I have raised exactly those arguments made by the writer's "white friends" and, in particular, in response to what I described as unintelligent arguments by Michael Bokor. The only arguments I did not raise were those dealing with the ability of Nana's clients to sue Kpegah. I hope that the guy who accused me of being subjective and unfair to Bokor is reading or has read this feature article. This said, what surprises me though, is why the Ghana police is not investigating the allegations of murder made by Kpegah. Since Kpegah alleged that the murder could have been committed in London or somewhere in England, has the Ghana Police contacted their counterparts, the Scotland Yard, for any information on this alleged murder? The Ghana police can get to the bottom of this matter rather easily - search the death and birth registry in both Ghana an England; track down the relatives of the "murdered person"; check newspapers for any appeal to the public for information on this murder; obtain a warrant to dig under Nana's office building to see if someone is buried there, if so, who was that person, when was he buried there and who buried him there; check with the airlines for records on any corpse transported to Ghana and what name was given for the corpse. The Ghana police is simply not doing its work. After the case is over, whether or not Kepgah wins (which I doubt), someone in Ghana should be bold enough to bring a public interest action against Kpegah, for not reporting crimes that he is aware of, and for which he would be an aider and abettor or an accessory after the fact. The person can easily win a public interest standing as the police/state, has shown no interest in investigating Kpegah crimes arising out of the allegations he has made in his suit. And for Nana, if he wins, of which I am 100%, he should sue Kpegah for damages, including punitive damages (and even donate the amount to Charity) to prove a point that Kpegah cannot destroy someone's hard-earned reputation for political expediency. He should also look for those behind Kpegah and sue them as well. And not only Nana should sue them; the other lawyer, Prempeh, should also go after him. This is the time that the gloves should come off and the "fa ma Nyame" syndrome should be thrown out of our national psyche.

1. What is the real name of Nana Ado?
2. Which law school did he attend and who are/were his law school/class mates?
3. His certificates
4. was he called to the Ghana bar?
These are simple questions that should have even been cleared by Nana to make this case useless. Once he Nana does this then we can even in advance make some predictions.
Coming to the Murder issue, should Nana fail to meet these requirement then he will have some questions to answer on the murder case. So the question boils to Nana proven himself and turning the case on justice Kpegah which I think will be a hard nut to crack considering the present name Nana is using.

The weird thing is no classmates of Nana in law school are coming forward to defend him. As a purely technical legal case, the onus is on Kpegah to prove his case. But as a political case, it is Akufo who must come out clear and the onus is on him here. In the perceptions of political Ghana, it is Akufo-Addo who must show that he is clean. That is why he needs Kpegah to come to court so that he (Akufo) can show how wrong Kpegah is. If this doesn't happen, the political public will still be suspicious of Akufo. It is Akufo who needs the public's vote and confidence, not Kpegah.
Kpegah has nothing to lose. He is old and decrepit and has no political ambitions - quite a nonentity. It is Akufo who has something to gain in this case - or to lose! And this will be so even if NPP wins the Supreme Court case.

When Kpegah knew of Akufo's not being legally qualified as a lawyer is of no consequence. He can know all his life and decide to bring an action now. But if Kpegah knew of Akufo as a murderer long ago and did not tell the police, then he can be accused of hiding a crime he knew took place. The murder part of Kpegah's suit is the weakest. That will be difficult for him to prove. Even the impersonation case will be difficult for him to prove. The only thing he may be able to prove is that there was something fishy in the manner in which Akufo got called to the Ghana bar. If he has done his investigations well, and has younger lawyers to help him, he should be able to prove his case. But if he is not sure of his evidence, it will be better for him to withdraw the case now and go home with his tail between his legs. Even if one has a good case in court, one must still be able to prove it. Can he? Courts work on the evidence that is provided in court - not on the actual truth or otherwise of the case.

I think every contributor to the dialogue, so far, has no idea how the legal system works. First of all, how long Kpegah has known Akufo-Addo to have been involved in the crimes is immaterial. And note the word "crimes" and not "crime" as every allegation that Kpegah has made borders on criminal activities - impersonation, holding himself out as a lawyer (fraud) and murder. As soon as Kpegah became aware of any allegations, he should immediately have told the police. He has still not advised the police of his knowledge. That is the essence of being an accessory and this is my first point. The second point is that a person accused of crimes is normally not sued by a private person in a civil action (except that if that private person has incurred personal costs or some personal damages, for example, funeral expenses or loss of livelihood then he/she can sue in a civil court and claim damages against the alleged perpetrator). Short of that, crimes are prosecuted by the State or nation (that is why you see R. v. so and so (for those not living in say England, R. being the Crown or the Queen). If the State refuses to prosecute then the complainant can seek leave of the court to institute a private prosecution. As of now, Kpegah has not taken any of the steps necessary to give him a standing to bring the action or institute a private prosecution. This alone is enough, in many jurisdictions, for the court to throw the case out. Now, for the allegation that Nana practised law without a licence, Kpegah should have simply, with supporting documents, asked the custodians of the register or the roll of lawyers, the General Legal Council (Council), to expunge his name from the register or roll. If the Council refused, then Kpegah could again go to court, not to sue Nana, but to seek writ of mandamus against the Council to do its work, that is, remove Nana's name from the register. In addition, Kpegah could ask the State to prosecute Nana for fraud. Third, people are asking Nana to produce his certificates, tell us who his classmates were, with one person, incredibly asking someone to come from the Middle Temple to identify Nana as one of their students. I hate to disappoint those who subscribe to this school of thought but Nana has nothing to prove; Kpegah made the allegations and he bears the burden of proof. Until he does that successfully, the onus does not shift to Nana to mount his defence. Besides, even if Nana were to produce the certificates, it would make no difference to his (Nana’s) distractors, as surely as it did not make any difference to Trump and his followers when Obama produced his birth certificate and even when the Hawaiian authorities stepped in to support the authenticity of the birth certificate. What I am saying is that some exercises are truly useless. Lastly, those who think I am supporting Nana or I am an NPP sympathiser, I wish to assure you that I am not driven by political expediency. I am a lawyer and I am driven by my professional ethics, objectivity, personal convictions and integrity. To me, nobody in Ghana, from the President down to whoever, is above the law. If Nana is practicing law without a licence, he should be removed from the register and barred from holding himself out as a lawyer and in addition be prosecuted. Indeed, I wish someone would have the courage and conviction to apply to strike out the names of the crooks and charlatans masquerading as lawyers from the register or roll of lawyer. My disagreement with Kpegah and his supporters is about the way he is going about this. While I have doubts about the merits of his case, I choose not to comment on that as I do not know the evidence he has. If Kpegah was genuinely interested in seeing that justice is done to Ghana and the integrity of the legal profession, and if he had asked me for my legal opinion this is what I would have told him. Submit all your evidence to the police, let them investigate and, in the exercise of their professional discretion and with the Attorney General’s Office, have Nana prosecuted. If Nana is convicted, that blows away all his (Nana’s) aspirations of ever becoming a President of the Republic of Ghana as convicted felons are barred by law from holding that office. Second with the conviction, Nana’s name will be automatically removed from the roll or register of lawyers, that is, he would no longer be able to practise law or call himself a lawyer. Ghanaians would forever be grateful to Kpegah for getting done something which no other Ghanaian has attempted to do, let alone do successfully. As it is, let us assume that Kpegah wins, what are the ramifications? He Kpegah gets no damages for his troubles, not having claimed any; Nana cannot be thrown in jail as this is not a criminal prosecution; Nana can still stand for the Presidency and those of us who believe that Kpegah was driven by politics could very well vote for him; the judgment/declaration that Kpegah receives will not be binding upon the General Legal Council (he has not sued the Council) and so the Council might very well decide not to remove Nana’s name from the register or rolls (they have already certified that Nana is a lawyer in good standing); and, much as supporters of Kpegah would not like to hear, Kpegah could be prosecuted for being an accessory to crime. This, therefore, begs the question why Kpegah chose to proceed this way? My personal sense is that win or lose the case does not appear to be Kpegah’s motive; his sole motive is only to embarrass Nana and that he has already succeeded in doing (at least in the eyes of the many supporters of the NDC who do not reason and assign anything into two camps, one for the NDC and the other for the NPP. And this is why, if I were advising Nana, I would strongly urge him to sue Kpegah if Kpegah loses the case.

I just think that you are not fully informed of the magnitude of the disgrace and effect on the many lawyers he Nana trained. You are also wrong that if Nana had produced his certificates people will still not believe him. Indeed some people would still not believe but the majority of the people would have even helped Nana including myself. Evidence of this is when Vice president Amisah was labelled with same allegations he produced his certificate and none talks about it now. I strongly believe there is some dark clouds around Nana's educational background which may be too serious or not too serious. In addition how sure are you that the police investigative committee are not involved? I will not call you an NPP supporter but I am not surprised of your claim that some people have tagged you as an NPP supporter.

You may very well be right, and I concede that, Nana would find it difficult to find a party which would accept him as a presidential material, but that is not the issue. What you do not understand is that in many countries, if Kpegah does not get a standing, that is beyond the flawed procedural route he has adopted, he would not get to argue the substance or merit of the case.

That is the whole point. Ghana is not yet at the point where the rule of law reigns supreme. Justice Kpegah is a seasoned lawyer. He knows going through the channels you have enumerated will mean death to his case at infancy. Not the police, nor attorney General's office can do a dame about it. Justice kpegah took the unconventional approach knowing well his bargain. There are many people who are just fraudsters in the system in Ghana. Even if Kpegah looses the case the onus now is on Nana to proof authenticity to the people he so badly want to rule.
