Anyone appoointed to any position in Ghana has to justify his/her continued employment by performace. Judges do not.
This woeful dissipation of national resourcces is universal. The President can oversee the destruciton of our national economy (the cedi depreciating up to 50% in some cases), and still manage to use the people's money to get himself re-elected in four years!
Some parliamentarians never make one contribution in parliament for four years, and still collect ridiculous "end of service benefits" at the end of EVERY four years, as long as they manage to convince tribesmen and village chiefs to vote for them!
What does the minister of information do to require two deputies? How much fish do we catch in a year to rquire a whole ministry with a deputy and chief director? When we have a failing education system in which whole districts score 0% at the basic examinationn level, what is the sense in the multiplicity of institutions/departments all overseeing education?
Coming back to the judiciary, commercial and other specilaist courts were created to expidite action on specialist cases. They all soon fall into the same snail pace adjudication process.
In the 21st century any court that cannot understand PowerPoint presentation, has no justification to exist!

These facts are known by every person that have had a case in court or been exposed to the Ghanaian court system. What will we say to a doctor that spends even more that 30minutes to make a diagnosis, given the right environment? Who and what are the causes, and to blame! LAWYERS!! The same way they have run down our political system, they have run aground the legal system. It appears to me lawyers live and breaths corruption and always looking for ways to twist the law they themselves make in their favor. What a shame. We all know why they collude with judges to delay and delay cases. It's just to extort money from their clients. Aaa for the Police and public prosecutors in the Attorney Generals office the less said about them the better. Look at all the judgement debts that are being paid? They destroy files, misplace files, and many times just don't care. Thank God the chief justice made sure we all saw the proceedings on TV. It just turn out there is no reason for such cases to take that length of time. Why cant the judicial system in Ghana learn from places as US which can have expedited trials? Well when you have a SC who does not want to work on holidays and weekends, what do you expect! When justice is delayed it breeds corruption. It opens avenue for people to manipulate, and money changes hands and influence so many people. In the end justice is not served. It's about time the rules of the courts are re- written, and old outmoded practices thrown away.

But the blame actually should be put at the doorsteps of the framers of the forth republic constitution who tailored it to meet the whims and caprices of Rawlings. There is no time limit in election dispute according to the constitution unlike that of Kenya. Does it make any sense for a constitution to allow a disputed president to be sworn in before commencing an electoral case at the SC? So, you see, John Mahama is exploiting this loophole created by the constitutional framers to cling on to power as long as he could. If you get so-called intellectuals who are sycophantic, mediocre and plain idiots to draft a constitution for a country, that is what you get!

It is true that the constitution was tailor-made for the coward Jerry Rawlings, but why haven't we done anything about it in twenty years? As you may remember, the PNDC with educated crooks like Kwesi Botchwey (who believed that it was a waste of time for politicians to leaf through the Constitution to look for faults), created a constitutional commission made up of illiterate PDCs, WDCs, mechanics, market women and and others and used their second rate lawyers to push their agenda.
President in Kuffuor as a trained lawyer, had the opportunity in his second term to do something about the Constitution. Instead, he busied himself awarding medals and awards to himself.
The monarchical powers that the Constitutions confers on the president to dash state monies and other favours to friends and cronies is very appealing. It will require civil society, all of us, to do something about it. Any country whose president can overspend the budget of his tiny office by as much as 600 million in a single year, is just a banana republic!

Take a look at the Second and Third Republican Constitutions, read the language of it and you will get my drift. I don't trade in insults. I am way, way above that!

with regards to the length of the ongoing SC case, I agree it is taking a long time, but how do you propose we tackle that? Should we for instance limit the number of witnesses who should be called ( that was done in this case to speed up the process I believe)? Should we limit the number of days a witness can be cross examined? (perhaps, but then again you will be the same person complaining)?
Should we limit the number of people "joined" to the case? (I argued from the onset that I did not see any good reason for there being three petitioners; likewise there being an NDC joiner in the case but once the petitioners had set a precedent and been allowed to, with Bawumiah and Obetsebi-Lamptey whom I still cannot comprehend his role in this whole business, the justices had no choice but to accept the NDC/Nketiah being joined to the case).
You see the trouble here is not about the system, but about the same human beings who want the system to work for them. Why was it not a straight forward petition by one person (Nana Addo) or one party (NPP) AGAINST the Electoral Commission (not the commissioner)? Why join the president and the NDC to the claim? Why accuse them of collusion and why accuse the EC of working for the president and favouring him?
Surely if (as has turned out) the issue was primarily about omissions, irregularities, poor administration etc. which were PROCESSES associated with the FUNCTIONING of the EC and as appears to be the case, these were human errors (however massive the scale) but not planned and orchestrated in connivance to defraud and to FAVOUR ONE PARTY OVER THE OTHER,then why on earth was the NDC and the president drawn into the matter in the first place.
If the petitioners had followed commonsense and proper due process, we might have had the whole process finished with one month of the elections and got the country going and spending our money in the right things.
From your posting, the only key lesson I think we can glean, and should learn is how in the future to prevent such a silly approach to petitioning the courts on matters such as this, and the courts to make sure that such an extensive petition which does not make much sense, is not allowed to be put forward. The court must perhaps be more proactive in directing petitioners to limit their petition and focus on the actual FACTS pertaining specifically to their grievance so that the court's own time is not wasted and tax payers' money is not wasted.
I would vote for that and hope you would too. I hope you see the sense in what I am driving at. We won't need all the nonsense from the media and pundits such as you and I and will not take so much media and television and work time!!!
Let's cut the crap and focus on serious matters. Let's also writing for the sake of it.

So what on earth is the big deal?
Now all these costs for the country just because of the ego of some disillusioned and unproductive one person.
If Akuffo really is interested in the fortunes of the nation--why not use his wealth to establish a scholarship for SS students--rather than his idealized notion of using would-be "borrowed" money to establish free secondary education.
And then for those graduates of the borrowed free education to spend the rest of their lives with poor wages to pay back that borrowed "free" education money.
Its all foolishness--if you ask me.

The Kenya constitutional provision on adjudication of electoral disputes heavily favours the winner of the elections as declared by the electoral commission. It gives a very limited time for a judicial challenge to be launched and such a case to be determined.
The Ghana constitutional provision tries to be fair to all sides by not stipulating how long a case should take.
Given that this is the very first time that we have had such a case, the SC judges have been careful to be seen to be fair to all sides, so that a final verdict is accepted by all.
It is unfair to suggest that they have deliberately dragged this case for personal gain.
