This is our own judge Akuffo -Addo as far back as 1968: In the case involving the REPUBLIC versus LIBERTY PRESS LTD. AND OTHERS [1968] GLR 123–138, Chief Justice Edward Akufo-Addo, on the instruction of Attorney-General Victor Owusu, had this to say:

“It must be appreciated by the press and all other freedom-lovers that without a judiciary strong, courageous and respected that can effectively protect the freedom which we all love so much, all talk about freedom, whether it be in the lecture room or at Bukom Square, remains no more than a mere metaphysical speculation, and the courts are entitled to look upon men such as are before me today to help them in the acquisition of the requisite strength, courage and respect. “One of the surest ways of doing so is to refrain from commenting on proceedings which are pending in the courts. For these constitute some of the most fruitful fields of contempt. There is however no law which prohibits absolutely any such comments, but there is law which punishes if the limits set by law are transgressed, as indeed they have been transgressed in this case. “I have stated that the courts are not above criticism but the courts will not allow themselves to be subjected to pressures emanating from irresponsible and romantic criticisms.”

Hello I believe the following quote is what motivated you to write your article: " Folks, this hogwash about quoting sections of the American constitution to support arguments against the Supreme Court off Ghana has to stop! Do we have any sense of pride as Ghanaians, or for that matter, Africans? Can't we evolve our own peculiar systems without constantly referring to the American constitution or American laws like a bunch of kids who cannot think for themselves? This is the reason why Africans are not taken seriously by the western countries.. Even our intellectuals can't get it right. Kwaku Asare and Arthur kennedy can quote from the American constitution and allude to the American judicial system all they want - they do not know better than the Ghana Supreme Court judges, period".

Basically unless an idea comes from a source in Ghana it should be discounted. In your thick head every country must develop its own peculiar democratic principles that underline its democracy whereas all democracies follow the same basic principles - freedom of association, freedom of speech, freedom from unnecessary searches and seizures, freedom to vote etc. Following your logic laws of science, mathematics etc should also not apply until your grandmother comes up with the idea or theory.

Are you nuts.....the whole Ghana education system from class one to university depends heavily on textbooks written by foreign authors. If there are Ghanaian sources that have made similar arguments to support their points I am sure they would have quoted such authoritative sources, you just don't go and quote your grandfather or mother just because it sounds nice in your ears.

In matters of this nature you have to focus on the point being made, its relevance and contextual reliability and appicability and not just the source of the quote. You are damned fool to suggest any otherwise. Ghanaian laws draw heavily from British laws not your mom's so what the blistering are you talking about? You are a bloody fool for bringing Prof. Stephen Kwaku Asare's name into disrepute. You are potentially the type who thwarts the efforts of Ghanaian expatriates who return home and unnecessarily label them "too known". All your write up is an excuse not to do anything and allow activist judges do whatever they like until local authoritative legal luminaries can be sourced and quoted to check their excesses. Check your coconut head to see if it is not your ingrained jealousy and inadequacies making you talk foolishly like that.

Talk about precedents, why do we even waste our time trying to 'invoke' Lord Denning's quotation on freedom of expression when we have our own Akufo-Addo (is it the same one whose son is in court fighting for the presidency?) defending the judiciary against a "free press"? I weep when I see mother Ghana going to the dogs due to the lawlesness that is creeping its urgly head into the Ghanaian Society even to the point that, our seniors from whom we have to learn are throwing the country to the dogs in the name of politics. Sanit, law and order must be brought back into this country and I am glad to see it starting from the courts. I believe even the teachers have lost control over the schoold children and discipline in our schools have even gone worse and it was not like that some years back. One set for Africa and the other set for the rest of the world. If we want to practice our own peculiar system of governing, we then need to go back to the KINGS, CHIEFS, LINQUISTS and etc. governing system that existed before the white men came. During those days, we not only reverend our chiefs and Kings a great deal, we also accepted dictatorship. With this so called democracy, freedom of speech rules. WE CAN'T HAVE IT BOTH WAYS. Sure, our Honorable Judges need to be respected but they also need tough skins to occupy those seats in other to absurd valid criticisms like what Mr. Awuku opined. Those who are calling for war based on the court's rulings are the ones that need to be looked into. Even with that, I believe our judges need to follow proper procedures instead of the so called verbal invitations.

It is very much disappointing that undoubtedly well-educated commentators will reduce this issue to the usual NPP-NDC political football. What Prof. Asare wrote was in not in defence of alleged NPP offenders over alleged NDC offenders. In fact he provided defence for all of them by his argument that their right to freedom of expression, as granted in the 1992 Constitution, must be respected. He was also critical of the manner in which they have been summoned to appear before the Court in clear violation of their dignity.

The thrust of the debate is that right to freedom of expression is given to every citizen of the country. This right cannot be curtailed unless it is to protect the authority of the Court towards protection of some aspect of societal morality and order as well as security.

When the right to freedom of expression is curtailed in the manner sought by the SC, it must be prescribed by law; that law should be specific and formulated in a language that is so clear that we all can regulate our conduct; and it must be shown that the law can deliver the intended protection.

Can those who are defending the approach so far adopted by the SC point to a particular law (by name and description) which these alleged offenders are supposed to have violated? Also if there exists such a law, the SC must behave like any other complainant. It should complain to an investigative authority that will investigate, and if satisfied, bring charges. The individuals concerned have a right to know what they have been accused of; the law they are accused of violating and they have the right to mount a defence. Where this is not followed, we are taken back to the days of arbitrariness. This was the crust of Dr Arthur Kennedy’s argument.

Lastly, does anyone think that the Supreme Court can monitor all utterances and publications within and without Ghana on this matter? I do not think they can; hence what they are seeking to do might not be effective in curbing prejudicial statements. That is why it is being advised to concentrate on the case in hand. A lot of the statements are incitements and they should leave the Police, if they are up to their duties, to deal with them.

This is not NPP against NDC. If it were, NPP should be gloating because Sammy Awuku was discharged with a ‘slap on the wrist’ but the NDC alleged offenders might get a harsher punishment.

Yaw Ohemeng writes as if the law of contempt and its parameters are not already part of the Ghana constitution.He writes as if those who are being cited for contempt are been brought to court under unrecognized and known laws.In fact he tries to create the impression that the present exercise of bringing some sanity into the open for all accusations against the sc is been done on the the judges whims without due regard to the law or the Constitution.That is wrong.

It is in the interest of all of us that the law of contempt be invoked by the court to address some of these affronts to its authority.It is even more so if we should address the blatant campaign by party activist to cast doubt on every ruling by the judges.Stephen Asare a well known npp activist is on record to have openly accused the president of the panel of bias as if to say he takes all decision exclusively and had written several articles against him in unflattering terms.

If we should allow these attacks on the process to go on unchecked no body would accept the decision of the court because they would have been tainted with doubt and cast as biased.

Those so called academics must bear in mind that their foot soldiers would take any decision that did not go their way by the sc as bias and would not accept it.Just because you give that impression in your writing and also posit that freedom of speech is absolute.

In fact in all jurisdictions freedom of speech is qualified and you can't attack the judges as incompetent and bring them under public ridicule all in the name of freedom of speech.For political expedience it seem to me that discipline has gone down to the dogs.

I have as recently as yesterday, repeated my condemnation of the president's purported comments about the supreme court case which I have suggested were unwsie, unhelpful and also bothering on contempt. Indeed the court specifically mentioned him (the president)in their criticisms prior to Awuku's crass behaviour in the media. I would however not put his comments in the same category as that of Awuku and others whose primary focus was to 'attack', condemn, indeed ridicule and openly disrespect the supreme justices and the JOB they are doing.

Although I completely disagree with the president's comments and condemn them, he was expressing his 'belief' that he "won the elections fairly and squarely" and that he believed the SC ruling "would vindicate him". These are his feelings about his chances in the case, but however privately confident he may feel, it is totally wrong of him to air such feelings in the public domain.

I am just an observer like you and would condemn anyone who does something I think is wrong, irrespective of personality or station (and that includes the president of the republic). In my view his advisers need to do better in terms of what he can and cannot say.

The treatment metted out to Awuku was completely wrong. Quite apart any arguments regarding freedom of speech, Justice Atuguba clearly sought to ridicule Awuku; making him the butt of jokes at the Supreme Court.

I do not think that it was the intention of the Supreme justices (mind you this is NOT a unilateral Atuguba decision) to ridicule anyone. There were merely applying the law within their remit.

This is the "Voice of Reason" that must be listened to. Thank you, Sir! And for those who quote American Constitution in cases affecting Ghana, it's shocking for them to imply that the American Constitution applies in Ghana or supercedes Ghana's own constitution. That is hogwash! And for those who think that freedom of speech is unfettered, they need to think again. My college principal used to say, "Your freedom to throw your hands ends where my nose begins". I think it tells it all that freedom of speech is not absolute; and your freedom can only make sense in the presence of the other.
