Asamankese, March 11, GNA - Samuel Nyarko, a farmer, who bit the nose of a purchasing clerk, during a fight, resulting in the victim undergoing a plastic surgery, was on Thursday convicted to a fine of GHC 840 by the Asamankese Circuit Court.
Nyarko, who pleaded not guilty, was also ordered by the Judge, Mr Emmanuel Siameh, to pay a compensation of GHC 500 to Frank Agbede, the victim, whose nose was bitten- off.
In default, Nyarko, who also faced a charge of intentionally and unlawful causing harm, would go to prison for nine months. The Prosecutor, Police Chief Inspector Kate Ogyiri, told the court moments before sentence was pronounced that, Agbede, who suffered the injury in 2007, was to undergo another operation at the Korle Bu Teaching Hospital soon.
Giving the facts of the case, Chief Inspector Ogyiri said sometime in 2006, Nyarko collected a traveling bag from the complainant and left for Nigeria.
He, however, returned to Akanta Yensua in December of that same year and when the complainant demanded his bag, Nyarko told him that his brother in Accra would send it to him later. The prosecutor said that explanation resulted in a misunderstanding between the two.
She said on November, 13, 2007 at about 06.00 hours whilst the complainant was going to Winnang village, he stopped at Akatanyensua to find out from the convict whether his bag had been brought by his brother, but the convict became infuriated and the two quarreled. When the quarrel was settled and the complainant was on his way to Winnang, Nyarko attacked him and hit his face with a stone. The prosecutor said the money the complainant was carrying on him also got lost in the process.
