  If Ghanaians would take a step back and see how far Ghana's democracy has progressed after 20+ years well into the 4th Republic, they would come to realize that any decision that the SC would make CONTRARY to the LETTER and the SPIRIT of Ghana's Constitution, should be seen as tantamount to a Constitutional COUP in Ghana. The effects of such a decision could be just as retrogressive as a COUP executed using the barrel of a gun.
  
  Here is why:
  
  1- Ghanaians have seen and tasted freedoms inherent in democratic rule;ie freedom of speech, freedom of association, freedom of press progress in Ghana in the 4th Republic.
  
  2- Ofcourse, there are some limitations and some changes and amendments that are needed to be made in the coming years, but where the Constitution needs to be upheld to preserve the Republic, Judges, especially those at the SC MUST NOT deviate from it; they cannot change it; they can only suggest that the Legislature lead efforts to amend sections where necessary etc..
  
  3- Where the Constitution works, Ghanaians have witnessed smooth and hitched free transition and continuity, in glee and in preservation of their peace...
  
  4-A case in point was where Prez Mills died suddenly, requiring the Constitutional mandate of swearing in a new President, in this Mahama, within hours.. That obligation was carried out beautifully and hitch free that the world SAT UP and applauded Ghana for her democratic strides-
  
  WILL THE SC JUDGES WANT TO BE SEEN AS REVERSING STRIDES ALREADY MADE?
  
  4-Another example was swearing in Prez Mahama after being declared by the EC as having won election 2012 without regard to a pending court case challenging his legitimacy- since swearing in Mahama, or any winner of an election, is a constitutional mandate, can the Supreme Court then be able overturn Mahama's presidency? Will that be in the "spirit and letter" of Ghana's current Constitution?
  
  WHAT GHANA NEEDS NOW, PARTICULARLY IN THIS CURCIAL "FORK IN THE ROAD" CASE, IS NOT JUDICIAL ACTIVISM, BUT FOR THE JUDGES TO CONSIDER PUBLIC POLICY IN MAKING THEIR ULTIMATE DECISION.. THIS INCLUDES CONSIDERING WHAT IS IN THE BEST INTEREST OF THE MAJORITY OF POPULACE AT LARGE, WHAT WOULD ADVANCE GHANA'S DEMOCRACY FORWARD, PRESERVE HER PEACE AND UNITY; AND WHAT WOULD UPHOLD THE CONSITUTION OF GHANA, WHICH IS THE SUPREME LAW OF THE LAND..
  
  ANY DECISION DECLARED WITHOUT CONSIDERATION OF THESE ESTABLISHED AND PRECEDENTIAL LEGAL DOCTRINES SHOULD BE SEEN AS TAINTED AND UNDEMOCRATIC!
