EC was asked to present its affidavit and it failed to do so at the appropriate time. So, it was in order to raise the objection that was rightly sustained by the judges. How can you try to spring a surprise with a questionable document? Didn't the EC go through the petition? It was all there in black and white, why did they fail to respond to that at the appropriate time?

The point you are making, that the petitioners' lawyers are trying to run away from the counter-evidence which could have exposed them badly, will not be lost on the judges.

How long does it take to print a document stored on your computer.you will only spend more time when you want to audit or change some format.The same thing applies to this Biometric Verification Machine(BVM).The data was readily available on the machine as soon as the last vote was cast.Why does it take the EC several weeks or months to print document already stored on the machine?The same EC has all the original pink sheets readily available,but they decided never to file a single pink sheet with their affidavit to expose the EC since they could not audit or alter it to suit their claim.So they took their time to programme the BVD before printing the altered data to court.Very Funny.Let's be realistic,come-on guys.
