This is an excellent test case and the best news for the Ghanaian tax payer in decades. Ex gratia should only be paid once if you are in the same job and only to MPs who leave parliament or have lost their seats but not re-elected MPs. This is never done anywhere except in Ghana. That is why the legislature has become a money making business and explains why every Tom Dick and Harry wants to be an MP. In the UK, ex gratia is only paid to retiring and defeated MPs. However with defeated MPs, s/he must secure a certain percentage of the total valid votes in order to be eligible. If that threshold is not met then good luck no ex gratia is paid. This is to stop MPs who were deselected by their constituencies/parties going independent in order to ensure the defeat of the official party candidate.

I have always argued that the whole issue of ex gratia is not consistent with the practice in other developed democracies. It makes our democracy too expensive to practice. If you go to matured democracies like Britain, all MPs contribute into a Parliamentary Pension scheme which MPs can draw when they reach the retirement age. This age could be 50 or 55 and if an MP loses his seat, that MP will have to go and find something doing until he reaches the retirement age. There is nothing like the payment of ex gratia. MPs like every other worker has a pension which they draw on retirement period. I therefore support this suit and hope the court will see the unfairness in this and ban it for good.

"All Human Beings Are Created Equal / Equally".I would have no qualms if the wording is "persons who have exhibited extraordinary intellect or simple common sense approach in the Community/Society.Members of the Council of State served as the President "backyard parliament". Therefore, a cross section of certain persons serves the purpose for which they're needed for the president to consult despite his advisors, and Not for the reason of honouring or a mere "Rubber Stamp" honour we have in Ghana.Either than that, the paramount Chief in the 10 Regions should be the Members of the Council of State.
