  Judges in Ghana behave as if the constitution does not guarantee separation of powers. Our judges are either corrupt of spineless. Judges in this country of are clueless. They also don't care about their legacy. Their cowardice is understandable, considering the fact that three prominent judges were abducted from their homes and summarily executed on the orders of Mr. Rawlings.

They should have good reason for assuming jurisdiction. Probably they were influenced by the fact that martin still has ajurisdictional remedy ie the High Courts.All public interest cases to the supreme court may open flood gates and subversive of the constitution both in letter and spirit

  It is constitutional issue. The writer was clearly pleading with the cowards at the SC "adopt a more purposeful approach to dealing with issues involving the national interest without recourse to laborious technicalities." The SC has jurisdiction over all issues raised by Amidu in his petition.

  once the supreme court ruled that there was no contract between Waterville and the state one can infer that any claims made under the cloak of such contract cannot stand. we can infer the obvious outcome of the Wayome case

  I have not taken a look at the judgment but I have read bits and pieces.I don't know whether the intent of Amidu is to by bass the established judicial process to achieve his ends and the SC was right to decline jurisdiction on some the remedies sought.If the writer presumes that defects in the sc procedural rules will benefit Ghana,he is lying.My understanding is that there was a constitutional interpretation which resulted in the sc decision.The question of jurisdiction and the constitution was interpreted by the sc to mean that the foreign company did not have the approval of parliament to give the contract its legitimacy.So on this technicality the sc decided that the contract signed by the then npp government was invalid.What the sc did not made clear was the argument that the contract was awarded to a local company who in turn subcontracted it to a foreign company.In this case there is a decision based on technicality as to whether is is a local contract or a foreign contract.I am sure we haven't seen the last of it if we should determine it as a foreign contract. The international company will appeal against the sc decision at the international court of arbitration to see whether the rules have been properly followed.Lets wait and see.
