In a civilized Nations, one is not called verbally to come and defend himself in court and supreme court judges don't have a right to charge someone without a proper protocol.

I admire your courage and I hope people will learn from. It takes one person to bring a change.

I reserve the right as a citizen of Ghana to protect and defend my honour and integrity should this civilized challenge for the truth be ignored.

This is not the price I should be made to pay by the Government of Ghana for defending the Constitution of Ghana in the Waterville and Isofoton unconstitutional payments declared by the Supreme Court.

The writer and others in the media should also note that the Fourth Estate is not a god and that there are limits to freedom of speech.There's no freedom that's absolute and unlimited.

To curtail outside interference in its deliberations,the US Supreme Court refuses to allow live coverage - and that in yours truly's opinion,is a wise decision.As it stands now in Ghana,every dumbass politician or journalist is disrespecting the Court,and even insulting the judges as they perform their duties.

There's nothing wrong with criticizing a ruling by the Court,but what Awuku did was wrong and he deserves what he got.It was about time and hopefully, others will learn a lesson.

How do you defend yourself without being properly charged with a crime? Take ken Kurachie's case, Atuguba said he needs to come and defend or explain to him what he wrote on the front page. What kind of stupidity is that? Only one article on the front page? And what part of the article he should come and explain it to him?

Frank, GOLD COAST may be right. With the except of one, all the case laws cited by the author were comments made after judgement. What my good friend Prof Asare has also failed to consider are the words ("in good faith"). Criticisms of court or judges whether before, during or after a case must be in good faith. That was in all the cases that Prof Asare cited. Can Prof Asare say that the cases in question in Ghana, these people made the criticisms or comments in good faith? The answer is absolute, no. They all have partisan and even personal interests in the case. For example, Sammy Awuku stands to benefit personally if the petition is upheld (by the potential to become a minister in an Akufo-Addo government).

Again, Asare has also failed to take into consideration, the potential for these comments and criticisms to cause people to lose trust and confidence in the Justices and the judiciary in general. Such a situation could make the losing party not to accept the outcome due to such irresponsible comments and criticisms and subsequently cause confusion or even conflict in Ghana.

Last but not the least, freedom of expression is not absolute as is being suggested, though it must be restricted in very limited instances for the public good.

For the above reasons but not exclusively, I do not share the views of Prof Asare. However, I agree with him that instant justice is in itself is injustice and therefore if the SC believes that these people committed the offence or crime of contempt of court, then the due process must be followed by committing them to a trial where they will have the right of representation and defence but not sentenced without trial as has happened to Awuku.

When you have a different opinion, you state what you disagree as well as what in your view, should be the case, rather than insult others.

I think a lot of them forget that the societies didn't come about out of a vacuum but through the efforts of the enlightened classes. The framers of the American constitution to this day can be credited with a lot of wisdom and make it so difficult to amend their constitution because it is generally accepted that they got it right on foresight in entrenching the rights of the individual(the favourite philosopher and mine too Thomas Paine. Juxatapose this with our constitution which could not predict that swearing a president in whilst still judging their validity is counter-intuitive. The US framers were highly suspicious of 'power' loking at the conduct of the British monarch at the time but ours were not even though we had a background of being beset with authoritarian and tyrannical governments. You would expect our constitution would not be so soft on the exercise of 'power' given our past before 1992.

Secondly, you neglect to mention that he also referred to the Jusctices as hypocritical and that is definitely contemptuous. You see, i'm a champion for freedom of speech and expression but I have also maintained that " my right, liberty or freedom to swing my arms ends where another man's nose begins". we cannot say people should go around instigating the already pent-up feelings of anger and emotions within some sections of the public in the name of freedom of speech. Kenya totally overlooked this and the result as you and I know was BLOODSHED and it will be very irresponsible for the Justices of the Supreme court of Ghana allow the same to happen.Needless to say that stern warnings came from the bench on innumerable occasions and even the slate cleaned severally but yet the stubborn, arrogant and recalcitrant ones across the divide (NPP and NDC) wouldn't heed. what would you do, if you were in the Judges Shoes?

Does he think that he knows more and better than the lawyers? He is just somebody who studied industrial law and not fit to comment on the actions of the Supreme Court judges from the perspective of the law. Such a vain attention seeker will be dealt with.

Therefore, justices do not need to skip following the media. They only need to restrain themselves and as you suggest, provide alternative sources of information to counter-balance the free exercise of speech by citizens and a free media.

However, we know that persons in the employment of the government/people, generally do not have the same free speech rights.

After having endured civilian and military dictatorships for the best of thirty years we can hardly accept judicial tyrany. Ironically the judiciary that is supposed to protect us against summary and arbitrary justice is actively engaged in it. It is an aberation. Even worse is the ignorance of Ghanaians who think criticizing the judiciary is wrong and punishable and that include so-called senior journalists. Our freedom of expression, however, repulsive, cannot be arbitrarily adjudicated. Not even by the people's Supreme Court.

The common law is often the starting point for determining what constitutes a contempt, and case law has established the powers of courts to deal with contempt.Contempt is therefore determined by case law as a shield to protect prejudicial court reportage and unguided utterances whilst the proceedings of the court is on.It also to protect the public interest to ensure that the proceeding is not used to cause public dissatisfaction.

It is rightly established at common law to safeguard the court from acts or omission calculated to interfere with the administration of justice from sinister agenda.Its therefore behooves all informed Ghanaians to to be objective when it comes to matters concerning the integrity and dignity of such important arm of state if the rule of law is to be protected.

We all acknowledge that rights have consequences and that they therefore come with responsibilities.Freedom of expression unlike the right for a fair trial is qualified and therefore not absolute.Asasre's attempt to give that impression is disingenuous of him.

The procedural rules of the courts in Ghana determines how contempt of court proceedings are to be addressed.The SC has the right to hear summarily contempt of court cases emanating from its proceedings unless the contemnor wants to be heard by another judge but these rules remain exclusive to the SC.

Asare's petition and the numerous cases he cited are mostly out of jurisdiction. these citations are not binding on our jurisdiction but just persuasive.To cite them as if these are binding authorities is another example of this writers woeful misunderstanding of the issues.

This forum has become a harpy hunting ground for his vexatious articles mostly criticizing Justice Atuguda whom he always posts on the SIL as a bias and incompetent judge and I am afraid he is becoming a meddlesome busy body and crank on this forum.Kwaku Asare is intellectually dishonest and dangerous

If one has reason to feel that the SC is being biased, be that person right or wrong, doesn't he/she have the right to say it? It is better to encourage Sammy Awuku to give reasons for his statement and that such would help to make some corrections, rather than ridiculing and putting fear in him.
The SC's actions against him are tantamount to denying him of his constitutional and democratic rights, and his rights as someone living in a "civilised" country. Do you agree that it could extend to others if not checked?
That the judges saw Samuel Awuku's comments contemptuous paints a grim picture of Ghana's so-called democracy.
In fact we are worried that the judges are now behaving like village tyrants and witch hunters.
Of course, Ghanaians (must) respect them and their work but that does not mean that they are above the law or can act with impunity.
We hope that they would reassess their obligations and responsibilities, and act in accordance, for the progress of Ghana.
