    IN ALL THE INSTANCES CITED THERE HAD NOT BEEN A PRIOR NOTICE SERVED AS THE SC HAD DONE IN THIS CASE. DONT FORGET IN KENYA THE COURTS HAD ISSUED GUIDELINES BEFORE THE COURT PROCESS.
