And before you decide to 'rain on the parade' of others,why don`t you discuss all the cases you handled on behalf of clients who,on your advice have lied between their teeth in documents they have submitted in support of 'bogus' permanent residency applications filed with the Home Office?
While you take delight in imputing ethnocentric motives to others, have you paused to reflect on what you are attempting to do with defamatory article?
Where is the your supporting evidence that "Woyome,Waterville and Isofoton could not have happened without corrupt and Undisciplined lawyers acting in abject disregard of generally accepted standards of conduct for proefssional lawyers"? Did you, by any chance, read about some of the statements and revelations made by the Country Rep of Isofoton,Anane Agyei, regarding the genesis of the Isofoton debacle?
And are you also aware that Kwadwo Owusu Afriyie(Sir John)has publicly admitted accepting payment in kind,in the form of car,for so-called 'professonal' legal services rendered to none other than everybody`s whipping boy, Alfred Agbesi Woyome? If you are in doubt,find out from Tarzan who can give you more "Apo" on the matter!
Finally, may I suggest to you that you can be of more help to Nana Addo in getting rid of this perennial thorn in his flesh, retired Jsc Kpegah, for good if you went down to Ghana to represent him in court!

Abroad Lawyers get investigated and arrested for this sort of thing all the time, mostly ethnic minority folk. it is your kind that has made evil triumph in Ghana

In his article,Kwame Ohene Asare chose to paint a very rosy picture far removed from what actually takes on a daily basis in their law practice! Listen, if we took a survey about the professional conduct of Ohene Asare and some of his colleague 'saints',how do you think they would stack up? Are you telling me these vunereable people from our community they prey on,are the ones who originate the 'dubious schemes' to circumvent the immiration laws of the UK?
Retired JSC Kpegah may very well be an eccentric oldman,butI we should not allow Kwaku Ohene Asare to get away unscathed with his own 'tribal hatchet-job' he has tried to on the individuals he intentionally cited in his piece. If propriety and ethical behaviour on the part of Ghanaian lawyers is his main theme, why did he not include the examples of lawyers who helped themselves to clients` eschrow accounts, or those became ntimate with clients of the opposite sex? And far from endorsing any of these kinds of scandilous and unethical conduct,I have encouraged people that I know to file complaints against Attorneys who have 'milked' unsuspecting clients dry!

Please don't make assumptions. You have been schooled to think everyone is corrupt. this must be the import of his article. You are no doubt an intelligent man. DO NOT MAKE ASSUMPTIONS. That firm can do without Immigration and not every Immigration Lawyer condones forgery cause if as we know there is a Ghanaian Lawyer in London currently reporting to Bail every month or so for just that and it is usually Ethnic Minority people like you who dont believe in clean ways of making money. The Isototon and the waterville cases were won on legal technicalities which I believe will create other difficulties under the law.Almost all the contracts under the Kuffour Government to date must be revisited to see whether our parliament have not done a bad job.The blame is parliament and not lawyers.

To find solutions to some of the seemingly 'intractable' problems facing Ghana. For me, there is enogh blame to go around - Judges,bureaucrats,politicians,business people,traditional leaders,the clergy,right to the ordinary folks on the streets. No wonder the state is csah strapped!
I have just read a reportage on this site indicating that certain major companies involved in PPP arrangements with GYEEDA (Zoomlion, Rlg and others) are to refund more than GHc 203 million to the state as a result of over-payments they have received from arious MMDAs. I suppose this is over and above the payments these companies are entiltled to under the lopsided 'sweet-heart' contracts they secured with the govt!

2. Do you have Akufo Addo's bar certificates?

3. Can you name one of Akufo Addo's classmates and/or lecturers?

4. Which year Akufo Addo did his post call bar at the Ghana School of Law, Makola?

Don't talk about matters you lack basic understanding and knowledge.

Take that piece of advice to the bank and stop writing about matters you lack basic knowledge.

Asare, I agree with you in principle that there is too much indiscipline within the legal profession in Ghana, though that should not be surprising because indiscipline is a cancer in Ghana. In fact, I said in one of my articles that, some are criminals parading as lawyers in Ghana.

It's almost the same story even within state institutions. You remember the State Attorney who recommended the payment of the money to Woyome and his wife was paid GHC400,000 by Woyome? Nothing happened to the man and reports indicate that he is back at work and seeking to become the Solicitor General. Do you remember the lawyer who represented the woman in the drug case that turned into some powder? He was paid for his services in the office of the female senior police offer who was dismissed after the case and still fighting the police in court. How can a defence Attorney be paid in the office of the prosecuting agent?

There is no effective regulation of any professional group in Ghana but particularly, the law profession. Many are inefficient, ineffective and corrupt and corruption is how they can make a living in their profession.

I do not want to comment on the Kpegah v Akufo-Addo case except to say that, it is just madness (I have written two articles on it). Again, whilst I agree with you that the case has the element of racism (commonly referred to as tribalism in Ghana), both the case itself and the demand for the Judge to recuse himself because of his ethnicity, I disagree with you that, this will meet the "racially aggravated crime in the UK under the Crime and Disorder Act 1998. I say so because, the element of racial aggravation, which some of us campaigned for (through the then Commission for Racial Equality) specifically but not exclusively relates to "hate crimes". I do not consider the Kpegah-Akufo-Addo case (though racially motivated) as hate crime because the objective of hate crime is to send a message of fear and intimidation not only to the victim but the larger community that the victim belongs to. The victims is so selected on the basis of what s/he represent rather than who s/he is. The crime and the victim is symbolic. I do not believe that Kpegah selected Akufo-Addo as his victim because he wanted to send a message to all his ethnic group. Again, Kpegah is politically motivated more than racial or probably on equal terms. I am not a lawyer but I worked in race relations for nearly eight years.

With respect to the Supreme Court petition, it was agian unbelievable that the justices allowed Tsatsu to continually call Dr Bawumia dishonest for no just cause, with no reprimand from the judges or any form of defence from his lawyers. Then there was his uncouth "shut up" episode.

In any other jurisdiction, Tony Lithur's flunging of court documents would have incurred sanctions.

The Attrorney-General's Deparment is probably one of the most porous institutions in Ghana. Back in 2001, every first year law student should have known that charging Tsatsu on a 1996 law for an act commiitted in 1992 was nonesensical. Instead, there was a case of using $2000 of atate money to buy shares for himself, a clear case of theft.

All the dubious judgement payments that have been made to crooked individauls and institutions/companies have been possible because lawyers at the AG's Departgment are either incompetent or crooked themselves.

Instead of the GBA taking on those issues, they rather applaud the dubious infringemeent of citizens' rights.

When man replaced the primitive egalitarian society and adopted the slave form of socioeconomic system he at once took the path of oppression. To protect the slave owners there must be organs of oppression, army, police, courts, a civil service, spies, among others.
The main organs of oppression in a class society is the executive, legislator, judiciary, security services, the civil and public service. The aim of all those institution including the Church is to preserve the status as it is in the interest of the exploiting classes, in our case to serve the interest of our former colonial masters.
Thus the judiciary remains an organ of oppression in a class society like Ghana.
Kwame Ohene Asare it is a fact that one can not work in any field of human endeavour without the evidence that he or she has a certificate, show by evidence of oral question at an interview that he was actually the holder of that certificate. It is also a fact that a person who changes his name must swear affidavit to the effect as I did in 1976. In addition to that in his affidavit he must show that documents bearing his former name or names are still valid, or he may decide together even forgo the qualifications he or she had earlier under the former name or names.
It is a fact also that when a person loses a certificate awarded to him by an institution he must notify the institution about the incident and have it replaced. How can an educational institution or a professional association just write to a court or an institution demanding a certificate of both a qualification and membership that they know the person whose identity has come under suspicion that they know him without replacing both the certificate and membership card.

Why can't your postings be objective but rather only one sided.So you did not see the many times that the judges have to call addison's attention to rude remarks far more insulting than Tsatsu's shut up.At one time a judge everybody consider friendly to the npp cause told him in complete disgust that Mr Addison to quote him "this is below the belt" repeatedly several times and even addison realized that and apologized.This was when he attacked KPMG's reputation in an insulting way worth not repeating.

Not a word was mentioned on addison's conduct or anything negative about the petitioners.Instead all that went wrong came from the respondents camp.In your eyes the petitioners were saints and the respondents were devils.What a ludicrous person.

Your bias in this ongoing petition knows no limit and you are gradually becoming a laughing stock as Mr one way bias analyst.

He wouldn't even wait for the first handful of mud to be thrown. What happened at the court - the fact that the exhibits could not be sorted properly, the registry giving different versions of the exhibits to the presiding judge, and all that - are all symptomatic of a failed education system.

The 'anything goes' sloppiness is what I wrote about.

To put it mildly,he over-played his hand! But can you blame him when 'loud praises' were being heaped on him for deliberately engaing in patent falsehood and deception in court?
My biggest beef is with the court registry which came close to derailing the entire proceedings for no good reason. And what has been done to that large retinue of court officials,whose body language and performance in court clearly indicate that they are not fit for their roles.
Inspite of the great lenghts Addison and his team have gone to prove that they did indeed file all 11,842 unique pinks sheets the seek to rely on as exhibits,why is the registry,the repository of these documents, unable to produce a full compliment in its custody? And what has been said about this strange development? Nothing!!!!

This office sitting practitioner with no experience in serious court room litigation other than petty immigration cases and housing and minor tribunal cases should give us a break.

His argument per se is about the defense of the npp and his perceived abuse of the judicial process as a result of Justice Kpega's suit against Akufo Addo.In that suit among other things Kpega is alleging that Akuffo did not qualify as a lawyer and accordingly he did not follow due process into the Ghana bar and therefore must be struck off.

I believe this to be a serious allegation that must to be rebutted and every measure taken to establish the truth.As we speak now that rebuttal had not been fully discharged and as to whether Akufo have certificate or not no one knows.I believe if it were UK the authorities would have step in to establish the truth since it is bothering on criminality. You may ask on whom does the onus lie? I think it is the responsibility of both parties to clear this dispute with the facts and not technicalities.

On question of ethics and professional conduct I completely disagree with your premise that the litigant should have no representation because of a counsel judgment.Even in murder cases where the murderer is obvious there a requirement of due process and defense.It is not for the the counsel to determine what is wrong or right in litigation it is for the courts to do so.Litigation must always be in the interest of the litigant and not the lawyer.Once you are not fraudulent you are OK.

One of the cardinal principles of the law is that all people accused of a crime are legally presumed to be innocent until they are convicted, either in a trial or as a result of pleading guilty. It is the duty of the court to make those decisions.

Finally the axiom under natural justice is that justice must not only be done but it must be seen to be done.Under bias in law any semblance of bias as in this case where Akkufo is coming from the same clan with the Judge will not make for a fair trial or make the plaintiff feel comfortable with that judge and hence the need for a neutral judge.

By the way the plaintiff is more vexed in the law and more experience than your limited knowledge in law will fathom.I say so because solicitors are limited in their in their practice as a result of their training.

You sound like an illiterate but never mind.When I say office sitting it is a factual remark.Solicitors by their training in England a and Wales limit their practice to the office where they do paper work for courts and prepare other legal documents.Unlike Ghana under the law of UK,solicitors can only do cases in the lower courts like immigration tribunals and rarely magistrate courts on child right and other minor cases.The duties of the court is exclusive to Barristers who are trained sorely as advocates in the E/W.

There is therefore a division of labor unlike Ghana.In England and Wales they have Solicitors for office work and barristers for court advocacy work.They are all called lawyers though.It is clear therefore that there are solicitors and there are barristers so don't show your ignorance.If you don't know ask.

NDC Laywer.Solicitors in the UK have audience in the County Court up to Circuit Judge in Hearings in the County Court, that is, up to the Highest and No audience from the High Court Onwards. They can represent you in anything in the Magistrate Court. Even then these days there are quite a number of Solicitors who have just a little additional training that enables them to act as Solicitor Advocates; they can do anything a Barrister does. That sort of dichotomy between Barristers and Solicitors in the U.K. is gradually fading. Get Legal Advice. Lets not fight over this though. I am a UK Lawyer. but whatever your view, you are my brother. but this little interraction shows how we all have to have some humility rather than make assumptions. An Illiterate? I have a PHD in Law, aha! I don't think everyone else is foolish though.

Look,in law masters is the highest degree and I have a masters in international law.So my credential read LLB HONs LLM International law.The PHD is just for research purpose only.In law in our methodology we as well learn t how to route our inquiry in legal theory when it comes to pure academics. so I am comfortable to argue my point with you notwithstanding your PHD which has nothing to do with law.Tell me your PHD thesis or dissertation title whether it relates to law or not.Lets argue on the issues.

I hope you are not saying that there is no division of labour in law in the UK. Although the roles are being relaxed they are by and large the same arrangement.That is why solicitor advocate are being encouraged to take exams and undergo training to enable them to represent their clients in court.

Having said that there is a distinction between a barrister and a solicitor. Solicitors by and large do the paper work and barristers do the advocacy work in court.
