I have just been asking myself if the Supreme Court should aim at earning respect and honor for how they deliberate on issues before them or they should intimidate and cow the people and the public to be silent for them to do their job. I was just struggling for answers. I thought that if the Supreme Court was able to pursue and do the right things, no matter the objections their stand would stand supreme. Truth is easy to recognize while biases and préjudices are also obvious to detect. In the ongoing NPP vrs NDC 2012 General Election case before the Supreme Court our eyes are open to follow the court every step of the way. They know that their judgment is for posterity. I suggest they should do the right thing that would be supported by the international communities and let the people deal with the conséquences. Corruption and insincerity have taken too much grip on the nation. It is time to reverse the trend and we look up to the justices for their intent to redeem the nation.

If the principle of sub judice and the offence of civil and criminal contempt did not exist in the annals of jurisprudence or did not prevail in civilized countries; then you could perhaps argue this case of freedom of speech. But where the Judges hearing a petition are accused of been selective and bias in a case where they haven't even given a ruling but are merely over ruling or accepting a counsel's objection; then the issue is not free speech but contempt of court. And it is here that you have shown a shocking ignorance that does not befit a general legal practitioner.
The problem is we have too many people with a superficial knowledge of the law who want to comment on every issue. The case you cite is irrelevant in so far as they do not relate to contempt of court. It would have been an entirely different matter if someone had accused the Supreme Court of having been racially biased in rendering a decision.

My own view is that the Supreme Court is ignoring more seriou acts of comtempt within the court premises and trying to silence people by puting the "fear of God" into faint hearts.

Isn't racial profiling akin to racism? This writer has taken everything he wrote out of context.The cases he cited were in reference to freedom of speech and not contempt of court.Not even one single case he cited addressed the question of the powers of the judiciary to protect it self under the constitution from being undermined.
Instead there was a whole diatribe of misleading assertions as if there is nothing like the contempt of court act in the US constitution and its common law system which protects the judiciary from undermining its authority under that constitution. In all civilized democracies including ours,the judiciary has that right.
Contempt occurs when a person disobeys a court order and is subject to sanctions, such as a fine or imprisonment. The purpose of contempt is not only to enforce court orders, but also to maintain public confidence in the judicial system since the administration of justice would be undermined if the order of any court of law could be disregarded with impunity.
There is doubt that free expression is the fundamental fountain-head of democracy.However the right of free expression does not confer right to denigrate others rights and reputation as such the right of free expression is subject to reasonable restrictions.
Since freedom of speech bestowed under the constitution and the independence of the judiciary are the two essential and most important constitutes of democracy in a country. Reconciling these two competing public interest issues and maintaining a balance is very important.
It is unfortunate therefore that this lawyer had taken the action by the sc as a breach of freedom of speech. When a judge makes an order to advance the administration of justice and the rule of law that,that order be respected otherwise there will be chaos and disorder which will break down order and therefore our democracy.
I feel that contempt of court, whilst harsh to contemnors at times, is not a dagger in their back, instead it is more of a nudge, prompting everybody to consider the rights of others whilst they are exercising their own freedom of expression.
Writers like this lawyer must understand this simple principle and stop misleading people with this one sided article.What is important is a balance and reasoned write up.

Is Dr Adjei here arguing for the sake of argument or is he serious about his analysis and conclusions? Tell us readers doctor: Are the functions of the three different branches of government the same, equal and similar? Surely just as parliament has its "powers" and the executive branch has its own powers, the judiciary also has powers vested in it that are 'specific, unique and appropriate' to its proper functioning?
Tell us if the powers of "contempt" (both civil and criminal) are not clearly indicated as a "power" of the court (not to be abused by anyone including judges) but applied correctly, appropriately and proportionately to protect the the court and all who rely on it to do its defined job.
Just as you disagree with the "application of the powers of contempt" in the on-going case at the supreme court, there are equally many who agree with it and believe it has been rightly and proportionately applied for the very reasons of its existence within the constitution.
That you have a deference with the law does not mean you should accuse the supreme justices of blundering. Perhaps you are too used to the workings of the lower courts and need to examine in some more detail the workings and provisions of the superior court of the land.
It is about time we (intellectuals) stood for our integrity and learnt to interpret and analyse the interpretation of our laws in a balanced and objective manner at all times (even when it hurts).
I personally take a very deem view of intellectuals who will not argue on the merits of the case but hide behind their qualifications (and / or job descriptions) to condemn the decisions of a jury of experts. Don't tell me the supreme justices don't know what they are about!

There are some people who doubt if he deserves to be called "Dr" because he didn't really do a PhD based to earn a "Dr" but took a Law degree which many in the US have (including President Obama) without insisting on being called "Dr". But Sarfo-Adjei is a Ghanaian and you can't deny him his due. He even calls himself "Dr", so don't forget and "lower" him by calling him "Mr".
As for the subject matter, "Dr" Sarfo-Adjei is an NPP sympathiser so he will naturally interpret the law in accordance with that.

However, if our memory serve us right, the last time we had an opportunity to comment on an essay by Attorney Samuel Adjei Sarfo was way back in 2008-2009. We are thinking at that time he had probably not completed his J.D. degree.
Further, it is possible that we ignored this "little matter" because of the rather unconventional/odd way the title/name were presented at the head of the essay (i,e., dr. Samuel adjei sarfo).
That said, we will point out that we have absolutely no reason to suppose that Dr. Samuel Adjei Sarfo has tailored his response to "NPP" interest/bias with respect to "the subject matter".
We are very familiar with American jurisprudence, political culture, citizen participation and their independence, as well as expectation for all (publicly-funded) judges.
Serious nations have long moved away from trivial outside-courtroom-contempt-of-court chargers.
If one is a critical thinker, one ought to arrive at the destination Dr. Samuel Adjei Sarfo has arrived at: the Ghana Supreme Court panel is blundering.

Before he issued his final warning, many irresponsible statements had been made by cefrtain individuals which were putting the SC in disrepute, and the presiding judge was categorically explicit that any body who, from that day afterwards would cross the line he had drawn, would have to suffer the consequencies thereof. Those self centred individuals actaully dared the court and they had to suffer the cosequencies. Sorry my dear PHD holder, i think you can do better than this!

I find it very difficult to understand how little minded person, supposed to have assailed himself in higher education show a narrow minded view of the interpretation and the meaning of 'free speech'. My simple and short education to Dr Samuel Adjei Sarfo is that means respect for the individuals rights, respect for the laws, rules/regulations of the land and our communities and responsibility for what we say. Lawlessness, indiscipline and reckless statements which bring unhealthy relationships to any society is not 'free speech'. Come again Dr Sarfo.
