Ballot stuffing and overvoting are two different things. Ballot stuffing leads to a condition described as overvoting. The problem here is, there is no concrete definition to overvoting since the 92 constitution came in place but one party wants to take advantage of the loopholes in the constitution to wreck havoc. Attugubah cannot be the only one defining overvoting since he alone does not make the constitution. The blame should be placed on the Judicial committee in Parliament who did not see this coming when approving CI-75 last year before the elections. Even Dr. Afari Gyan could not define what overvoting was but referred to a classical definition used in 1966 where over voting meant number of ballot papers in ballot box exceeds number of registered voters on the voter's register of a particular polling station. Out of this confusion including that of the author here (Mr. Badu) we need a definition that will stand the test of time so generations to come would not suffer what we are suffering today. My suggestion is overvoting occurs when the total number of ballot papers in the ballot box, counted at the end of the poll, exceeds the number of ballot papers issued to voters on that particular day at that particular polling station. The number issued to the voters should equal the number of ticks made in the register by presiding officer or assistant and should also equal number of counts on biometric verification machine. This is the only sure way forward. The biometric device is only a means to an end (for verification) and not an end in itself, whereby a breakdown in the stupid device should call for confusion at the polls. Things would have gone the petitioners way if they had asked for a re-run at the affected areas but because of parochial and selfish interests they only asked for the interest of one person to become president and not thinking about the masses. The judges were thinking about the masses so asked for a re-run in affected areas, not unseat someone for another to come and chop. The NPP did not ask for a re-run because they had screwed up by using results in the strongholds of the NDC. The petition made no sense. There were 26,002 polling stations so why come up with analyses based on 24,000+ only. Does not hold water, does it? Where are the remaining 2000 polling stations? Are they in the NPP's strongholds? Then the dynamics of the analyses would change. For those saying the petition leads to electoral reforms go and check the facts, there have always been reforms after 1996, 2000, 2004, 2008 and after 2012 there will be reforms, We dont need court action before reforms. It was just a waste of time. You can learn court proceeding from the library or watching TV series on law. Listen to Attugubah's concluding statement of common sense lacking on the part of the petitioners and I quote: To sum up the result sought by the petitioners in this case would involve what Mackinnon J protested against in British Photomaton Trading Company, Limited v Henry Playfair, Limited (1933) 2 K.B 508 at 520 when he said: “this is a result against which one is inclined to struggle, because it tends to outrage both common sense and what is fair.” (JSC Attugubah, 2013, page 48 of judgment). Sometimes when you want to play too wise, you end up looking a xxxx.

When you take ballot papers, not issued to voters at the polling station and stuff them in the ballot box you are creating a situation of overvoting where the number of votes in the box is more than the number issued to voters at the polling station. There is no definition of overvoting and that is why lawyers spent hundreds of hours in court trying to prove overvoting. Was Dr. Afari-Gyan able to define what overvoting is? Have you read the judgments? None of the judges was able to point to exactly what the law's definition of overvoting is. Yes we need an agreed definition on overvoting. That is why parliamentarians are paid to enact laws. Since you think there is a definition of overvoting in our constitution, roll it out here for all to read. We will be very grateful.

If a ballot box goes over the required number,you don't need a group of lawyers to make a determination. For instance where a presiding officer issues 50 ballots and at the end of voting you find 58 EC stamped ballots in the box, people with reason and conscience should know there is an excess, I mean over. Having said that, we do not necessarily have to enact laws to guide us as to constitute over voting,---it is apparent. If we have record of the number that suppose to be in a ballot box, and we find it to be different, conventional wisdom will tell us something is wrong.

Some are comparing it with the number sent in to the polling station from the printing press. Others are comparing it with the number of registered voters on the voter's register. Some too want to compare it with the count on the bio-metric machine. Even a fourth group wants to compare it with the number of ticks by Presiding Officers of eligible voters who came to vote. Yes this is clearly a possibility but this situation can be checked and corrected administratively at the Polling Station level and thus need not be sent to the Supreme Court and get the nation to sit on tentahooks for 8 months.
How can this be checked and corrected?
1) By first checking the serial numbers of the ballot papers in the box to ensure that only the serial numbers of ballots issued at the polling station are counted, thereby eliminating all ballots with out of range serial numbers or ballots with duplicated serial numbers.
2) Check all ballots in the box for the polling station stamp and signature of Presiding Officer.
3) Many other administrative checks can be conducted at the polling station.
