Kofi, the mere fact that we have this stupid petition tells the story of indiscipline in the Ghanaian system. The judiciary, the executive, the bureacracy all all corrupt.
The same reason--why Nana has not produced his certificate--and the Legal counsel has not provided any legitimate exaplantion for the loss of Akuffo Addo's cert.
Can you imagine a presidential candidate stating all die-be-die, and openly fondling some one's wife?
The arrogance, indiscipline is all over. What about the Chief Justice getting a sweet heart land deal? Is it that conflict of interest?

Just imagine Afari-Gyan stating not a single soul voted abroad! Contrast this to the huge figure NPP threw around in their package of falsehood to stir agitation from its supporters?
Akufo Addo is just getting a poke in the flanks for listening to guys like Bawumia, Jake and Sir John. He would go down very shamefully as a leader who contested electoral outcomes in court without knowing anything about the case.
NPP will have a hard time next time with elections in Ghana.

Your observation is quite accurate. It seems there is a culture of disrespect in the very system that should be a cradle of respect. I think this is another issue where our cultural practices of respect to adults should not have been thrown away by just observing a culture we do not fully understand. Yes in the UK courts there have well planned measures to deal with such intransigents.
The problem with Ghana is not because the rules are not there, it is just because the senior judges refuse to use the whips because of reprisals and sometimes because of their own history. Imagine Addision, Lithur or Tsikata becoming judges with this level of disrespect to the bench from them.
My second point is that, Counsel Addision has taken an aggressive position towards the other counsels unlike the lawyer you met in the Uk case who treated you with respect and so encouraged you to take a much more interest in the UK legal system. I don't blame Addision because he seems to have been pitched in a battle against three frontiers and he has no option but to attack without consideration and that seems to bring negative response from the other sides as well. I think, so far, the counsel for the EC has behaved well but time will tell.
This is all good because, if nothing at all, it brings to light the issues impeding justices in our courts and like the great proverb says, to know the cure or medicine for a sickness, one has to know first of all, what that illness is.
You raised the issue of keeping records and count of documents and this also highlights an issue that is dear to my heart-details. Ghanaians like to excessively elaborate without really paying attention to details. Our registry institutions, such as, Country Planning, Lands Commission, Birth and Death Records Dept are all in chaos and need urgent addressing. If we are to succeed in this Age of Data management, we need to address this issue of details.
I have left you a comment on your previous article and will like to hear your response to that.
Have a fun.

BRAVEBOY, thanks for the positive contribution. I do read all comments left by readers of my articles, except that sometimes I am unable to comment on all of them. I agree with you regrading the subject of respect in Ghana and it's a challenge for the country to begin to respect the institutions in order to strengthen them.
Yo are absolutely right with records keeping which is another big problem for most African countries. Records are not properly kept in Ghana and even when they are kept, corrupt officials and the public are able to defraud the system. It's a matter of money, who you know and one could get any record of a document supplied illegally in Ghana.

MASSA KOFI, if anything at all, this piece reflects the incompetence and weakness of the Supreme Court for allowing the proceedings to become theatrical with such misbehaviours. Sorry to say, this is what happens when 'lunatics take charge of the asylum.' The Supreme Court judges led by Justice Atuguba, virtually tolerated some of the misbehaviours instead of getting a firm grip of the proceedings. I blame the SC judges for this 'Great Political Theatre' we're watching due to their incompetence, weakness and unconscious political bias!
In any competent and efficient court of law, all the lawyers and witnesses of both NDC, NPP and the EC could have been charged with 'contempt in the face of the court' with their total disrespect, tantrums and intimidatory attitude during the proceedings. The actions and misbehaviour of all the interested parties undermine the authority and dignity of the court and the individual judges conducting the proceedings.

Personally, I don't think any of the players in this drama has comported themselves well, probably with the exception of Mr Idun. From the lead counsel of the petitioners to counsels of the respondents, the witnesses and to the judges have all fallen short a little, and I wonder why the writer seems to be pointing his anger heavily towards Tsikata and Tony Lithur.

If anything this case seems to reveal everyday, the lapses in our Ghanaian system across the board. There is a need to learn lessons and review the way we do business but will they do it? There is sometimes this notion that - "this is how we do things here whether you like it or not"!! which is too bad.
I think the justices should have unanimously put all parties in check from the word go. The fact that the bench seemed to even have disagreements or that he chair had to do most of the admonishing appeared to put him in a bad light to some but I feel he was not helped by his colleagues on too many occasions.
I used to think that discipline was a key word and feature of the law especially at the highest court but apparently not in Ghana by this showing!

Kofi, what's your take on the open confrotation by the lead councel fofr the petitioners with the presiding judge in which he accused the bench of curtailing their evidence. You have conveniently ignored that in your discussion and asking only the lead councils for the first and third respondents to apologise to the bench. The lead councel for the pertitioners must equally apologise.

If you talk of uncouth behavior then come down heavily on Addison. At one time one of the Judges said to him if this the way you behave here ,what about the lower courts. To ask a Judge in a stern voice whether a ruling was unanimous and telling a fellow counsel that he is a pot calling the kettle black and that it is a bit rich of him can not be ignored. In a high tempered case like this where the stakes are high you expect some of this occasional outburst unless it is completely out of control like the Addison's I don't there is cause for alarm.Personally I have seen lots of disagreements between lawyers and and lawyers and judges in the UK some times raising high tensions in the courts.

Saka, I thought I indicated in the article that so far it's only lead counsel for the second respondent (Mr Quarshie Idun) who has behaved well. That means Addison has also been part of the disrespect towards his colleagues or the bench. Was it because I did not give specific example of his sins that you assumed I ignored his behaviour? I do not play the NDC/NPP game of equalisation.
