High Court strikes out contempt charges against Watch and Dine Cinema, five others

The Commercial Division of the Kumasi High Court on Tuesday, July 16 acquitted and discharged Watch and Dine Cinema and five others of contempt charges brought against them by Glorie Osafo Agyemang-Duah and Osei Agyemang-Duah.

The court presided over by Justice Dr Richmond Osei-Havre dismissed the charges on the grounds that application for contempt was incompetent.

The applicants were praying the court to commit Watch and Dine and Five others over what they believe to be a disregard of an interim injunction imposed by the Court on the 7th of May, 2019.

However the court in its ruling stated that the ingredients of contempt for which the applicant sought were not satisfied.

It held that the applicants could not provide cogent and convincing evidence to back their claims.

The court in its concluding remarks stated ” In conclusion the applicants are not entitled to the order sought, as they have failed to prove that the Respondents willfully disobeyed the injunction order of the court dated 7th May, 2019 and that they (Respondents) have acted in a way that brings the court into disrepute. Consequently, I dismiss the application.”

The court also awarded costs in the sum of GHC8,000 against the applicants.

The operators of the cinema have also denied reports of it being closed down, describing the reports as ‘calculated attempts by some mischievous people to cripple activities of the Watch and Dine”

They appealed to the public to disregard such reports and emphasized that Watch and Dine Cinema is opened to clients.
