Ghanaians remember the regime which stripped people of their properties, destroyed families and killed in the name of corruption eradication. Today, they have been found out by EOCO and the Sole Commissioner to have deliberately connived to steal millions from the State. The Supreme Court has confirmed the stealing, labelling it as an alliance to create, loot and share.

Rather than deal decisively with such gargantuan and mind boggling impunity and corruption, the President chooses to join his communication foot-soldier chorus.

If you do not respect the supreme Court of the land then what other institution would you respect?It is time to draw a line in the sand to avoid anarchy.Freedom comes with responsibility and at this particular period of high political tension in the country,i personally reckon we allow the Supreme Court to lead and bring sanity into our political debates.We sort of take too much things for granted,we have a whole bunch of weirdos who can turn the nation upside down just by using an offensive statement against another group.In the US,where you reside,they are educated and there are no tribal lines in their politics as compared to Ghana.Those living abroad should be careful as they always try to directly compare,it does not work that way.All we need is sanity in our political discourse and i support the Supreme Court to apply the law to avoid unnecessary bloodshed.

The Supreme Court has come under intense scrutiny these past few months. The criticisms fall on the shoulders of the presiding justice ATUGUBA. In my opinion he deserves the blame. It all began when Tsatsu Tsikata told Addison to "shut up" in open court. That was a HUGE affront to the dignity of the court. It went with no reprimand nor was he asked to apologize. Next came Tony Lithur who threw documents on the floor. Again, Atuguba joked about ships jettisoning cargo. These actions were very very serious to merit reprimands if not expulsion from court. I dare say that as a presiding justice he Atuguba does have some modicum of authority over the other 8 justices. I also dare say that Atuguba, out of BIAS in favor of the NDC did not take action. He even yelled at one time to Addison to SIT DOWN. Atuguba will in the end be hoist on his own petard and be stewed in his own juice. Like someone wrote last week. Atuguba is a disgrace to the judiciary!!!!!

The way and manner sympathisers of NPP are critising Atuguba paves the way for the rejection of any verdict in favour of the NDC. Nor will NDC accept any verdict in favour of the former. So in this case what should the SC do? Drag on until the 4 years are over and new elections are organised. In fact, the SC is in a dilemma and their best bet is to drag on. How on earth can people be saying that anybody can say anything with impunity, all in the name of freedom of speech? Does freedom of speech exclude common sense? When people are saying the presiding judge is bias, will they accept any unfavourable verdict from the same man? Why are people refusing to realise the harm those criticisms are causing?

Even before the whistle was blown to start the hearings,did we all not see how the petitioner`s legal team attempted to shunt Justice Atuguba aside,and how this effort failed miserably?
I was one of those who urged Justice Atubuga to conduct the hearings with a big stick,but I am glad he did`nt, because had he done that, you and others would have staged demonstrations around the globe to have him removed. Look, this plan to villify Justice Atuguba as though he is running a one-man show is not going to get the desired results,thanks to live TV coverage.

In my comment to what ECONOMI wrote,I exopessed my displeasure with Justice Atubuga`s style, and thus did not have to engage in any point-counter-point exercise of apportionig blame or finding fault. That is the mark of 'infants' who always insist on cateloguing every conceivable perceived faults of others in any given disagreement. Adults should endeavour to outgrow this business of he/she hit-me-first, or insulted-me-first attitude,that is not to going to help restore peace and civility within the family.
Btw, you forgot to include the charge that he he tried to 'gag' a colleague on the bench. You can list all the perceived 'transgressions' of the Presiding Judge, but nobody has addressed my question as to whether Justice Atuguba is a one-man demolition crew who has deliberately set out to derail an otherwise "solid" case that has been presented by the petitioners? When this question is fully addressed, we will all realize that this baselees campaign to paint Justice Atuguba as a'bogeyman' will not help the petitioners and their supporters!

All the questions have nothing to do with the other 8 judges...unless in your warped mind, you think when he told another lawyer to be quiet and sit down, he had to consult the other judges or when she told Bawumia to bring his mind to the courtroom, he consulted his peers. Are you OK up there?

As an independent thinker, I will read and debate on issues. Where I found it necessary to challenge any opinion from the author, I will argue against that and debunk that, but will support those that I agree with. What you are doing is not independent thinking. To you, you want us to lay prostate for anyone and swallow everything hook, line and sinker.-- that is a mark of cowardness and defeatism. His outburst at the beginning of the hearing when the NPP raised their suspicions was a dead give away. And really as bad as all the others have been he is in a class of his own, and if I can borrow his own parlance, he is of a different 'size' compared to the others. I am so disappointed in these judges,I feel troubled that they could not command respect so had to demand it.The general disapproval from reasonable minds says it all. Atuguba needn't be made a bogeyman by the NPP zealots as that would be putting it mildly, he has earned a name in the book of infamy! A pathetic excuse for a judge in a democracy.

For you to suggest that the Supreme court is "suppressing the democratic right to freedom of speech and expression" is most disingenuous go say the least.

It is also a great pity that an intellectual of your stature would stoop so low as to create the impression to readers that somehow, "Justice Atuguba and a small gang at the supreme court" are taking "undemocratic decisions" in respect of same. This is so blatantly untrue that you give yourself up even more biased than those you accuse of such an 'offence'. I am sure you are well aware that decisions of the court are WHOLLY democratic and often we are even told the VOTE when the supreme justices retire into their chambers to deliberate on, and take a decision on any matters.

This is something we all expect and in this particular case of the petition, it has clearly been demonstrated throughout the process. Pronouncements by the chair of the panel Atuguba (or any other member of the nine member panel) is therefore a decision of the court and not ANY ONE INDIVIDUAL or a "small gang£ as you put it. Your own impressions here are contemptuous and most disrespectful of the very court you are hoping would RULE in favour of those YOU Lungu rather prefer to win the case - the NPP petitioners.

I hope that your own supporters would see through your bias and dishonesty in this posting. In the past you have pretended to be analytical of issues, but on this occasion, it is crystal clear how your vision and intellect have been clouded by your partisanship.

For most neutrals who only wish to see due process, respect for the highest court of the land and their proper execution of their duty in the interest of our democracy, it is most worrying when people who are 'lettered' like you, seek to twist fundamental issues for your own parochial interests.

Coming back to Dr Bokor's posting which was published yesterday on Ghanaweb, I thought he was right in his general impressions, although I would have preferred that he also spent some time admonishing people including the president who in my view should not even comment publicly about the case, however 'privately confident' he or his surrogates may feel about their chances in this petition. I have indeed condemned the utterances purported to have been made by the president in this regard and have also been critical of others such as Asiedu Nketiah, Atubiga and the like.

If you claim that you want to see democracy grow and thrive in Ghana and your party wishes to run the country, I continue to wonder just how you hope to achieve this and take the country along with you if you continue along this path of clearly partisan bias, blatant disregard for the truth and your continued efforts to 'mislead' readers!!! Why can we not examine issues fairly (even if we have a particular leaning) for the sake of our country and our ONE PEOPLE?

How do you expect me (and millions of other Ghanaians in the neutral 20%) to regard you if you continue along this dangerous inward-looking path which does us all no favours? Would you expect me to attend a meeting of 'Ghanaians e.g. in Washington or New York knowing that I will be sharing a platform and a drink with people such as yourself who may think that somehow you are different from me?

And how does your party hope to develop Ghana if this is how the intellectuals within that party such as yourself think and act? It is indeed a sad indictment of our decades old partisan culture which continues to blind people like you.

In Kofi Annan's recent article calling for us to "go back to Nkrumah's aspirations", I believe he was not making the call because he was an "Nkrumaist" or a member of the CPP, but rather upon decades of sober reflection, and having been in global leadership himself and learning how tough it is to deal with all the powers that be. He has also dealt with leaders from all over the world and has direct access to every single one of them. Over the years, he has probably analysed the situation in Ghana and realised that despite all Nkrumah's FAULTS AND FAILINGS (like most of us humans), he had aspirations which come to think of it, most political and national leaders also have (and some share). ?Therefore, irrespective of our party affiliations, our nation is far greater, and indeed more important than our individual selves and our interests. We cannot hope to develop at a reasonable pace if we cannot operate together as ONE NATION despite our political differences.

It is such a pity that people like you and I who should be using our fortunate position (yes, I know we worked really hard to merit our accolades) to educate, encourage, challenge and motivate our fellow Ghanaians and Africans to emancipate ourselves and improve our people, rather spend time arguing with each other and spewing out garbage which does no one any good.

Your attack on the supreme justices is wrong, unfair and smacks of intellectual dishonesty. Your attack on Michael Bokor is equally unfounded and quite frankly a show-off on your part.

There are better ways of using your talent and this is not one of them. Either you change and start to think properly as a Ghanaian and African, or keep your cynicism and ridiculous, blinded partisan nonsense to yourself. Ghanaians are fed up with this kind of nonsense and simply want to get on with their lives and not be fed your brand of 'nationalism' and cynicism. Hiding in the USA to continue this line of communication does you no favours either.

Justice Atuguba must strive to be respected and not be feared.

Atuguba has successfully, through intimidation, deprived the petitioners of an effective lead counsel. Philip Addison has now been badly rendered ineffective by Atuguba's persistent snarling and screaming. Tsatsu Tsikata and Tony Lithur were allowed to shit and spit at Addison and the Bench without a murmur from Atuguba.

Look, Paul,how can the whole Supreme Court fear that the comment by that NPP activist will influence the reasoned judgement that is expected to come at the end of this hearing?

This ritual broadcasting of the names of potential contemnors to appear before the supreme court is reminiscent of the heady days of the AFRC in 1979 when citizens used to hang by the radio at 1 Oclock to listen for the dreaded roll call of who was to report at Gondar Barracks.

Please don,t slap Lungu and Asare down. They are not behaving as mere partisans. They are fighting those who are denying free speech.

If this was not their agenda, why ask the CJ and others, who are not part of the panel, to intervene to micro-manage the hearings from the sidelines?
The fact of the matter though is simply that no single individual, the CJ herself included, has any such powers to do what they are seeking to have done! Indeed,not even the President, who enjoys enormous and extra-ordinary powers under our current constitution, can think about embarking on any such move! This why we all must view these 'freedom crusaders' who have sprung up, mainly from their comfortable surrounding in the US, with some amount of suspicion.

Kwaku Azar's conception of modern Ghana fascinates me to stupor; he has some weird ideas, to start with. He behaves the same way NPP does. That is, if the tides are against him, if his lines of reasoning and ill-logic don't go down with anyone, he falls apart, pretending omniscience. But I would say, it is an attitude you find in most Ghanaians.

Despite the number of decibel resounding titles like "Professor" we have in abundance in Ghana the country crawls like a toothless baby yet the so-call "Profs" would not let us hear.

No 'real' civilized countries behave the way we do, and frankly I feel a lot of shame vis-a-vis the diplomatic community and the world. Even British from which we pretend to learn our political and courteous leanings don't behave this way. In fact, insult is not common in Europe, not in their political terrain, not in the civil society.

In Ghana, everything started with lack of respect for our civil code and therefore the beginning of indiscipline...

Sadly, it is in the same category we find an adequately compensated President who does not pay rent or provide for his own transportation, yet is allowed not to pay income tax. But with the other side of their mouths, these same individuals would expect other citizens, businesses, and individuals, etc., to pay all manner of taxes as part of their responsibility to the Nation.

They say it is in the Constitution.

What happened to the moral and responsibility of these so-called "elders?

ITEM: Judges in Ghana ought not entertain the thought, least of all actually cite private citizens and members of the press for contempt, when these individuals do not have a case before their courts.

I cannot understand why all these so-called 'freeedom fighters' are picking on Justice Atubuga as though he was conducting a one-man petition hearing. If anything,I believe this panel headed by Atubuga, had allowed a lot of 'nonsense' to go unchecked.
Having realized that their side has NO CASE convincing to present to the SC, and the Ghanaian public at large,a small group of self-acclaimed 'intellectuals' resident outside the country,have mounted a vigorous but mean-spirited rear-guard action, aimed at scuttling the work of the SC panel. Where were all these national 'heroes' when Owusu Afriyie and his cabal now in control of the NPP,were 'dumping' on fellow NPP members like Wereko Brobbey and Kwame Pianim? All these 'defenders of freedom' have all but forgotten about the public humiliation that this band of sore losers headed by current Party Gen-Secretary, meted out to fmr. President Kuffour for choosing to attend the inauguration of President Mahama.
This carefully planned strategy to drive a wedge between Justices who now constitute the SC will not succeed. personally, I do not see what the current CJ acting alone,or in concert with Justice Date-Bah and anybody else can do to 'resurrect' the the dying hopes of the NPP at this point in time. It beats my imagination how the same people who would vilify their own party members such as Wireko-Brobbey for (yes), speaking his mind and voicing his opinions about their own basic errors, omissions and commissions, can turn around in such quick fashion and become "defenders" of freedom of speech and expression.

To prove your point, their voices were not heard when Owusu afriyie et. al., summonsed Dr Wireko-Brobbey for his comments and are threatening to expel him from their party.

Summoning individuals to appear before it without due process is fundamentally flawed and represents an attack on individual liberty and it is essentially an abuse of human rights! It an act meant to intimidate the public! SC justices are not above the law, indeed even the President is not above the law! If the SC justices feel they don't want to hear any commentary, of course they can refrain from listening or reading what is being said out there and concentrate their minds on the case. Now, coming back to the issue of freedom of speech.What exactly is freedom of speech? Can it be re-defined to suit a particular situation? Is there no difference between a free speech and a responsible speech? Where in the world is comments and propagandas made in a case before a court of jurisdiction?

It is wisdom to learn from your experiences. It is supreme wisdom, even divine to possess the ability to learn from other people's experiences. The latter is a better manifestation of scholarship, and this is what I am inclined to invest the SC with. Recent events in Rwanda and Kenya are still fresh in our minds. We don't want to have to experience that kind of horror first in order to garner the potential of what could befall dear Ghana in any such eventuality. We can cleverly learn from the experience of Rwanda and Kenya without having to actually experience it. We may ask what the causes and immediate precursors of the Rwandan and Kenyan conflageration was?.......unbriddled press freedom, with its ability, albeit seemingly innocuously, to stoke tension which is already visibly at flashpoint. Justice Atuguba and his SC, I believe, are seeing well beyond the horizon of the so-called men of academia who would want to tout press freedom as if it was an end in itself. One careless spark and Ghana is ruined. Kudos to Justice Atuguba and the gallant men and women of the SC for their visionary disposition. Please haul before the SC anybody with an interest in creating tension in the society related to the on going election petition. We Ghanaphiles are all behind you.

In the meantime, the politicians and their technocrats were looting the country left right and centre. The impunity and the 'bigmanship' on display by politicians in the face of general economic hardship was staggering. It was open secret that the bribery and corruption and politics of subterfuge and chicanery went all the way to the seat of government. Name any government institution in the country and they had their bloody noses in its trough, devouring like greedy pigs. In the midst of all this misrule and rampant abuse of professional ethics, lawyers and journalists tripped over themselves, comitting libel, defamation and contempt.The wayward legacy left by Kufour and amply manifest in the actions of these professionally reprehensible lawyers and journalists needed to be confronted head on.
The thing I would like to tell prof Lungu is this(even his name sounds like a buffoon)Making public pronouncements on a case pending in court, as taught in any worthy journalism class, is anathema. it borders on professional misconduct, Not to talk about contempt of court and treating the court to disrepute.The ultimate lesson behind this is that it could be prejudicial. This grievious national waywardness by politicians and journalists reached such a dangerous and disgraceful stage, such a crescendo, they were calling for violence and attack against political opponents and using graphic terms such as;"mayhem,"all die be die"etc; even calling upon one tribe to "kill" the other. Indeed, politics and journalism had descended to the gutter.'Judgement hath fled to brutish beasts, and men have lost their reason'. Now this carricature of a lawyer, Awuku, pronounces publicly that Judges sitting on a pending case, of massive political and historical significance for this country,are hipocrites and are dispencing selective justice. If this was not a stark case of contempt and disrepute, I don't know what is. If this was Kufuors time, there would be a thunderous silence and he would sit there like some po-faced ganster mafia don,so long as the kick-backs were flowing. The country at large can go hang.Personally, those wayward lawyers and journalist should be thrown into the slammer for at least two weeks. Some of us have had a chance there and we know what goes on there. Please go get a corporate email at least, if you can't afford a website; it will score you the first hurdle of a credibility probe.
