I used to be of the same view that the absence of the signature of the Presiding officer could not invalidate the results of the votes cast until I read the Constitution this afternoon. (Given I am not a lawyer though) but my layman's interpretation of the supreme ;aw governing the land says categorically states that the Presiding SHALL sign the declaration form ie pink sheets. Article 49 (3) The presiding officer, the candidates or their representatives and, in the case of a referendum, the parties contesting or their agents and the polling agents if any, shall then sign a declaration stating -
Now I am not sure of the consequence of not signing since the the constitution is silent on the validity or otherwise of the pink shrrt. This willbe the duty the duty of the Honorable Justices to determine. My personal guess is that like Ms. Margaret is saying the judges may rule the votes to be valid based on the testimonies of the party agent represented at the polling station. My view is dictated by the argument the right to vote and have your counted is such a fundamental and sacred right that it should transcend the signature of one irresponsible so called presiding officer. And again if the court errs (in my opinion) to invalidate the results of these polling station only because they lacked the signatures of the presiding officers, then the court woukd have open a door a set a precedence for unscrupulous partisan presiding officers to intensionally hijack the election process should the results not go their way.

There is no need spending time to quote laws to force people to accept the results if indeed the election was won by headcount but not on technical grounds. So far the apprehension and the aggression with with which the NDc is trying to justify the legitimacy of the elections which is being challenged in court make me think there is a skeleton in somebody's cupboard.

It seems also to me that some of those EC returning officers were newly employed or were just hired, and they might have forgotten to sign their portions.
If those people have not been paid yet then I suggest they should lose portion of their wages because their failure to sign their portions has brought a consequence that has put Ghana on the verge of EXPLOSION.

“There are 1,825 pink sheets without signatures which goes against the electoral laws and the total votes involved is 16,109 which is likely to affect the election results” he added.
"..Nana Akomea posited that the NPP anticipated that the EC may want to interfere with evidence that is why it asked the court to force the Commission to tender in all the original pink sheets for safe keeping...
"..The (NPP) Director of Communications said EC has been caught red handed trying to change the documents because they know the NPP has a case in court.."
Margaret Jackson is also being haunted by her fears and inferiority complex, by making this derogatory statement about the NPP;

In this circumstance, I do not see how the presiding officer's signature alone having been ommitted has allowed somebody else to commit fraud, unless the party agents deny their signatures.

The fact that the law specifically does not state that "any unsigned pink sheets would not be accepted as valid" does not mean that the returning officers could submit those pink sheets without their own signatures. And if returning officers' signatures would count for nothing, how much weight would be attached to those of party agents?
It seems you are behind the times. The EC has been accused of accepting unsigned pink sheets from polling station 205, say, in Savelugu. When the EC checked their records, they realise that the pink sheet for polling station 205 was actually not signed. So the EC instructs its officials in Savelugu to get a copy of the pink sheets for polling station 205 signed and despatched to headquarters asap. The EC would, when called to testify, use this new signed pink sheet from polling station 205 in evidence, rather than the old unsigned copy. How about that? Get to grips with common sense and stop seeking unnecessary attention.

The signature important as it is can questioned but not a valid vote. personally do not see the wisdom in EC officials going round to fish out signatures. That should be seen as tampering with evidence for all that it is and the culprits must be brought to justice if found guilty. But all this crying foul about the unsigned sheets will be resolved by the SC ordering the EC to go back and get them signed just like an unsigned check will be returned to issuer to append his/her signature. I bet you the SC will throw out all these votes for such flimsy reasonings. Ihe purpose and goal of this suit or petition is actually to make VALID AND LEGALLY CAST VOTES COUNT FOR WHAT THEY ARE AND TO DISCOUNT WHATEVER VOTES THAT ARE PERCEIVED TO BE ILLEGAL. And I will contend that unsigned declaration sheets do not invalidate the ACTUAL VOTES CAST. We can always go back and recall those ballots and have a recount. If I was representing the EC/ndc I would counter suit for a recount to settle this case( except of cause they have something to hide-hahaaha)

"All the parties that contested the 2012 Elections including the Supreme Court have copies of the pink results sheet from all the 26,002 polling stations. The result is currently being contested in court, so if somebody tries to validate some few copies of the pink results sheets who will that result sheet go to? Can the person who is trying to play mischieve take the so-called newly validated sheets and distribute it to all the parties that contested the 2012 Elections and also provide same to the Justices of the Supreme Court? It does not make sense at all.
I do wish the NPP will stop this nonsense and do a deep soul searching and later inform their members about the truth on the ground. It is better to let the truth out in time than later. The NPP's basic understanding of what even constitute validation of results clearly shows that we have a party that is too keen to govern but do not even know the basic laws of the EC".
I appeal to all supporters of JDM and the NDC to remain calm and calculated. The Lord God won victory for Ghana, and no man (NPP)can put asunder. They are finding it difficulty to live with the fear of losing the 2012 elections, having been too sure of winning with the Free Education mantra. Folks stay-tuned!!
