Now people watching and listening to the proceedings in court have been reminded that, President Mahama and some Northern Chiefs put pressure on the Electoral Commissioner to allow some people to vote in Northern Regions and the rest of the country who were not qualified to vote and this is for what? That NDC did not do anything wrong? This is a case of pointing one finger at your opponent when two of them are pointing to yourself. We now know that, Mahama and the EC colluded and agreed to allow people to vote without being verified all thanks to the 'genius' of a lawyer Tsatsu."

Where in the CI or the Constitution does it expressly say that any non biometric vote will be annulled? What does C1 75 Sec 37(1) give as grounds for invalidating a ballot paper? Where in the regulations does it say that a vote not verified by biometric process would be ILLEGAL and should not be counted.

"CI 75 Sec 30(2) requires that the voter shall go through a biometric verification process."

The law makes excemption for some people to go through voting without Biometric verification and these people were captured on the registration roles who numbered just 3,196. These are people who have lost a limb or due to special circumstances cannot go through Biometric registration.

The EC made it clear nobody apart from these special people should be allowed to vote without Biometric registration and there were two polling stations in Northern Region where the voting were annulled because two people were allowed to vote who did not go through Biometric registration.

Tell me the reason why the EC will annul some voting in some polling stations because others voted without being verified but is accepting the votes of more than half a million where the votes were tainted because others voted without being verified?

When the CI 75 was passed, no individual or institution challenged it as in conflict of the constitution and therefore should be voided or nullified. CI 75 can pass the test of time.

General Secretary of the People’s National Convention Bernard Mornah has won a writ he filed at the Supreme Court seeking to nullify portions of the Constitutional Instrument 74.

Rule 71B of C.I. 74 provides that the decision of the Supreme Court in respect of a petition presented to challenge the election of a President cannot be reviewed.

But lawyers for Mr Mornah argued that "To the extent that Rule 71B of C.I. 74 seeks to extinguish the constitutional right in article 133 of the Constitution to seek a review of a decision of the Supreme Court in Presidential election petitions, same is unconstitutional, null and void, and of no effect.

The five member panel which sat on the matter today upheld the lawyers’ argument. It also ruled that the Supreme Court sitting on public holidays will be unconstitutional.

Mr Mornah had also challenged Rule 69C (5) of the CI.I.74 which stipulated “the Court shall sit from day to day, including public holidays" when hearing a Presidential election petition”. His argument was that it violates the Public Holidays Act.

The Supreme Court also ruled that it was unconstitutional to sit on holidays and further declared that Article 71B and Constitutional Instrument (CI) 71 and 65, are unconstitutional.

Lets get this straight, know that there is diffence between voting without the biometric verification machine and voting without biometric verification. As the name implies bio means life and metric stands for measurement. So if ones visits the CI 75, it is clear that one must go throgh the biometric process, which includes one's name in the voter register, Vote's ID card, physically present at poling station before 5pm or by proxy on voting day and of course the verication by the biometric machine, before one casts a vote. Any attribute such DNA, Skin colour,hair colour, pupil colour, height which is unigue to a person are part of his bio-dataIt. That is why in previous voting persons were allowed to vote if they could be identified by 5 persons in the constituency. The persons can only use your bio-data to identify you nothing more nothing less. Ii is therefore commonsense that all the attributes mentioned above constitutes the biometric process so it will be a wild goose chase to annulify a vote just because the voter didnot go through the biometric machine through no fault of his/her. The onus lies with the CE not the voter so the the law books must be examine to punish the EC,accordingly, not the voter who fullfilled his/her part of the contract. It is methematically impossible to determine the number of persons who voted without the verification machine when relying on the pink sheets alone as there is no telemetric correllation between the two. Another difficulty is that the biometric verification machine operates on cummulative bases, which means that should the machine be used to detect the same name twice it will count the same name as 2 and not one. So excessive relies on the biometric verification macine mifgt provide figures which might not necessary tally wiht the hard copy. The import of the machine is not to give the finall vote count but authenticate the finger print as captured at the time of registration to at least give the assurance that the person preparing to vote was the same person who registered. The Supreme court needs a measurement expert or an instrumentalist to confirm this point. Bye and Thanks for sharing my thoughts

Really? How come the EC threw two polling stations votes away because two people voted at these polling stations.
"CI 75 Sec 30(2) requires that the voter shall go through a biometric verification process."

The law states that, everybody who has not lost his or her limbs has to go through Biometric verification process before allowing to vote or the person should not be allowed to vote. The law is clear and the EC Commissioner made it clear that violating that policy will nullify(annulify?) that polling station votes so what is the problem here?

If there was no law by the Electoral Commissioner barring people from voting if they failed Biometric verification machine process, why was President Mahama 'sweating' the Electoral Commissioner to break the law and allow people to vote?

I don't see any voter being at the Supreme Court but the EC and the people who benefitted from the irregularities so I don't know what you are talking about here. The voter is not being punished, the EC is being asked to explain what happened.

That is why the EC said that, wherever a voter is allowed to vote without going through the Biometric verification machine, the votes where he voted should not be counted since all those votes have been tainted. 1. Why did he allow Bawumiah to read the myjoyonline news exhibit about President MAHAMA appealing to Safari GYAN to allow people to vote without going through the Biometrics verification? That was really dumb on his part.

2. Why did Tsatsu ask a question about IC and then argue with Bawumiah a about what the IC is when it came out he Tsatsu didn't know what the IC is supposed to do.

3. Why will Tsatsu ask Bawumiah about his opinion? What kind of a lawyer cross examining a Witness ask him about his opinion and giving him the chance to explain and make statements? A defence lawyer if possible should demand YES or NO answer from a Witness or short answers without giving them chances to explain their answers.

If you think I am not being truthful, go and discuss these three issues with a lawyer and see the mistakes the NDC lawyers are making.

The role of our constitution is to limit the power of the government,to protect the rule of law and finally to defend the citizen's fundamental rights.A good cross examination in a constitutional case must have to address all these issues. Tsatsu is taking Bawunia through these drills.What is noticeable here is that the third strand which deals with fundamental right is sacrosanct and protected by the constitution.Any secondary legislation is therefore subordinate it as the enabling authority so when there conflict between a secondary legislation and the constitution, the constitution prevails.CI 75 will therefore fail when it comes under the test of scrutiny.Already some of these unconstitutional legislations are falling by the way side. Sitting every day including holidays now abolished by the judges as unconstitutional.The petition can now be appealed against because it was in breach of natural justice which insists on the right of appeal when a decision is given against you.The next to fall will be CI 75 because it is clearly unconstitutional and the ec was wrong to make it a secondary legislation.

The whole basis of the petition which is taking a severe battling rest on this legislation but I can assure you it will not stand the litmus test of legal scrutiny.This is my observation and i speak as some one who knows and understand the law better then you.Let me repeat here that if you want a debate lets have a genuine one devoid of insult which is becoming your trade mark.

If you are following the petition in the sc,the respondents are saying that no one voted without the biometric id.They claim under the rules every body went through the biometric process.That argument is a matter of law which will by decided the sc.My take is that to comply with the rules,they will rule that there are other ways other than the finger recognition which complies with barometric recognition.There will be agreement on some irregularities but that will be seen as human errors and Mahama will complete hie term of office.

I still believe if the CI 75 is declared null and void, it will make the 2012 election an illegal one and a new election conducted but first somebody has to challenge CI 75 in court.

What he sought to do was rather to demolish the accusation of the Petitioners.
What he has sought to prove to the court is that the president was only echoeing the demands of the affected people. As president, it was his duty to defend the constitution in accordance with the oath of office. Note the constitution as emphasised by previous Sc decisions frowns upon the disenfrachising of citizens with a right to vote in this manner.
You appear not to appreciate the sanctity of the right to vote as postulated by the constitution and which the supreme court has upheld in decided cases. It is that position of the constitution that the president sought to defend.
Tsatsu could be said to have punched a hole in the Petioners accusation on the other hand

How can you call for the annulment of votes in Greater ACCRA when those in the Ashanti region have similar irregularities and your so-called over voting? Your arguments in court are biased! You are disputing only areas you lost but not the ones you won. Where is the fairness? The EC declared you winners in certain areas for both the parliamentary and presidential elections so dispute those areas too as being rigged. Fake pink sheets and forged evidence is what you have and by the way the burden of proof is on the NPP.
