal procedure.

According to the defence, the Attorney-General's own affidavit acknowledges that multiple payments and transactions took place during the period under investigation, a position they say supports their argument that the prosecution has failed to identify the specific acts that constitute the alleged offences.

Godfred Dame also maintained that the prosecution cannot rely on the same facts to pursue charges of both stealing and defrauding by false pretences without clearly setting out the legal ingredients of each offence.

On that basis, the defence urged the court to dismiss the entire charge sheet, insisting that Abdul-Wahab should not be made to stand trial on charges that fall short of the legal threshold.

The application was opposed by Deputy Attorney-General Dr Justice Srem-Sai, who argued that the charge sheet is clear, complies with the law and provides sufficient information for the accused to understand the case against him.

Justice Francis Apanga Achibonga, who presided over the proceedings, adjourned the matter to July 23, 2026, when he is expected to rule on whether the charge sheet should be struck out or the case should proceed.
