Just think of how the fool-soldiers are looting and burning stuff even when they have, let alone if the power is taken from them.
Afari Gyan had been the commissioner for eons and it seems, just like all educated elites that have found themselves in high positions, he did nothing to bring a change in the EC.
This is the man who was so bent on to go by the rules by annulling Konadu's candidacy for missing the deadline and yet gives so many excuses for not doing the right thing in his own office.
Just a month before the election, this man was still trying to create more constituencies to burden the tax payers. 40 new constituencies to give us another greedy bastards who do nothing for the state, except to collect their fat salaries and ex-gratia. Amazing!
If you had NO MONEY to train your staff, what is the point of creating more constituencies to make it harder on state and your department. Did he not know that he would need more staff to man those NEW constituencies during the election?
What about TIME? One month to the election, instead of using the all the time you have to train your STAFF, you were walking around creating new constituencies. Does this make sense to anyone?
And moreover, as a commissioner for the EC and having worked for over 20 yrs, this man said, he does not even know the meaning of OVER-VOTING or can't define it. My goodness. This is a man we have to take his final word for our lives.
And yet, there are people who do not want us to talk about the truth. But want us to forget about all these. How do we develop or advance with such mentality?

In Ghana, some people thrive on confusion and weak institutions. Just cast your mind back to Tsatsu's stunt he pulled on submission of addresses day and it tells you how even those who are supposed to know better have no respect for the law.
From GYEEDA to SADA to RLG rot is all a result of deliberately weakning our institutions to make it easy for them to create loot and share.
After reading this article, just wait for the he/she columnist Margaret Jackson to write an article, compare the two and you will understand why we can't develop or progress.

the summation and subtractions at the ballot accounting sections were for the EC's own documentation but did not affect votes earned, if say NDC had 30 votes and NPP had 35 votes, the figures were then swapped. at the ballot accounting section there were misrepresentations but then each candidate were assigned the right votes. please read daily graphic of Monday ie yesterday's graphic to get a good summary of the EC address not this jaundiced article. thank God the supreme court proceedings was telecast live otherwise NPP would have thrown this country into chaos. their pronouncements and effusions does not bode well for Ghana at all. We all know better as a result of the live telecast. if u are a winner, it is clear u do not have to declare yourself, everybody would see it. if they are going to win at the supreme court then they shd shut up and save our ears (eyes). and remember the EC's advice, if the SC accepts their petition then that is the end of Democracy as we know it in Ghana since no election can ever occur in Ghana without these clerical errors. if it favoured Mahama, then at one time it did favour kuffour and one day it may favour NDC or NPP. meanwhile the evidence submiited by the NPP does not include the audit of all 26,002 ballot papers, which means the evidence was cherry picked. justice can not be served half baked

It appears that Mr Asare is arguing that if the EC admits to certain obvious shortcomings in the conduct of the elections, it should argue against itself! How, Asare? Of course, the EC will use all legal arguments to defend itself just as the petitioners are using all legal arguments to argue their case.
One thing is obvious from the SC hearings. We will all agree that the EC did not do a very good job. As a matter of fact, the EC didn't do any worse (or better) than it did in the previous elections. We are now hearing of its shortcomings because the last elections were so close that it was a pity that one person was declared winner and that the elections are being contested.
For us, the true neutrals (those of us who genuinely do not care if it is Mahama or Akufo-Addo who won), we are more interested in the shortcomings in the system in order to prepare for the next round, not to argue, as Mr Asare is doing, for one side against the other. We do not also believe that the EC aided one side as a premeditated act! It is in this spirit that we should point out the shortcomings of the EC.
The fact remains that where a court is called uponn to judge who really won an election, then there is something seriously wrong somewhere. A court of law is not in a better position to know who really won an election (as an empirical fact) than anyone else. That is why whatever decision the SC arrives at will be unfortunate. We have found ourselves in a situation where a "correction" cannot be made. Any "correction" that is made will be based on legal argument not on the empirical evidence. Such a "correction" will be as bad as the status quo, and, given the extra-legal ramifications, even worse.
Nobody knows, truly, who won December's elections. Even Afari-Gyan doesn't know much as he will want to. There were too many shortcomings within the system for a post hoc rationalization to unravel the empirical facts. Some of us also detest the idea that it is the SC that will determine the outcome. The justices don't know any better than the rest of us and can only base their rulings on the legal evidence. (I expect a split decision, which will, itself, be evidence that they don't know either).
The best solution will be to order new presidential elections preferably with the two main combatants (Mahama and Akufo-Addo) prevented from taking part because both are tainted. But what convincing arguments can we make for that?

Unless it could be proved that these errors were deliberate it can hardly reach the threshold of irregularities which is defined as intentional mistake in which case there will be the need for sanctions.
So far the arguments and the evidence available had only shown clerical,administrative and transposition errors and problems with arithmetic which is curable upon investigation and therefore easily redeemable mistakes which could not be used as punishment as the petitioners want the court to do.
It will be a travesty of justice if the petitioners relief is upheld.It will be beyond logic.In fact the court have no scope for discretion other than to uphold the EC's declaration.

Kwaku, I personally do not begrudge the petitioners taking this matter to court in so far as it contributed to our assessment of our electoral processes (not even the electoral system which in my view is sound).
But with all due respect, to argue that these human errors which happen in MOST if not all elections all over the world, that votes should be annulled is such a dangerous precedent, even you will come out some day to challenge. Let's be fair and consistent.
I disagree that the results were announced in a hurry. I also disagree that the EC did not check the petitioners' concerns about these errors.
If you would recall, at the time, the petitioners leveled huge accusations against the EC and president/NDC That the EC was in collusion with the latter to "steal" the elections, among others (something they have since abandoned).
As someone with an interest in constitutional law, surely you cannot let your eye off the ball on this one just because of your party interests? Are you suggesting that the errors made in sections of the pink sheets, were not read, detected and corrected by the EC during compilation of the results before announcing the winner. Come of it man? Let's be real.
Kwaku, for once, let us put party interests aside and let us look at the bigger picture. Are you suggesting gross errors and violations on the part of Ghana's EC? and by extension, are you suggesting that election 2012 was so flawed as to be declared invalid (in those areas where the petitioners have focused?).
Please for the sake of justice, constitutional rights and provisions for our universal franchise, move away from this posture if you wish to command the respect of our many fellow readers and intellectuals such as myself.
I say this not because I believe in Ghana's EC and do not wish us to 'throw the baby and the bath water away simply because we do not like the colour of the water'.

His accertion or findings was that every president for his second term election loses 2-3% points of the votes that brought him to his first tem in office.
His conclusion, since the 2008 elections so close that Mills only won by a margin of 0.1 0.2% votes, automatically Mills share of the votes will fall by 2-3% therefore Akuffo-Ado will gain those votes and will easily win the 2012 elections.
This is something that has been sold to the NPP leadership. Evening on Satureday 8th Dec., NPP proclaimed Akuffo-Adoo the winer based on this simplistic analysis because at that he was leading by 52% point not taking into account that a large section of the electorate had not been able to cast their vote. Check through their petition, all their calculations end up with Akuffo-Ado as the winner with 53% points. What a bunch of skeewde mental people. Kweku´s analysis was not about the parties contesting the elections however about individuals. In the last elections it was a contest between Mills and Akkufo-Addo but rather a new person altogether John Mahama so this analysis does not come to play. The NPP held on to this view as the analysis Kweku Azar is sacorsant hence they cannot come to terms with the verdict.
Deep down in my heart if it was adirect contest between Mills and Akufo-Addo, yes AKUFO-ADDO would have won hands down considering the situation in the country at that time "PROF. DO LITTLE".

The margin between the candidates was so small that this could have had an impact on the result. In this case it was concluded that new elections needed to be conducted in the two districts concerned. The result was that in one of the districts the first elected labour candidate lost the seat to a conservative candidate."

Anyone found guilty of violating the voting regulations must be given a jail term. This will serve as deterrent and also help to advance our democracy.

The writer has only succeeded in confirming the suspicion some of us had about his NPP affiliation.
Neutral people should reject tainted results. If you agree there are errors then it is hard to understand why you cannot agree that the errors must be corrected.
