In reference to regulation 19 of C.I 75 stated in this address, grounds 1 and 2 as stated says a candidate MAY appoint and not SHALL appoint. which means is optional and not mandatory. Article 64 of the constitution also said a person and for that matter a Ghanaian can challenge the validity of a presidential election but did not say a political party. This means, agents are for political parties and i dont need to have a report from any polling agent to challenge election results if as an individual i see that the election was not conducted well. It is the contention of petitioners that the constitutional responsibility of the conduct of public
elections and referenda including the 2012 elections, has been entrusted to the 2nd
respondent by article 43 of the Constitution. The 2nd respondent can not relinquish that
constitutional duty to the polling agents or anybody for that matter. our Honourable Court
has had occasion to pronounce on this point in the case of Apaloo v. Electoral
Commission (supra).
The observer status of polling agents under C.I. 75 was clearly confirmed by
the Chairman of 2nd respondent under cross-examination on 13th June, 2013 (pages 21, 25-
26 of the record of proceedings).
Q. You are aware that the functions of a polling agent are strictly
circumscribed?
A. My lords I would say so.
Q. They are not election officials?
A. In the strict sense of the term, no.
Q. I would like you to read Rule 19(4) of C1 75?
A. WITNESS READS OUT
Q. So I am suggesting to you that it is not the business of the
polling agent to supervise the work of the election officials but
to observe the conduct of the poll?
A. My lords I agree that the agent is not supposed to supervise but
he plays an active role at the station.
At pages 25-26 of the record of proceedings for the same day, Dr. Afari-Gyan made the
point about the very limited role of polling agents abundantly clear.
Q. A polling agent is not involved in the actual administration of the
election?
A. My lords you are correct.
Q. He does not count the votes after the election?
A. My lords no.

Q. He also does not inspect the ID cards of persons who are in the
cue to vote?
A. My lords no.
Q. He cannot confront anybody directly at the polling station?
A. My lords no and for that matter nobody can confront anybody
directly at the polling station.
Q. if he has any objection to anything happening he has to inform
the presiding officer?
A. My lord yes.
Q. So the presiding officer is in-charge of the polling station?
A. My lords absolutely.
Q. He has the final say on any matter?
A. So far as it is connected with the election yes.
Q. In fact the presiding officer can ask the polling agent to leave
the polling station.
A. My lords yes if the polling agent misconducts himself or herself.
Q. And who determines who misconducts himself, it is the
presiding officer?
A. Yes it is the presiding officer but misconduct they are trained to know how mis-conducting oneself in a polling station is. lets juxtapose these issues and judge for ourselves

National Peace Council did not enable anyone to be declared President nor did they prevent anyone from being declared. As mediators, they facilitated the dialogue between the parties. They did not take any decision for anybody. Afari Djan took a decision as given to him by law to do,ie, declare the candidate who had made 50+ votes, the winner,in the absence of subsatantive evidence to the contrary. At the time only allegations were made. He did not fail to advise your party to exercise their right as by law to take him and the EC to court if they so desired, when armed with what they considered to be evidence! Remember in 2008 Afari Djan had to reminded overexcited complainants that 'the name of the game is evidence'. In 2012, he was forced to repeat the same advice!!! So what kind of misinformation are you promoting, brotherman!

UNUSABLE EXHIBITS AND EFFECT ON POLLING STATIONS IN ISSUE
34. It is striking in respect of exhibits in the P-series that large numbers of them are simply unusable for the purposes of determining the identity and/or number of polling stations in respect of which allegations are being made. In Appendix A.2.13 where data is captured in respect of the P-series, there is a glaring anomaly revealed whereby, for instance, (on pages 145 to 149), the first 171 sheets relate to MB-P, MB-P 000001-000170 and are followed by another 171 sheets (on pages 149 to 154) also with Exhibit numbers MB-P, MB-P 1-170 but with different polling stations in each case. On pages 162 to 175, data is captured for Exhibits MB-P 476 -1234 and followed by MB-P 476 -814 (pages 175-184) which have different polling stations from the earlier MB-P 476-814 exhibits. On pages 190 – 199, there are exhibits in the range MB-P 2314 – 2632 with different polling stations from a subsequent set that goes from MB-P 2314 on page 225 to MB-P 2613 on page 227. There are more instances of such confusion in relation to the exhibits, but the above should suffice to demonstrate that, in all these instances, the polling station to which reference is being made in the provision of evidence cannot be identified without a resolution of the contradictory sets of exhibits.

It is obvious that NPP leaders and followers admit that based on the merits of proceedings so far PRESIDENT MAHAMA won the elections hands down. Rather they are trying without success to capitalize on administrative of computation to disenfranchise innocent voters. No doubt they are hiding over 2000 pink sheets from the court for scrutiny. Politics has succeeded in transforming an intellectual into a moron who seems to forget his simple maths calculations.
