Going by their interpretation of the case, a bad siting President can always be declared winner of an election by hiding behind those principles.

The sin of this piece is that you point to a case the 1st respondent has cited, and straightaway you jump to an amateurish conclusion that it is so hermetically persuasive that it will, willy-nilly, clinch victory for your party: How pathetic; what intellectual bankruptcy; what insipid naivety!
Mr. Allotey, your whole piece could be reduced to the following argument:
PREMISE: People stood in long queues to vote.
CONCLUSION: Their votes MUST be counted.
Your warrant for this argument is absent; however, I am willing to be charitable to you and assume that your unstated presuppositions are that all those who stood in the queues were eligible to vote; produced the right identification; were deemed eligible to vote at the particular polling station they showed up at; cast their vote for the candidate of their choice, and no vote cast was declared invalid. Fair enough!
My question to you is: How do you explain the situation where the number of votes counted exceeded the number of votes cast?
I deduce, from your argument, that, in such a situation, you still would advocate that whatever figures were captured on the pink sheets MUST still stand. I doff my hat to you for your sense of fairness and propriety!
Mr. Allotey, since you are such a great stickler for fairness, please tell me what you would do in the following real life, everyday scenario:
You are the manager of a bank. A customer who owns and operates an account with your bank, presents his own personally signed cheque for the withdrawal of $500 from his account. When you check his balance, you realize that he has only $499. He has no overdraft privileges. Will you go ahead and honor his cheque?

You see the answer your 'simple' example wants to elicit ignores the other benefits that will accrue to the bank if the Manager were to go ahead and honour the $500 cheque. And that, my friend, is what the petitioners in this case failed to give consideration to when they rushed to the SC!
Apart from the English case law which some blind supporters of the NPP consider as dated,what about the citation the respondents gave in the Canadian Supreme Court case that was decided less than a year ago,that is 2012?
I think I know what the Akuffo 'game plan' is all about - mount a petition in the SC, and then rely on 'friendly' Justices to make you President, regardless of how credible your case is! This plan may have worked except that the live telecasts of the proceedings have made it very difficult for him and his sympathizers on the panel to pull this off. Look, I am pretty certain that even the "strict constructionist" Justices of the US Supreme Court will have a hell of a time siding with Nana Addo and his clique of 'bad losers'in this particular case! Did he not say that elections are essentialy won or lost at polling station? So what is he trying to do here? Soothe his bruised ego; and at the expense of the honest and hardworking men and women of this nation?
Let me end by saying that only robots lacking in common sense and logical, will believe this preposterous claim of over-voting advanced by the petitioners. And as we all saw under Tsikata`s 'hot and heavy' cross-examination, this claim was 'manufactured' by Bawumiah and others who tried to hoodwink us with that constant and dubious refrain of "on the face of the pink sheet"; "you and I were not there"! The truth of the matter is that NPP party agents and outside observers,including the media,were there, and was not a single incident of over-voting was recorded. And that explains why no formal complaint was made at any of the 26,002 polling stations, across the length and breadth of the country.

At the moment, my sympathies largely lay with Mr. Akuffo-Addo, although I am an avowed Nkrumaist, because, contrary to what besotted nitwits like you shamelessly propagate, he has chosen to seek redress in the law, rather than resorting to the sort of violence you and your ilk will unhesitatingly unleash if you were to inhabit his circumstances.
Konfanko, unlike you, although I have reservations about Mr. Mahama's performance so far, I still see virtue in him, and will prefer to withhold my judgment about him for now; I will not ascribe unto him the sort of pejoratives you have heaped on Mr. Akuffo-Addo. Perhaps what did you in is your very patent infatuation with Mr. Tsatsu Tsikata. If you give the transcript of his cross-examination of Bawumia, and for that matter, his whole performance during the trial, to any disinterested legal scholar, the overwhelming conclusion will be that Mr. Tsikata lacked effective advocacy skills and courtroom mastery.

Selective amnesia! The case you quoted emphasizes that the election was conducted substantially in accordance with the law! How lawful was it for the EC to print duplicate, triplicate and quadruplicate pink sheets when according to its own Afari-Gyan, just ONE set was required?

When Afari-Gayn says “By verification we mean Biometric Verification”, what exactly does that translate into vernacular? When Asiedu Nketia says “Those were foreign materials,” how does that translate into “total votes cast,” in English?

In an election in which the difference in the number of votes between the supposed winner and the next contestant is less than 2%, you really believe that an aggregate error margin of 30% comprising “transpositional, clerical errors, voodoo arithmetic base of twenty seven- zero ” does not matter?

If the people who come to this forum constitute a fair cross section of the educated people in Ghana, it is not surprising that we cannot rid our national capital of filth, cholera, typhoid fever and potholes!

Tony Lithuania knows that and therefore tried to con the judges with argument that the right to vote is a device one i.e from God. We all know that that is absolute nonsense because it is a constitutional right that ought to be protected by what the constitution says.
