The Judicial and Electoral Systems constitute some of the most important institutions of Democracy. And where these systems remain deficient, the citizenry carry the burden of failure.

Last week we heard lawyer Sam Okuzeto tell Pres John Mahama to step aside and make room for his party`s presidential candidate Nana Akufo Addo. Yesterday it was another guy and today it is Art K. And what surprises is the brazen attempt by Arthur Kennedy to link the detours in this country`s democratic path to what he(Kennedy) considers as wrong decisions made by our SC. Good Heavens Heavens! Where was this guy when Busia made the infamous "NO COURT" pronouncement in the Salla case?

There is a reason for the old adage for not comparing apples to oranges. Similarly comparing Ghana's pretentious democratic practices to accepted norms of best practices and procedures of democratic values will not do. J.B. Danquah was able to use article 13:1 of the 1960 constitution in his favor to win the release from detention of his clients because, just like everything Ghanaian, the parliamentarians who drew up amendments and addition to Ghana’s constitution did not have foresight or clear understanding of the effects of law, their application and implications.
For example, the United States of America, the greatest democratic nation on earth, came up with its own PDA after the infamous 9/11 horrific attacks which most constitutional purist saw as anathema to the freedoms spelt out in the original articles of the constitution. But the congress of US after 9/11 understood the coming changing world. In Ghana those so-called law makers did not understand the coming dangers nor the prudence and foresight required to bottle up traitors, anarchists and agitators whose acts and pronouncements will and do encourage chaos.
If referencing the short-comings of a nation then and now is a feel good moment in history for people, then that is well and good but in the end a true unbiased reflection of events past and now in Ghana only highlight a nation incapable of wisdom and foresight. It takes people with wisdom and foresight to draft documents that stand the test of time. You may want to look for those character traits in America’s founding fathers and not in tribally driven yahoos in Ghana. Ghana is not a bankrupt, corrupt, dysfunctional nation because of wonderful leaders of yesteryear and or today; it is because we have consistently lacked wisdom and foresight.

The US has the 2nd amendment abot carrying or gun ownership. when was the law enacted? in the era of the wild west. Law enforcement could not be on those widespread farm and the needed to defend themselves. Today it is recited as a gospel fact. PDA was a necesity
