Following the news that Ghanaian rapper and presidential aspirant in the ongoing University of Ghana Students’ Representative Council (UGSRC) race, Maradona Adjei Yeboah, also known as Guru, had been disqualified, UGSRC Legal Advisor Bright Atsu Kofi Agbetsise has stated that Guru is still eligible to appeal the SRC’s decision.
The disqualification, announced in a letter dated August 16, 2024, and signed by the UGSRC electoral commissioner, was due to Guru and his running mate's non-resident status.
However, in an exclusive interview with GhanaWeb Entertainment on August 16, 2024, Bright Agbetsise confirmed Guru’s disqualification and explained that while Guru met all other requirements, his non-resident status was a key factor in his disqualification.
When asked about the possibility of an appeal, Agbetsise affirmed that Guru could seek redress from the Judicial Board.
"Yes, he can. The SRC Constitution makes it possible for aggrieved persons to seek redress from the Judicial Board," he said.
He added that Guru would need to determine the grounds for his appeal with his legal team.
Regarding whether an appeal would necessitate an amendment to the constitution, Agbetsise stated that the decision would, “be left for the Judicial Board to determine.”
According to Article 30(1)(a) of the UGSRC constitution, candidates must be resident students and eligible to contest elections under their hall's constitution to qualify for executive office. This requirement led to Guru's disqualification from the race.
