Mr Blankson, though I only listened to the second session of yesterday's hearing, my view is that it is too early to assess Asiedu Nketia's performance as the key witness for the first and second respondents. Again, comparison with Bawumia is also premature. Remember, he is giving evidence in chief. That is very easy because he would have been taken through the process by his own Counsel and coached how to respond to questions posed to him. In other words, he knows the questions in advance and possibly the answers or what to say.

The real hard work comes when he is under cross examination by lead Counsel for the petitioners. That is when it would be appropriate to assess his performance and to do comparative analysis with Bawumia, which I am keenly waiting for.

More so,he defines over voting in a simplistic way with a powerful legal connotation.He said the phrase over voting had come to be accepted and recognized by all as the number of votes castes exceeding the number of registered voters at a polling station.Customary law which is part of our constitution,recognizes a norm that had been accepted by the general population as a binding law.It is a principle in law that when a certain legal practice is observed and the relevant actors consider it to be law (opinio juris) then it stands.Asiedu's definition is what every reasonable Ghanaian will say is the definition of over voting.
