Actress and model Daphne Joy has been slapped with a defamation lawsuit by her ex-boyfriend and father of her son 50 Cent after she accused the rapper of rape and physical abuse in an Instagram post.

The court documents were obtained by PEOPLE. And the lawsuit, which was filed in Texas on Monday, claims that the “false allegations” made by the defendant, whose real name is Daphne Narvaez, have made the plaintiff suffer “extensive public ridicule, hatred and contempt.”

The suit also alleges that the allegations made by Narvaez, 37, in the post were a “purposeful attempt” to tarnish the In da Club rapper’s image and prevent him from having access to their son.

The lawsuit stated that Narvaez on March 28 took to Instagram to level the allegations against the rapper, whose real name is Curtis Jackson. Narvaez in the post had said that she and their 11-year-old son, Sire, relocated to New York so they could be near Jackson, but the rapper in two years only saw the boy 10 times.

“I am tired of upholding and protecting an image to our son that you have never even earned. Let’s put the real focus on your true evil actions of raping me and physically abusing me,” Narvaez shared.

Authorities in 2013 brought a domestic violence charge against Jackson over an incident involving Narvaez, PEOPLE reported. Jackson was said to be arguing with Narvaez when he kicked the 37-year-old in the stomach and damaged her property. He ultimately entered a guilty plea to misdemeanor vandalism – a minor offense.

Jackson in his defamation lawsuit alleges that Narvaez made the March 28 allegations after reports circulated about the plaintiff wanting custody of their son after the defendant was described as a “sex worker” in a lawsuit filed against Sean “Diddy” Combs.

But Narvaez on March 28 also responded to those allegations, writing that she was “deeply hurt by the lies” in the lawsuit producer Rodney “Lil Rod” Jones filed against Diddy. “The claim that I am sex worker is 100% false and character assassination,” she stated at the time. “I am retaining an attorney to explore all legal remedies against both Rodney and his attorney.”

Jackson’s suit, on the other hand, alleges that the plaintiff’s custody filing was met with retaliation from Narvaez as she took to Instagram to share “multiple defamatory statements.”

Per the documents, her statements “falsely and publicly accuse Jackson of rape and physical abuse during their prior relationship, in a purposeful attempt to… destroy his personal and business reputation, harm Jackson’s commercial and business interests, negatively affect his custody case, and prevent him from seeing his minor son. Narvaez’s claims are false.”

In a statement to PEOPLE, the Candy Shop rapper’s attorney, Reena Jain, said that “despite being given ample opportunity to retract a false and malicious retaliatory accusation, Ms. Narvaez has shamefully chosen to interfere with her 11-year-old son’s relationship with his loving father by falsely calling him a ‘rapist.'”

Jackson is seeking over $1 million in damages.
