Kumasi, May 10, GNA - A Kumasi high court on Tuesday awarded a 2 million cedis' cost against the Electricity Company of Ghana (ECG) for delaying in filing its defence in a case in which a customer had sued the company for illegal disconnection.
Kwaku Owusu Enterprise Limited at Tema Community Five had filed a writ at the high court, claiming damages of 914 million cedis against the ECG for illegally disconnecting electricity supply to the company's cold storage plant at the Race Course in Bantama, resulting in the destruction of the products of the company.
The ECG failed to file its defence until May 09, the day set by the court to give its judgement.
Counsel for the ECG, Mr Owusu Sekyere, told the court presided over Mr Justice Kwame Ansu Gyeabour, that his client had filed a defence to contest the case.
Counsel for the plaintiff, Mr Bob Senyalah, argued that his client had not received any defence notice on the matter. Mr Gyeabour, in awarding the cost, asked counsel for the plaintiff to study the defence and come back on Friday May 12 for the normal trial of the case to begin. 10 May 06
