Killing of “spirit children” abolished in Upper East Region

The practice of killing children believed to possess spirits, has now been formerly abolished in seven communities of the Upper East region.

The chiefs, opinion leaders and people of the seven communities which are in the Kasena-Nankana East and West districts, have publicly announced the end of the spirit child phenomenon.

Myjoyonline.com published a report on April 1, 2011, on the chilling practice of cultural murder; the killing of babies who are born with deformities, or whose birth coincide with a tragic incident in the family, such as the loss of a parent.

In that report titled "SHOCKING!… Ritual baby killing
in Northern Ghana", Joy News Seth Kwame Boateng visited the “Sirigu” orphanage to uncover the chilling practice of cultural murder; the killing of babies who are deformed at birth.

The Seven communities, known to be practicing the killing of alleged spirit children, held a grand durbar on Saturday, to announce an end to the age old barbaric practice.

The declaration followed 12 years of intensive education against the practice, by Afrikids Ghana, a Child Rights Non-governmental Organisation.

Meanwhile, the 30 elders (concoction men), who brew poisonous liquid from local roots and herbs and force-feeds the alleged spirit children until they die, have been presented with four goats, a bicycle each, food items and have been registered under the National Health Insurance.

They are now to be called “Life Promoters” and have been tasked to promote the life of hitherto spirit children.

As part of the package, the former concoction men will be taken on a trip to schools in the communities to interact with pupils on specific issues affecting them.

Ofori Attah (Paa Willie) and many great political figures in Ghana have been at Nsawam Security Prison under similar political coercion. No one should therefore vilify Tsatsu under similar unfortunate attacks and persecution. If his crime is having being in Nsawam, then we can rightly surmise that Ofori Atta, J.B Danquah and the rest are criminals.

First, Tsatsu Tsikata is not a Dr. However, he certainly did not commit any crime nor stole any state money for his personal gain. It is simply mischievous libel or slander to claim so.

All that he did was acted as a quid pro quo surety for a loan for another firm, a cocoa growing venture Valley Farms, in which GNPC has interests, in order to generate financing to support its activities; besides getting some loans too. Unfortunately, GNPC wasn't much funded, forcing Tsatsu to resort to all kinds of short term activities not related to the core objectives of GNPC in order to raise funds to pursue the core objectives of GNPC. That was what earned him the accolade the "Wizard of Finance or Figures" or something like that; can't remember exactly. The firm defaulted and GNPC paid up and acquired more interest in the cocoa farm, said to be a viable venture. So in effect, GNPC did not incur any financial loss, since its shares in the farm could have been sold and the money realised. However, the Kufour regime, out to do in the NDC gurus and thus destroy the NDC, decided to bring a malicious charge of causing financial loss to the state against Tsatsu, for guaranteeing a loan which was not even half a million $s and without making any efforts to recover the amount from Valley Farms!

Considering the tens of millions of $s which have been lost under the NPP, due to sheer negligence (Tarzan's losses, e.g.), abrogation of legally binding contracts, etc., Kufour and his Ministers should be considered monstrous criminals, in whose shadow Tsatsu paled into insignificance.

It is interesting that they couldn't charge Tsatsu for the failed derivative deal running into several millions because Sam Jonah lost 20 times that amount under his own bad derivative deals which eventually forced the sale of the Ashanti Gold Fields to the S. Africans!

Ahoofe is just a jerk and I don't normally waste time reading him. In fact, I haven't even been wasting time following the unfolding circus in the Supreme Court. This rejoinder is therefore an exception.

Let the malicious fools here continue maligning and abusing Tsatsu but it is all hollow noise. He didn't steal any money from state coffers nor engaged in corrupt deals to enrich himself as those who support his detractors openly did!

Perhaps, this community college teacher missed Tsatsu's case at the time. The community college teacher needs to understand that Tsatsu's conviction was politically motivated. The man applied government funds in another sector and was convicted of the infamous law of causing financial loss to the state. We are aware of Tsatsu's initiative of trying other things for the nation to benefit which unfortunately was not approved by parliament. To say that he was a thief, is a long shot from the truth.
Tsatsu's achievements is on record. He is a brilliant lawyer, and of course an Oxford Graduate. I do think that the man has been humble...a hall mark of academia. Remember the saying..."empty barrels make the most noise"...perhaps, this community college teacher fits the adage? I don't know. Simply put, his politically motivated and manufactured criminal records have been expunged and wiped clean by JAK (who knew in his heart that Tsatsu did not belong to Jail).

Tsatsu Tsikata, first came into the national
spotlight when he got a first class law degree
at age 18 at the Law Faculty in the University
of Ghana, Legon. Later, after another first
class in Oxford University, the young and
brilliant lawyer, driven perhaps by his
avowed commitment to human rights, he
defended many prominent personalities such
as “Paa Willie”, Mr. William Ofori-Atta, and
Mr. Sammy Okudzeto when they were
detained during the Acheampong regime. He
was involved in a case brought for the
release of over 500 Ghanaians detained in
various prisons in the country for long
periods without trial. Tsatsu also represented
his cousin, Captain Kojo Tsikata, when he
was on trial for subversion before a military
tribunal during the Acheampong days. He is
also known to have championed the cause of
students in those days and represented
NUGS at an inquiry into a railway shooting
incident in which a student, Adjei-Barimah,
was tragically killed. It was again Tsatsu who,
in 1979 was counsel for the 32-year old, Flt.
Lt. Jerry John Rawlings, when he was on trial
for subversion at Burma Camp in Accra, by
the Supreme Military Council (SMC) regime
led by Gen. F. W. Akuffo, for attempting to
overthrow that government on May 15th that
year.
With Tsatsu's close association with Flt-Lt.
Rawlings, he got involved in the Provisional
National Defense Committee (PNDC) and
National Democratic Council (NDC)
governments. He became Chairman of the
Ghana National Petroleum Corporation
(GNPC) in February 1988 after Alhaji Iddrisu
Mahama, the first Board Chairman, ended
his term. Later that year Tsatsu also became
the corporation's Acting Chief Executive
Officer (CEO). In 1995, he was made the
substantive Chief Executive, with a new
board chairman, Dr. J.L.S. Abbey, being
appointed.
Constitutionality of Fast Track Court
Hell broke loose and the foundations of the
Kufuor-led NPP government were shaken
badly when Tsatsu Tsikata, brought before a
Fast Track Court presided over by Justice
Julius Ansah in February 2001, challenged the
constitutionality of the Court at the Supreme
Court. By a majority decision, the learned
judges of the Supreme Court declared the
Fast Track Court null and void. President
Kufuor, who was in far away Australia, was
quoted by his spokesperson then, Ms.
Elizabeth Ohene, as finding the Supreme
Court decision on the Fast Track Court
“strange”.
Nana Akufo-Addo, then Minister of Justice
and Attorney-General, who had arraigned
Tsatsu Tsikata, immediately announced at a
hurriedly organized press conference that he
was putting the accused person before the
“normal High Court” the next day while the
government pursues a review of the Supreme
Court decision. The normal High Court before
which Tsatsu was brought upheld a
preliminary objection by his counsel that as
the charge referred to acts by Tsatsu “in or
about February 1993” when the law under
which he was charged only came into force in
July 1993, the charge could not hold. The
court discharged Tsatsu but President Kufuor
remained determined to prosecute him.
The very weekend President Kufuor returned
to Ghana from Australia, two Police officers
were instructed to go to the Asbury Dunwell
Church at the Headquarters of the Methodist
Church in Accra to arrest Tsatsu Tsikata, who
was in church that Sunday morning
worshiping. They were however prevented by
a pastor of the church, Reverend Amoateng
and other members of the church who
pointed out that Tsatsu would come himself
to the police as he had always done
previously when requested to do so. Later
that day, a police public relations spokesman
put out a statement that the police did not
want Tsatsu.
Barely had President Kufuor touched down
from Australia when the then Minister for
Information and Presidential Affairs, Mr. Jake
Obetsebi-Lamptey, issued a press statement
in which he specifically said the President,
was nominating the late Mr. Justice Dixon
Kwame Afreh, a Court of Appeal judge who
was presiding over the Quality Grain trial to
the Supreme Court, for the review of the
illegality of the Fast Track High Court.
In addition to the late Justice Afreh, who
before his appointment had been assigned to
hear the Quality Grain case at the Fast Track
High Court, Mr. Justice George Lamptey, a
Supreme Court judge who had been receiving
medical treatment abroad was also brought
onto the review panel by Chief Justice
Wiredu.
As expected, the two new judges on the
panel, Justice Afreh and Justice Lamptey,
joined the minority to reverse the Supreme
Court's earlier decision and the Fast Track
Court became legal, but now referred to as
the Fast Track High Court.
Reports of the African Peer Review
Mechanism, (APRM) has described the
appointment of Justice Afreh as a clear
manipulation by the government of the 1992
Constitution, which does not provide a ceiling
on the number of Supreme Court judges that
can be appointed by the President, to
achieve an avowed objective.
Interesting Background Bits
The illegality around the Fast Track High
Court had been reviewed, and the
government's long-awaited trial commenced
in earnest. Some interesting background
things which have not caught the attention of
most people are:
Papa Owusu-Ankomah, Nii Ayikoi Otoo,
Ministers of Justice and Attorney-Generals,
who were later involved in the case after
Nana Akufo-Addo, as well as Ambrose Dery
and Gloria Akuffo, Deputies in the Ministry,
and the current Attorney-General, Joe
Ghartey, were all once Tsatsu Tsikata's
students at the Faculty of Law, University of
Ghana. Ms. Gertrude Aikins, Chief State
Attorney of the Department of Public
Prosecutions, who has also recently been
involved in the case, was also a student of
Tsatsu Tsikata.
Tsatsu's uncle, a former Chief Justice, the late
Justice Apaloo, when he started his law
practice prior to joining the bench, practiced
at the chambers in Accra of the father of
Nana Akufo-Addo, Mr. Edward Akufo-Addo
who was also a former Chief Justice of
Ghana.
Tsatsu and Nana Akufo-Addo represented the
plaintiff in the well-known case of Amoako-
Tufuor v. the Attorney-General before the
Supreme Court in 1980 which prevented
Justice Apaloo from losing the position of
Chief Justice when the Limann Administration
came to power.
Tsatsu was arraigned before a judge Mrs.
Henrietta Abban, who was Tsatsu's senior in
the 1960's at the University of Ghana, Legon
Law Faculty. Mr. Osafo Sampong, who was
the DPP until he was retired last year and
who mostly handled the case for the
prosecution, was also Tsatsu's senior in the
Law Faculty.
Professor E.V.O Dankwa, lead counsel for
Tsatsu Tsikata, was his classmate in Legon
and joined him in Oxford where they both
did postgraduate studies. Professor Dankwa
went on to do his doctorate degree at Yale
University in the US.
They both for many years taught at the
University of Ghana, Faculty of Law. Major
(Rtd) Agbenoto, junior counsel for Tsatsu,
was also taught by Professor Dankwa and
Tsatsu.
The trial, which has been to and fro the
Court of Appeal and the Supreme Court, at
various stages, had already been before
three courts -a Circuit tribunal, another Fast
Track Court and a normal High Court before
which the prosecution even filed some new
charges by the time the accused was
discharged.
