LITHUR GET PUNKED REALLY BAD.

Lithur problem is that, he cannot prove that the duplicate copies affected the total number of the illegal votes.

I am not holding brief here for Bawumia but your presentation of the issue is either mischievous and/or misinforming.

I have serious problems with the credibility of Bawumia's evidence, the fact that the pertitioners are complaining about 11138 while providing only 8621 polling station sheets.

Despite these concerns, your point is wacky and indicates a limitation in your comprehension of the issues at stake.

First, a lawyer should not ask a question he does not know what the answer is going to be.

Second, a lawyer should not ask or suggest an open question that will give a witness the liberty to ramble on and Tony Lithur committed both mistakes on Monday.

First mistake was this exchange;

Lithur posits there is "substantial duplication" of pink sheets by the petitioner to make up the numbers. If we count the pink sheets that have been presented we will not have 11, 138 polling station that have been brought before the court. He says the respondents do have only about 8000 pink sheets as exhibits and not the 11, 138 as claimed by the petitioners.

Bawumia insists there has not been substantial duplication to make up the numbers. He adds the respondent's counsel has only brought forward 348 polling station of what he claims to be substantial duplication and that even if 6,000 polling stations were taken out of the petitioners' request, the first petitioner would still win by first round.

Lithur then asks if the pink sheets in lot four have been repeated.

Bawumia answers in the affirmative but says they were only analysed once.

The second mistake is when Lithur averred that the NPP Agents slept on the job and this exchange took place.

Role of Polling Agents; Tilapia thieves

The counsel for the first respondent averred strongly that the petitioners had polling agents who were statutorily mandated to watch keenly every turn of the voting process and that if they failed to carry out their duty, petitioners had no business running to the court and calling for the annulment of votes.

Bawumia retorted saying the counsel erred in that logic. In an analogy, the witness in chief of the petitioners said if a thief escapes the notice of a sleeping watch man and succeeds in stealing "tilapia", the owner of that tilapia still has a right to enforce the law and to ensure that his tilapia is returned to him. It will not be said that because his watchman slept on the job, his right of ownership of the tilapia has been taken away from him, he added.

LITHUR GET PUNKED REALLY BAD. This was a knocknout because Lithur gave Bawumiah an open question for him to turn the tables on him Lithur by calling his clients TILAPIA THIEVES in essence

King solomon applied wisdom in his court. from the court of Otumfuor to any little chief up to the supreme court of Ghana application of wisdom is what makes the difference. This is why some lawyers win where others have failed. I am not a lawyer and I dont know the law much but if you state the law I may be able to apply more wisdom to argue around the law than even a qualified lawyer. Lithur first went for Bawumia's suppose mistakes to prove that anyone can make mistake and so is the EC therefore irregularities are normal. That cant win the case because if mistakes are found and genuine it means the will of the people were mistakenly disrespected and has to be respected. his business is to prove that no mistake occurred and that mahama really has the mandate of the people. Now he is still fumbling and not proving nothing. This is sad.

In a complex case involving thousands of pages of documents, there is bound to be a few mistakes in assembling those documents as exhibits for trial. It has happened to me before. This case involves In excess of 11,000,000 documents produced to the Court and copied to each of the three Respondents. So don't be excited if Lithur jumps on Bawumia when he finds a few errors with the filing because it proves nothing. What is controlling is whether the alleged duplicates or errors makes the statistical analysis unreliable. So far the

errors or duplicates unearthed by Lithur is so insignifant that as a trial lawyer, I will not spend three days cross on them in light of the responses he has been getting from Bawumia. It seems to me that he is doing this for the party supporters. Unfortunately for him, the Judges will decide this case so he better bury his nose deeply into the statistical analysis and punch big holes into them . Picking out a few duplicate pink sheets and alleging that the Petitioners did so to deceive the Court is conclusory, lacks foundation and is disingenuous. The justices see through this charade

and this is why he has been losing every motion thus far. Addison is strait to the point and he seems to have established credibility with the justices and this will help his clients. The speed at which he did his direct examination of Bawumia was very impressive. He will continue to dominate the Court room.
