  The judges did well, all of them. But i am still trying to figure out how someone can interprete the constitution so literally as to imply that the non signature by an individual( presiding officer),among array of actors at the polling station, can cancel valid votes!How on earth can the constitution be saying that!

  The prescripton for a re-run of the elections in the affected areas,was an OUT the minority judges wanted to afford the NPP to reverse thrir political fortunes. But given the realities on the ground, was this strategy going to help the petitionerss in any way? Not in my humble view,because these are,in the main, Mahama strongholds which the sore losers had deliberately targeted.
  And if the case/allegation of the petitioners` always preceded by the word WIDESPREAD this or that, was to be taken seriously,why were their strongholds virtually left untouched?
  Were those areas somehow 'immune' to the to the so-called "FATAL" shortcomings of Dr. Afari Gyan and his EC officials?
  If the minority side, which expresses belief in a strict interpretation of the constitution,was true to this utmoded principle,why did it not proceed to order new elections on the grounds that the entire results had been tainted,especially where the categorization of the petitioners kept changing constantly, and the computations it seemed to accept,showed nobody achieved the sacred threshold of 50 plus 1?
  These Justices who sought to take the narrow view of the constitution,put themselves in an awkward situation, because were unable to apply their sacred doctrine to its logical end.
  Thank God their side did not prevail!

  Only fools and brain dead will think the Supreme Court can elect a President. What is the point in organizing elections if the power to elect a president is vested in the supreme court. This can happen in Ashanti/Akyem area not in Ghana. Fortunately NPP lost the election and wanted a backdoor deal which never worked.

  Good article,and well explain.Even Nana Akuffo-Addo himself prior to the petition hearing
  spoke eloquently about the sanctity of the valid
  votes cast,and how these votes are the essence of democracy(not the exact words).

  a signature goes to affirm the authenticity of the votes. imagine where the same voters cast their votes and after recording them, a presiding judge swaps the authentic document and replaces them with a doctored one.
  
  I will agree that once there are more than enough evidence of other players authenticating the report then irrespective of whether a presiding officer signed or not should not be enough basis for annulment of votes. but in all cases the stringent of proof must be applied to authenticate and protect the ballot.

  And to me, giving the prevailing political climate we live under, the argument being advanced, in some quarters, that we should be able to rely soley on election officials to safeguard the intergrity of the voting process,is even bizarre!
  Do we not hear howls and protests about election fraud during intra-party contests like party primaries all the time? When are people like Sir John going to accept defeat graciously in this country?
  Let`s be honest with ourselves and admit the fact that many of us pay mere lip-service to the idea of democracy in this country!

  Do not also deceive yourself or misinform your readers that because the petition was rejected by a 5-4 majority only the reasons averred by the majority Justices become the (case)law. No, you are wrong. Until the reasons given by the minority Justices are found to be perverse, they can also be cited as authorities (case law) in the future.
  
  I am shocked you stated that President Mahama "should be congratulated highly for allowing institutions of state like the Judiciary to freely function when his presidency was at stake". Why should he be congratulated because the President has no powers to stop the Judiciary to function freely whether his presidency is at state or not. You appear to be either naive or ignorant of the 1992 Constitution and the powers of the President. I suggest you take some some to read and understand the constitution because such a statement from the ruling party's Communication Director in Germany is dangerous.
